I received an email from the Cottage Program and while the new food list goes into effect September 14th, they won't adopt the new food list until rule writing is complete, which could take up to year! I can't believe this is legal for them to do.

It can be tiresome just working the farm, now you gotta still to baking too? Because you can't sell certain things as they are. I have a question.... I only want to bake little mini panned cakes and recoup the money and the rest to fund my college sons educational trip to Italy. I don't plan on making this a business, this would just be goods for suggested donations. Once I reach the goal amount, I don't plan on going any further until next time I need to raise funds for school activities. I have no basement, no garage, no shed, no separate area in my home to do this but the family kitchen and have a cat. I only plan on putting this out to friends and family. I will bake you 5 mini pan cakes for $20 towards my sons trip. Can I get around Cottage Food Laws for something like this? Thank you!

Just found ya! We're trying to launch out of Clearwater Beach, but hit some roadblocks. In regards to Cottage Food, we got that part; however, it comes down to the vending. We plan to bike to the location on Clearwater Beach and set up a kiosk to sell roadside or beachside rather; however, we don't know if we need a vendor's license or something. Any thoughts?

Just because you're allowed to make cookies in your home in your state doesn't mean you're allowed to sell them to people in other states. Crossing state lines still means something; if you're caught, you can be fined. Also, $12K sounds great, but between the ingredients, packaging, shipping, marketing and so on... I only make dough one day and bake one day per week to stock a table at a storefront farmer's market and packaging costs really eat into my sales.

Did you here about Chevron Deference being overturned? I think this can change a lot of the “unreasonable regulations” surrounding cottage foods and the food industry as a whole. For instance, I’m selling cottage foods because it’s too difficult in my state to start with snowcones and coffee. Most notably the need for a commissary kitchen will make my part-time idea too risky. Being able to use a shared kitchen like caterers would make sense and I have less risk for contamination since I won’t be using the kitchen gear like they do. I think that’s an unreasonable burden and stuff like that might get changed if people petition and challenge these rules

Tennessee allows sale of single cut fruits and vegetables. Example, you can sell a head of lettuce, not shredded lettuce. Also drying your own produce for making spice blends. They'd have to be dried whole and then crushed. If you chopped your peppers before drying them, then it is not allowed.

Do profits from farmers markets count towards that 50k annual limit? Or can I have a farm stand at my home that makes 50k a year, plus whatever I make on the side from farmers market?
