I heard that you can't sell dairy products like buttercreams or cream cheese icing at like local farmers markets or fairs, but that you could use them for like a catering thing.

Veterans are exempt from paying the permit fee but for those people who do pay a fee, it varies from county to county as well as the amount you are allowed to earn. If you are a veteran fill out the veteran exemption form, you will need a copy of your DD214 and you are all set. MY county realized their mistake and returned the fees they charged me. The only thing you pay for are things that involve labor like label approval.
I make around $4,000 a month profit selling cookies and other food products from my home restaurant. My products are available for pickup or delivery through a popular food app.

Once you buy something you own it how you use it is up to you the seller if they are selling sourdough would need to be sure they can sell that type of "starter dough" etc. BUT YOU own it . thanks
Have you checked the price of the pickles? How about the price of the jars? AND other ingredients? It'll cost you around $5+ to make a jar of pickles.
there are huge amounts of small family startups selling pickles online there is always a way to make a profit figure the better pricing for jars, buy cucumbers in bulk etc.

Can I sell danishes, or any types of baked goods with cream cheese that's baked in the oven, not frosting, it can sit on shelf afterwards. And can I sell baked goods that's baked with berries in the oven
these are time sensitives due to the cream cheese almost every state does not allow this type of filling it would need a commercial kitchen

you could because I have not seen these on ANY list stating otherwise and these as donuts don't have anything that would be time or temp sensitive BUT check with local health department about event permits and licenses possibly as a " food vendor" this is the only thing that comes to my mind. ALSO I would recommend LLC and food business insurance to protect yourself from any personal liability

hello when it comes to shipping any interstate shipping over state lines falls under a commercial license and setting and FDA facility registration. Cottage food does not allow state to state shipping from a home kitchen

I would like to be able to sell boiled peanuts but I can’t put a 84 quart pot on my stove in my house. It says that you can’t cook outdoors or in an out building. I would like some help and clarification.
This may seem like a silly question, but what about canned (jarred) soup? I know you said something about the canning process but then also jams and jellies are allowed and those are canned. It would not require refrigeration.
Under Florida's Cottage Food Law, selling canned (jarred) soup is not permitted, even if the soup is shelf-stable and does not require refrigeration. The restriction comes from the canning process itself, which can be risky for low-acid foods, like soups, due to the potential for botulism if not properly processed. While jams and jellies are allowed, they are considered high-acid foods and have a much lower risk of bacterial growth, making them safer under cottage food laws. Florida allows certain canned goods, like jams, jellies, and preserves, but restricts other low-acid canned items, including soups, sauces, and pickled vegetables, due to health and safety concerns. For selling canned soups, you would need to operate out of a licensed commercial kitchen and follow additional regulatory requirements set by the state’s Department of Agriculture and Consumer Services.
I live in southern California. Are Cinnamon rolls/buns permitted to be sold under cottage food law? The buns/rolls are NOT filled with cream. The cream/frosting is on top.

Great video, in the State of Texas, I've read that a cottage food vendor cannot sell as a vendor at events that are hosted by businesses that sell food or drinks, do you know if that is correct? For instance, I cannot set up as a vendor at a winery event because they sell food or drinks.

If maple syrup is not mentioned then where would it fall under any regulations in Missouri
although it is not listed on their site you can request it to be an item to be made in almost ALL states you can ask to have an item added

I ship my syrup out of state and I sell it wholesale to grocery stores and I don’t have a label that states made in a kitchen so I don’t want to break those rules but if they don’t apply then I won’t worry about it.. Do you know what I mean?
I have a question. I'm reading about the TCS and I have a question. I have seen a lot of people sell plates and bowls of homemade food on social media. I'm in Texas and these people I see are also in Texas. Now, if the TCS foods are chicken, meat fish, potatoes and the rest, does that mean they're selling cooked food that are not in compliance with the cottage law?
yes many people DO sell "FOOD PLATES" in many states but honesty it is illegal from a health dept, cottage food law standpoint. and for those it takes just one person getting sick or food bourne illness and they can face fines and or jail time in some cases. I personally would NOT reccommend doing this.

you can use butter IN a recipe but for frostings or cake icings normally no.
What about olives? They are brined, not pickled
they are not on the list BUT you can simply write to the local health department and ask to have it ADDED as a food item.
