It's framed and hangs in my kitchen. My requests for a few of her items of no real value when she passed were ignored but at least I have those things.
I feel that the daughter was sue happy in this case and saw an opportunity to try to get as much money as she could! The dad was cremated and they are burying him not scattering the ashes so she would still have the clothing with her dad, she says it has nothing to do with money but then asks for an insane amount, I think the $500 was more than a generous offer and that's what the judge should have awarded, I probably would have awarded her maybe $200 because I think she got greedy.
How can one say it's not about the money, but sue for 10k? The funeral home definitely made a mistake, but saying it's not about the money and suing for the max seems like it's about the money. I feel bad for her loss. I hope she realizes clothes and smell are not the only memories she has. Hopefully, the memories in her head have more value. She's definitely hurting. Someone from her circle should have told her the max she's suing for wasn't going to win. RIP, hopefully, she has coping skills to get thru this loss.
The funeral home director made me laugh a little bit at the end when he was talking about his hopes of future business from the family. Like...I honestly wouldn't want to work with people who sued me for $10k.
The crematory I worked at made sure to have a form that says the clothes will be burned. Anything that needed to be removed was done prior to the decedent being placed in our care. Also, the clothes are likely soiled, damaged, bloody, and smell like death.
As a individual who have performed a few hundred cremations, COMMUNICATION and documentation is VITAL!!!! It sucks to make mistakes like this but it HAPPENS honestly😔.
There is clearly something else going on with her that has nothing to do with the Defendant. She needs to see a therapist. There was no intent or malice here. She has to think logically rather than emotionally. There is no way that her father would want her to be suing or fighting over his clothing.
when she said other family members are fighting over a sweater the alarm bells started ringing by me, because if she was given the 10k she would of kept it all for herself, because not once did she say shes doing it on behalf of them, and another court case would of taken place ,
I do have some keepsakes, but the most valuable things I have of my Dad are all the memories through the years and the fact that through time we became less like father and son and more like friends. It was very comfortable and we got along just great.
If that article of clothing was that important, she should have held onto it and dressed him in something else. It’s unfortunate that the mistake happened, but it was just a mistake. She should have gotten the depreciated value of the cloths and everyone could move on. Not everything has to be an emotional battle, especially material things. Lastly, I would not want my parents naked waiting for cremation. Hopefully she finds peace and can learn to remember her father in a non materialistic way.
6:30 I love it when they say it's not about the money because it is! They took full responsibility and tried to make it right with her, but that wasn't good enough. I want every dime I gave you and more... It's about the money!
I hope if the plaintiff watches this (after she's healed sufficiently from her grief) she can gain some perspective on what is truly important to exert her energy on in this life.
You gotta be kiddin, sue over clothes being creamated with the person? Really? One reason I never go to a funeral.Seen too damn many fights in my own family when a member dies.Ain't worth it.
I can't imagine fighting over "things". Yes, the funeral home made a mistake and they owned the mistake. She made the comment that her family was fighting over a sweater... sad. The passing of a loved one can bring out the ugly in people. I think the plaintiff saw this as a way to make a little cash. The defendant seems like a very nice man.
and believe me, if she got the 10k she would have kept it all for herself, and if other families found out they would of taken her to court again to get their fare share, lol yes so sad,
The defendant reminded me of Marcus Welby MD - from the old TV series - seemed very kind and professional. Condolences to the plaintiff, grief is heartbreaking.
Thanks for the Asheville shoutout! We love you, too! It is beautiful here, but coincidentally (?) several people have been killed or injured or property destroyed by some large trees…specifically on the property of the Biltmore House!
Death is always absolute, so even a moron knows its one of the best businesses to have. He didn't do anything wrong nor was he being morbid. You act like you're exempt from death and any mention is soooo offensive. Get over it
If it wasn’t about the money as she claimed afterwards talking with Doug, then why sue for 10K? If it’s just the principle sue for a small nominal amount to prove your point. Plus the defendant did admit their mistake and tried to rectify it, but that wasn’t good enough. Sorry, she made it clear it WAS about the money. You don’t honor your loved one by getting greedy. That’s unfortunately what this was all about. I just do not believe her.. sorry..

I'm disappointed Judge Milian gave her $1000. I think the $500 was plenty more than appropriate. I understand the plaintiff's pain but turning your grief into greed is ugly. She wouldn't REALLY want those particular clothes - they would reek of embalming chemicals and death! And I hardly accept that that man had only the singular outfit to wear in life or that her siblings pettily bickered over the division of his remaining basic tshirts, underwear and jeans to the tune that none could be spared for her!
I understand her pain. I would've lost my ish if I didn't get my father's favorite shirt & tie after he was killed. However, here I sit, 21 years later, and instead of smelling his shirt or looking at his tie every once in a while, I look at the pictures of him wearing them. If I didn't have those 2 items, I wouldn't have been able to heal & accept his death. I would NOT sue anyone for them or all she tried suing for, though!

She wanted them to strip her dad off his clothing to be cremated so that she could keep the clothes in her drawer. Am I the only one who thinks that's not the best idea? This is definitely more greed than grief.
As a pastor, I will say this...people grieve in all sorts of ways. Many fight about money and things. It's is really sad when this happens. The training I received is to help the family grieve but also to keep them from making mistakes as they grieve. By mistakes, I mean things like buying the most expensive casket(the person is dead, they don't need the air tight silk lined model) putting value in things in a way that is unhealthy, etc. I would say wanting to put ashes in jewelery to carry around all the time is a little strange(people actually want to do this...) Putting this much value on a pair shirt and pants, that is also in the strange realm. I mean, how long are u gonna keep hisndorty underwear? Part of grieving is holding onto the right things and letting go of things that do not matter. There is no right way to grieve but it sure can make you do some unhealthy and silly things. Wow $1000 for a shirt and pants...that is kind of excessive.
I worked for a funeral home and discovered there were caskets for as little as $500 dollars. My late husband and I discussed this and when he passed that was exactly what I purchased. He has a nice site in a small well maintained cemetery in the country (which he would have loved) I still purchased a nice headstone for both of us along with a vault. I have instructed my son and his wife to buy the same coffin for me. No one is going to pay attention to the coffin and though most of my arrangements are made I don’t want them spending the life insurance on things that don’t matter and there will still be expenses.
@@carolyndavis6657 You’re better than me. I want a decked out coffin (lol, but I’ll pay for it myself), but I want archeologist to find me one day and mistake me for a queen. 🙃🤭
@@wackybrattyx haha...That is great particularly if you plan ahead. I don't think you have to be buried in a potato sack but some people really go too excessive. Funeral costs can be really burdensome to those we leave behind. If we can't bless them with some $$$, I guess the logic is that we shouldn't leave them with bills to pay. I have had people leave their entire fortune to the church, with none going to the family. It is super awkward particularly when we are talking a lot of money, life changing money. What I read from that is that the family never took interest in what was important to this person, the church did. Despite what people might think in these cases, we pastors do not ask dying people for money. Well trained one's just encourage people to plan early and the church lands in there somewhere. And "plan" means everything from finances to the hymn and scriptures they want read at their funeral. They have an opportunity to take account of their life and what mattered to them. Also, in most of these cases where money is given to the church, the amount is designated to something specific, like ministry to children, the garden, music program. The church is legally bound to spend it in the way it was designated. It is about honoring the deceased, not about the pastor or church lining their wallets. It's crazy what people say when their loved ones snubs them from what they perceived as their inheritance.
I understand that grief takes on all different emotions, expectations, and can even make thinking clearly difficult. It's a very long process to get through and isn't linear. That said, she really can't truly believe that this mistake was worth 100% free services/labor + extra, right?? She took this opportunity like no other! When my mom died unexpectedly last year, I couldn't stay focused on anything long enough for nearly 6 months after, let alone could I go through the process of suing someone in the midst of my grief.
I have been widowed twice. I would never sue for clothes or argue with family members over a sweater. Yes, JM is right. Their father would be ashamed of this situation. They need to be united in honoring his memory and get over the material items.
I agree. I'm a widow as well (he's in profile pic). I understand how hard a loss is. This to me seems like greed & biting off more than they could afford with funeral & burial expenses. The $500 offered feels very fair, but since CA does give sentimental value $1000 will go towards the $7000 they still owe towards the burial.
@@lilbutterfly6977 lovely picture! .....(and yes, greed or ego or some kind of mental health condition, whatever created this case, definitely not love and understanding) JM's ruling was fair. I agree with you. Why spend so much on a funeral? I know some religions promote this. They are just showing off or obeying their church. Like our Doug has said - It's a very sad case.
@Diane Allen I'm not saying they don't. Trust me, I'm a widow; I know what it's like to go through your loved ones' belongings & try to decide what to keep & what to do with the rest. You feel like if you throw anything away, you're throwing part of them away & if you give/donate it, you're giving part of them away as if they don't matter anymore. It's EXTREMELY hard. Fact is, you can't keep everything & in the end it's just stuff. You can't take it with you when you go, so you keep something small & meaningful that you can pass down; that'll keep getting passed down from generation to generation. Honestly, unless it's like their military, dress blues, wedding dress, or something of that nature, clothes, for the most part, are going to end up being discarded in one way or another.
My dad’s old dirty work cap was the most coveted thing for us. He didn’t have much so it meant a lot. I can’t imagine someone burning it up. A keepsake has value. Since you can’t sure for for emotional pain what’s so wrong about monetary compensation? It’s also about teaching the offender a lesson to be more careful. I’m sorry so many of you don’t have parents you love. I loved mine.
What a ridiculous law to be able to sue over “feelings”, but of course I can’t be surprised coming from California. 🙄 I made a gorgeous art piece out of one of my fathers shirts and watch and sometimes these items can being peace, but no amount of money will make it better.
Everyone grieves differently. I turned into a monster when it was time to bury my dad .. so much hurt and anger 😢 I was upset that the grave site wouldn’t accept the concrete slab and we had to get a small headstone because my sister and I spent most of our money on the slab 😒
I am shocked that the courts would waste their time with this case. I would have thrown this one out. This lady is incredibly greedy. “It’s not about the money” but I want all of my money back, and then some. Get real lady. Sorry your father died, but funerals cost money. I’m sure most people don’t hold on to all of their deceased loved ones clothing, if they do, it’s not for long. You can just see the greed, she wouldn’t even allow her fathers sister to have some of her brothers ashes. I wish Marilyn would have ruled in favor of the defendant, or at least awarded less than the $500 offer by the defendant. Award her the depreciated cost of the clothing, so $20 would have been more than enough.
That’s all she has to remember him by? Are you kidding me? So the pictures, other clothing and shoes he had, personal effects, jewelry, etc divided between siblings doesn’t count? How about all the memories? $ 10,000? I’m thinking this is a money grab.

Sit down. You’re wrong.
I agree!
i woud say mabye 50 dollars
This lady is crazy, her whole family is too, fighting over a sweater wow, they all need help.
The woman said she is suing over a shirt, pants, belt, underwear, and socks.
Clearly she does not have the skills to deal with this
it was maybe worth 50 bucks
The funeral home director made me laugh a little bit at the end when he was talking about his hopes of future business from the family. Like...I honestly wouldn't want to work with people who sued me for $10k.
I interpreted it as him low key saying he wished then death 😅😅😅
The crematory I worked at made sure to have a form that says the clothes will be burned. Anything that needed to be removed was done prior to the decedent being placed in our care. Also, the clothes are likely soiled, damaged, bloody, and smell like death.
smell like death ??? how is it the smell?
@@estherjeudy23 decomposition produces a horrible smell and unfortunately dead bodies start to decompose rapidly.
@chasityd3252 i guess she doesn't know that
The hugest error was her asking for the funeral balance for compensation.
It is clearly about the money. So embarrassing for her.
She put on a good performance!
Yes, especially at the end, trying to soup up the sentimental value of the clothes. Smh
Oscar worthy 😂. “Not about the money” …..got it
If that article of clothing was that important, she should have held onto it and dressed him in something else.
Smh you have no soul
6:30 I love it when they say it's not about the money because it is! They took full responsibility and tried to make it right with her, but that wasn't good enough. I want every dime I gave you and more... It's about the money!
She keeps saying "it's not about the money"
Yet she was suing for 10 thousand $$$
She's ridiculous!
Exactly!!!
I hope if the plaintiff watches this (after she's healed sufficiently from her grief) she can gain some perspective on what is truly important to exert her energy on in this life.
Nicely stated.
The plaintiff is full of crap. It's nothing more than a money grab. It's hilarious when she tries to put a spin on it.
You gotta be kiddin, sue over clothes being creamated with the person? Really? One reason I never go to a funeral.Seen too damn many fights in my own family when a member dies.Ain't worth it.
It's not about the money....but in the next breath she says whatever you can award.......please
I can't imagine fighting over "things". Yes, the funeral home made a mistake and they owned the mistake. She made the comment that her family was fighting over a sweater... sad. The passing of a loved one can bring out the ugly in people. I think the plaintiff saw this as a way to make a little cash. The defendant seems like a very nice man.
and believe me, if she got the 10k she would have kept it all for herself, and if other families found out they would of taken her to court again to get their fare share, lol yes so sad,
Your dads sweaty underware isn't going to bring him back dear!
The defendant reminded me of Marcus Welby MD - from the old TV series - seemed very kind and professional. Condolences to the plaintiff, grief is heartbreaking.
This was a very strange case.
She chose 10,000$ because that’s what they owe on the funeral!
Thanks for the Asheville shoutout! We love you, too!
It is beautiful here, but coincidentally (?) several people have been killed or injured or property destroyed by some large trees…specifically on the property of the Biltmore House!
I feel like the plaintiff is so full of bs over some clothes. She just wanted that money off. Those were definitely fake tears
She put on a show!
Soon as the judge said “CA permits you to collect more” this lady needs to stop.
The funeral director hoping for the family to come back to them for repeat business sounds unintentionally so morbid, lol.
Gotta drum up business; there's lots of competition out there! 😉
Death is always absolute, so even a moron knows its one of the best businesses to have. He didn't do anything wrong nor was he being morbid. You act like you're exempt from death and any mention is soooo offensive. Get over it
i absolutely love it. i hope this man has extremely dark humor
I just do not believe her.. sorry..
"It wasn't about the money." Oh, yes, it is. Nobody sues for old clothes; it's all about the money! Judge failed! Second-hand jeans, shirt & underpants for $1000. Stooooooooooooooooooopid!
Omg. She literally asked them NOT to burn them. It doesnt matter if they were second hand
@@Jahmai203 she would’ve got $500 without wasting the court time suing for $10k. That’s more than enough for stupid clothes. Even with sentiment. You don’t get more money for a dog than it’s worth no matter how it dies or how much pain it causes. Some clothes come on
Did you not hear the judge repeatedly saying that it’s California law smh
I'm so sick of people saying "it's not about the money" It's about the money or you wouldn't be in court. I understand she's upset and they made a mistake and offered her what they could. Just like she said no amount of money can replace something that's sentimental value, so why didn't you take the $500 and let it go. Because it's about the money !!!!
To each their own but I can't imagine ever wanting the clothing a family member's corpse wore, especially when I saw them dead in it (the viewing). I could see keeping something from their closet but not the corpse. I think it's creepy and gross.
Yea, unbelievable. She used those old No name brand clothes for money!! 😂😂😂
Her dad was homeless? The plaintiff is trying to profit off her dad's death.... shallow shallow plaintiff.
A watch, a ring, yes, but worthless clothing is a bizarre thing to hold on to. Kudos to the plaintiff for the tears, though.
Yeah, tears only started coming when the judge said that in Ca you can sue for passion or sentimentality. Tsk tsk tsk …
Why would you want the clothes he wore after he was deceased. Keep his favorite clothing he wore while he was alive. It most DEFINITELY is about money!!!😥
I’ll never understand why people bury ashes. They couldn’t even afford it.
It is cheaper than a casket.
@@Aceofwolves if you can’t afford a casket how can you afford to bury the ashes? That’s still a plot at the cemetery which is thousands.
Soon as I heard she wanted ten grand for the clothing I knew she had to be from California
What baloney. This is a money grub, plain and simple. Disgusting.
So if she has the ashes, then keep a portion and burry the rest. That’s more meaningful than a few pieces of clothing.
To you!
I didn't have anything of my grandmother's when she passed, so I got a tattoo in her honor, and I'm blessed that I have all of my. Memories with her. I don't think I would ever sue because I didn't get her sweater.
Once she sees she's losing, the tears come on. She's greedy af
I told my kids to "Bake Me" in my Darth Vader Costume! When it's time, that is.
in other words if you're a great actress, you get more money. $500 is more than enough.
She is stuck in a very unhealthy grieving process; his clothes is not bringing him back.
This woman is Nuts if she thinks J.M. Will entertain her ridiculous did she expect her Dad to go without his clothes.Shame on her to come to court and make her Dad's last day on earth be remembered with her shenanigans it just beggers believe what she has done.
Stop it lady, stop it...
“It’s not about the money”What? It’s obvious ALL ABOUT THE MONEY! It’s a shame this happened, but she’s trying to turn her dads death into a money grab. Sad behavior on both sides. 😢
Exactly.
and if she got the 10k believe me she would of kept it all, because her answer that the other siblings are fighting over the rest of the clothes, says all, when my father passed on he left a large amount of money behind, when it was paid out all 3 us siblings went and invested the money, and now 10 years later its helping me live a very good life being on pension,
On second thought...the plaintiff is a bottom less pit of shame.
She wanted his underwear and socks too...
$500 isn't enough. They need to learn a lesson. Can never undo a mistake like this.
@@jeffkilpatrick6204 🙄
@@jeffkilpatrick6204 it's clothing. let her go to kmart and buy new threads. she's just pissed he didn't leave her any cash, if he did she wouldn't be doing this dumb shit. she's done this before with other things, obviously, she's an opportunist.
She should've looked for that bottle of cologne as well. Does she think the smell was going to stay forever?!?!🤔
Nobody believes it's not about the money...with her. Tune in next year when it suddenly comes to light that she actually hated him.
"Its not about money" lol
"But I want $10,0000 for an heirloom handkerchief"
She wanted them to strip her dad off his clothing to be cremated so that she could keep the clothes in her drawer. Am I the only one who thinks that's not the best idea?
This is definitely more greed than grief.
I understand it’s priceless to smell your loved one on cloths. No money will fulfill that. ❤
@@wackybrattyx actually I would love a beautiful pine coffin (no they aren’t like the ones in old westerns) but my frugal side won’t let me!
@09timae Lmbo. Of course my Queen.
She so lying she wants the money its just a money grab
Maybe it means that Dad gets to wear his favorite clothes forever!
The material items had sentimental value.
Widowed twice?! 😮 You probably didn’t care about the clothes, just those insurance policies.
What a cash grab! 😮
She wanted 10 gees for stuff her Pops bought at the indoor swap meet?! Ummm okay 😂
This lady is out of touch with reality. If any money received is a blessing then why wasn't $500 received and a blessing?
What a ridiculous law to be able to sue over “feelings”, but of course I can’t be surprised coming from California. 🙄
I made a gorgeous art piece out of one of my fathers shirts and watch and sometimes these items can being peace, but no amount of money will make it better.
I'm over this plaintiff
I'm sorry for her loss and this unfortunate incident, but come on. $500 was very generous. Take it and move on.
She’s a good actress LOL
Everyone grieves differently. I turned into a monster when it was time to bury my dad .. so much hurt and anger 😢 I was upset that the grave site wouldn’t accept the concrete slab and we had to get a small headstone because my sister and I spent most of our money on the slab 😒
Leave it to California to allow additional compensation on this issue. SMH
I agree!
They always say it isn't about the money.
$10,000....yeah right ✅.
It was about the money, she wanted to pay off the debt the family owes on the bill.
