Hi there, I am under the town of Babylon in Suffolk County New York. I recently called the town to inquire about converting my garage into a kitchenette. I was told not only that I couldn't do this, but that I also could not run a business out of my home. Do the laws of the town supercede the cottage laws of the state? If you can help with this question I'd greatly appreciate it.
Great question..... yes and no ... here is what I mean each "state" creates the law itself and in some states they state will write a clause that says NO local ordinances or rules can affect your ability to sell food from home. Florida is an example the state says NO LOCAL laws shall hinder the cottage food law and can do anything to stop it. So it would be in the state legislation itself that would say this. Each state is different.

these are looked t as time or temp sensative items like a restaurant or food truck they would need a commercial kitchen in new york.

this maybe not .. only because it is a refrid: item things that are time or temp sensative normally are not allowed

no this is a law or rule that is pretty much across the board in cotatge foods in almost every state
