  • The plaintiff says the defendant towed his pickup truck and damaged it. He claims the defendant won’t take responsibility for it, so he’s suing him for damages. The defendant says the plaintiff blocked someone’s driveway, so the flatbed tow was warranted. He insists the plaintiff inspected the truck when he retrieved it and all was fine.

    I wonder if he could've asked the neighbor to share the ring camera recording of the tow, that would've cleared up any possibilities that they loaded his truck inappropriately.

    I'm truly surprised JM was so easy on the defendant for not having documentation of the tow. They have a responsibility to document everything(damages noted before tow, etc) to cover themselves in these events. It's awfully suspicious this defendant didn't keep any paperwork, especially considering the plaintiff contacted him regarding the damage the very same day. He had to know this could end up in court. Very suspicious.

      Because it’s on the Plaintiff to prove it happened his way, once the Plaintiff does then it’s on the Defendant to prove it didn’t happen that way or prove that even if it did happen that way the Plaintiff waived away the right to blame them for it, except for gross negligence or they rigged it to temporarily hide it.

      they were probably busy that week and did not keep up on all the paperwork for all the tows and it was not a police tow situation where the courts have documentation , it was a private homeowner calling the tow company .

      The burden of proof is on the plaintiff tho, it would of been nice for the defendant to bring evidence but it's up to the plaintiff to prove his case

    There’s no way the plaintiff would not have noticed two flat tires on the SAME side of his vehicle. As soon as he sat in the driver’s seat, he would have realized that the vehicle was more-or-less “leaning” to one side. Also, who picks a vehicle up from a tow yard, and doesn’t even bother to walk around it once? Ridiculous

      There are a couple problems with what you're saying, one your car isn't automatically going to be leaning enough for you to notice, two there may have still been some air in both of those tires until he actually started driving on them, that has happened with many punctured tires, he says he drove at most half a block before he noticed the tires were both flat, and you and I might both walk around our vehicles and inspect every inch of it but not everyone thinks like that or would do that, that doesn't mean that the tow company isn't responsible for damage that they caused, in fact this is more likely than not that this tow company did cause the damage, just the fact that the defendant brought in absolutely no paperwork to show how the tow was conducted is enough to show his guilt. He knew that if he brought in the paperwork showing how the tow was conducted it would hurt his case! he didn't forget his paperwork that was done purposefully.

      @@al3220 If the tow had punctured the tires, it would have been leaking air from the Saturday they towed it until he picked it up on the Monday. So probably 36 hours of leaking.

      The stories for sure will be missed but the two judges whose only real claim to fame is how loud they can yell and how rude and obnoxious JJ can be. I do believe Judge Milian can easily out screech JJ. My ears hurt after Peoples Court!

    If I get in my car and it doesn't feel like it's sitting right, I get out and look at my tires. As soon as I start driving I can feel a flat tire.

    As an auto tech with over a decade of experience I’m 100% sure the tow popped his tires. The heat shields underneath rot out all the time or the shop that used a “forklift” to move his truck damaged them. If he just had a little more proof.

      I towed for years with J hooks on the A frame [f/wd hooks down] iv'e went under cars w/ rear w drive putting veh. in nuetral to make it roll and used clamps in front never cut a tire.@@MWAmos

    I have a buddy that works at my local Mavis tire and brakes , he's heaven sent🙏🏾 I hope everyone gets a mechanic on their team. it's so important to either know the cars or know someone who does 😂

    I know exactly how this happened. If the black top is gone from the street, there is a drop in the driveway. That's how the under plates got damaged. He went straight, instead of on an angle. It also means there's about a 4 inch drop on the sides of the road. If he got too close, to that, it will rub the tires. And if there's a bar sticking out of the concrete...pop goes the tires on the passenger side.

      the clue that gets the tow driver off the hook is the fact that both the damaged tires are on the same side of his pick up truck . to me that means the tire damage happened when the truck was being driven and the plaintiff ran into or over something in the road that damaged both the front tire and the back tire as he drove in a straight line .

    I don't doubt for one minute that the tires went flat while in the "care" of the tow company. I used to work for a tow company and the drivers including the owner would mess up cars all the time while they were improperly loading them onto a flatbed, towing dollies or anyting else. We have flat tires, body damage and anything else you can think of simply because it was not properly loaded or unloaded correctly. Then the drivers would always lie saying they picked it up that way or they don't know how it happened it must be the customers fault.

    The plaintiff said that the tires were 6 months old, but the picture he provided looked like tires were almost done. If you hit a pothole hard enough, that will cause the side wall to pop. If he drove it flat, there was a good chance he could have damaged the heat plate under the truck.

    You can see the front tire that had the bubble in effect on. You could see that he ran over the tire with the rim, cut a hole in the tire, the tires were damaged because the idiot after he picked it up, chose to drive a block you never do that unless you have a run flat, which being, it’s a Tacoma, it’s a truck, so it’s too heavy to have a run flat so the driver is at fault because he ruined his tires and probably his rims too

    The side wall punctures are usually caused by hitting a curb especially if the curb is jagged. Or of course by vandalism. I doubt by towing.
    The plates underneath being described are heat shields. Way back in the day when I purchased and drove old used cars. The heat shields sometimes would rattle or fall off. If they couldn’t be tightened any longer. I would just have the shield removed. Making sure not to park on grass or leaves

    First of all when you release a vehicle from a tow yard, you ALWAYS sign a release form to protect the company from liability such as being sued etc.
    Second, using a flatbed tow truck you can use the method of strapping all 4 wheels down or using chain hooks on the frame to secure the vehicle. Initially you hook the vehicle with chain hooks to the front control arms or subframe to pull the vehicle on the bed.
    This is information coming from a current tow truck operator.

      @@eisbeinGermany only way to damage the front end of a car on a flatbed or wrecker is if they dragged it or the car is too low or the bed isn’t low enough when pulling the vehicle up on the bed. But for a wrecker the wheel lift can damage the front end and underneath the vehicle if the operator isn’t operating the wheel lift properly,

      The vehicle owner pays, shows proof of insurance & reg & signs for the release, B4 even seeing the condition from the tow.

    Honestly, there was no way the Plaintiff was going to win. That's probably why the Defendent didn't bring anything. Plaintiffs rarely win against tow companies. I can only recall once.

    If you got in your truck and the two passenger tires are flat the truck and going to be leaning to the right. You 100% would notice that as soon as you got in it.

    I had a similar incident when my car was getting serviced. I didn't noticed the 2 tires being flat til I started my car. My flat tired alarm was going off. I got out immediately. You could see a distant line in the cement from the car bay to my parking spot. Where the rims had left a line in the pavent. Similar to this guy's picture. The car dealership had to buy me 2 new rims & tires. How they didn't hear the alarm or the display saying the tires were flat is beyond me!

    I wonder, since the tires were on the passenger side (aka the sidewalk side when parked) if the home owner, that was sick of people blocking their driveway, slashed the tires by puncturing them but the tires didn't go flat right away and leaked out slowly... It would make sense why it's that side of the car and why the damage is on the side of the tires.

    I don’t agree with this verdict. They are supposedly supposed to rule with the evidence being more likely than not. And anyone who know how tow companies work, they know how rough they are with cars. What a weird coincidence that they towed his car and then the guy has two messed up tires and the plates under the car are busted . Like really ? That’s how they pick up the car by the tires and by hooking underneath by those plates. Bad ruling on this one

    Jeffrey Dahmer, I mean the plaintiff, is straight-up lying. As a claim adjuster I know the first thing you do when you have your vehicle released is walk around the vehicle to make sure that it's not damaged. Let's go with his logic and say that the entire passenger side was flat when he left the lot oh, do you really think you're going to drive for an entire block and not notice it? The minute you leave that lot, your shit out of luck because anything that is damaged at that point is on you.😂

    It's a pick up truck and it's very possible to drive a block, wondering what the issue is, and only stop after a block. A block isn't far. He said he knew something was wrong. He just didn't know it was a flat tire until he actually got out his car and looked. Silly of him yes to pick up his car and not check for visible damage, but it's possible for someone not to know a tire is flat immediately upon moving an inch. Happens every day.

    I’m curios, I’ve been towed a couple of times.
    Long ago, tow companies used a form to mark any damage.
    Even if he wasn’t present,I’m thinking there should be a form, to cover their butts. Heck these days, I’m thinking they’d have the form, AND pics. That’ll show damage, no damage.
    Suspicious no proof for court, especially on the tow co. smh

    I’ve been to a tow yard where I witnessed the employee backing up a car into the lot and hit the gate. They acted like this happened before. it’s sad because there are tow places that mess up these cars.

    Wait- how is it an accident to have your truck blocking a driveway but also you're told you don't have to move it because the neighbor is gone? That means you knew. That means it was intentional, not an accident.

    Another stupid verdict from this ridiculous judge, tow companies damage cars all the time, I've seen this firsthand on many occasions, the tow rep brought nothing to back up anything on his side, the plaintiff had video and paperwork and yet he gets nothing, the truck was in the tow services care and upon leaving there were immediate issues, ridiculous!

    I thought that's the whole reason why people have paperwork: if there's any dispute, all the information would be there, no need to remember anything. But, if he doesn't take it to the court, why bother with paperwork and signature?

    🤨 I have tire receipts from years ago. Even when I use cash the receipts go in the glove box in case I ever sell the car the new owner can see what was done and where.

    Repaving doesn't "make nails" or things in the road that damage tires. Pretty clear they dragged the truck onto a flatbed and dragged the ties against the side.

    I too am uneasy with JM’a verdict. They kept saying “bockS” away but the guy said a 0.5-1 block away. Why wasn’t the tow company asked about any damage to the car upon them taking possession of the vehicle? Since the guy didn’t think to mention, “Hey, it had two flat tires when we got there.” I’m going to assume they got the vehicle intact. And yet when the owner picked it up, it was no longer intact. Doesn’t that seem more likely than not that they did something? Accidentally I’m sure. And is it possible they weren’t completely flat like that when he started to drive off but the pressure or the movement quickly push the air out? I don’t know much about cars or tires but this really seems like it should be on the tow company.
    Sure.. don’t award him the full amount he’s asking. But tires and labor seems reasonable. Even at a depreciated value since he couldn’t prove his tires were only six months old. Heck, he even made a good argument that he shouldn’t have to pay for the tow because they botched the service by returning his truck in a devalued state. He proved that they picked up the car in good working order. Now burden is on tow. Prove you gave it back in good working order. Am I completely wrong? I did just wake up HaHa. But the main thing they would have brought to court was the guy’s signature stating truck is good. That didn’t happen. Hmmmm.

      The issue is the plaintiff did not prove to the judge without a reasonable doubt. Sadly we cannot assume and the judge can’t either. Doesn’t need to be proven 100%.

      There’s no way he drove anywhere without noticing his rims were literally touching the ground. the tires weren’t just low but completely flat and on the same sides of the vehicle it would’ve been lopsided asf, especially if it was like tht in the tow companies yard. He’s definitely just trying to get money or not take accountability for what he did. Which is why he didn’t have proof.

    It’s sad because I believe the tow yard was at fault and unfortunately this young man didn’t bring enough evidence but who teaches these things nobody not the schools it’s like a person turns 18 and just has to know everything

      I disagree!! However I don’t believe the plaintiff is lying or trying to run a scam. I think he’s truly believes that the defendants company caused the damage. He most likely ran into a pot hole causing the damage to both tires on the same side. That makes the most sense!!
