Just to get this corrected. The original deal in 1878 - The Sulu sultan leases Sabah to the British North Borneo Co., represented by Englishman Alfred Dent and German Gustavus Baron de Overbeck in a deed of pajak (“lease”) in which the company would pay 5,300 Mexican gold pieces a year to the Kingdom of Sulu. Instead it was converted to ringgit. This is one of the reasons why the rent ballooned to 14.9 billion dollars in todays money. I hope this helps you all see the truth.

The Malaysian government stopped rental payment in 2013. The heirs then went to the court to demand rental payment. Guess what? The heirs won because they really own Sabah and now the Malaysian government is ordered to pay $15B to the heirs of the Sultan of Sulu.

The Sultan of Sulu did not have the authority to cede or lease any part of Sabah to begin with! If anyone had authority to do that, it was Brunei and indeed Brunei signed an agreement with the British North Borneo company to cede that disputed portion of Sabah plus additional areas before the agreement with Sultan of sulu was signed. Why did they signed something with the Sultan of sulu? Because they said Sultan was a pest and he was going to cause trouble. Remember he and his subjects were notorious pirates! They needed to pacify him. He never had a right to that part of Borneo. Please people, learn the history. Stop watering down the information. Brunei promised to give that piece of land to Sulu if Sulu helped Brunei Sultan in a family dispute, but Sulu didn’t turn up, so the land was not given. Anyway, in those days, there were no administration in the modern sense of the word. What the Brunei Sultan promised was for Sulu to collect taxes and basically ruled as a warlord but because they didn’t turn up, the promise was null and void. When Sulu was incorporated into Philippines, they never included Sabah because Sulu KNEW THEY DIDN’T OWN SABAH! You can twist and turn history as much as you like and still the conclusion is that Sabah belongs to Sabahans and since Sabahans went with Malaysia, Sabah belongs with Malaysia! And, oh, yes, that scammer Stampa fellow will be jailed and disbarred.

The biggest mistake was, discontinuing the rental payment which resulted to a breach of contract. It which case, the heirs of Sulu came into default. To regain control of Sabah and demand payment for the arrears based on current market price and maybe including the illegal use of natural resources of Sabah which is not stipulated in the agreement, destruction of environment, compensation for the human rights violation, and etc.

But the Philippine claim to Sabah rests on the assertion that Brunei gave the territory to Sulu in return for assistance in the 1660-73 Brunei Civil War. However, the sources supporting this notion give the year of transfer as either 1658, two years before the Civil War broke out, or 1704, 31 years after it ended. The span of time covers the rule of different Brunei sultans. Brunei has never accepted or acknowledged that North Borneo was given to Sulu. A narrative in Brunei states that although an offer of land may have been made in exchange for military support, that support never came so the deal was never concluded. No Sulu sultan or other authority has been able to furnish proof of ever receiving the territory from Brunei, or of having governed it since. Britain annexed Sabah as a crown colony in 1946, after the chartered British North Borneo Company acquired it through a sale from the German magnate Gustav Overbeck, who had obtained the cession from the sultan of Brunei in December 1877. Since Sulu was making representations to the territory then, Overbeck also went through the motions of a cession with the sultan of Sulu some three weeks later. Two competing title deeds were obtained, signifying rival claims to ownership and sovereignty being given away. Both title deeds were for a permanent cession, but only Sulu has tried to overturn the agreement. Sulu representatives have since tried to use the title deed granted to Overbeck as proof of Brunei having ceded the territory to Sulu. Even before the founding of the Republic of the Philippines, successive Spanish and US colonial administrations had already rendered the Sulu sultanate defunct. Any credence in the Philippine claim today is highly contested and purely historical in nature, which is rejected in international law. The Manila Accord of July 31, 1963 facilitated the formation of Malaysia with Sabah without hindrance from the Philippines, while granting Manila the option of continuing to entertain its claim. However, conditions were set by both the Philippines and the descendants of the defunct Sulu sultanate. Manila wanted a UN-approved plebiscite of Sabah residents endorsing the creation of Malaysia, and the Sulu partisans wanted the continuation of the RM5,000 annual cession payment (later increased to RM5,300) from Malaysia. Malaysia met both conditions. However, after the February 2013 attacks on Sabah by armed militants from Sulu which violated their part of the agreement, Malaysia discontinued the payments. The persistent claims to Sabah, whether from Manila, Sulu or both, are disreputable and without foundation. The sultanate of sulu did not give up the rights to the british. In fact, the british were paying rent approximately 3,000 mexican pesos at that time. Which also means that sulu maintained their rights and never gave it up

Descendants of former Sultan of Sulu claim that Sabah belonged to Sulu Sultanate because Sabah was given by Brunei the original owner to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. In fact on 29 December 1877, the Sultan of Brunei ceded the whole of Sabah to BNBC/British and concurrently appointed Baron Von Overback, the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya. This cession agreement was documented. When BNBC went to Sabah to begin their business, Sulu claimed that Sabah belonged to Sulu. BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak'' agreement was signed on 22 January 1878. BNBC understood that this "pajak" was a "cession", so did early generation of Sulu Sultan accepted it as "cession". Only later generation of descendants of former Sultan of Sulu claimed that the "pajak" agreement was meant to be "rent" or "lease''. Still there was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. The two above events led to an overlapping issue on Sabah. What ever it was, the above agreement and overlapping issue were superceded by later event. On 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory. In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner of Sabah Britain had full control and sovereignty over Sabah and they could do what ever they wanted. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain. What ever happened to Sabah after that was under British jurisdiction. Even though British had full control and sovereignty of Sabah, they still honoured the annual "cession money" payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed in 1963, still honoured the annual "cession money" payment as consolation for the Sulu Sultan. The term "cession money" was used because to use the term "consolation" was felt to be too degrading. Thus the term "cession money" was continually used as used before by the British. On 31 August 1963 Britain gave independence to Sabah and before that on 22 July 1963 Sarawak was given independence. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says: "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia". The Sultan of Sulu did not have the authority to cede or lease any part of Sabah to begin with! If anyone had authority to do that, it was Brunei and indeed Brunei signed an agreement with the British North Borneo company to cede that disputed portion of Sabah plus additional areas before the agreement with Sultan of sulu was signed. Why did they signed something with the Sultan of sulu? Because they said Sultan was a pest and he was going to cause trouble. Remember he and his subjects were notorious pirates! Brunei promised to give that piece of land to Sulu if Sulu helped Brunei Sultan in a family dispute, but Sulu didn’t turn up, so the land was not given. Anyway, in those days, there were no administration in the modern sense of the word. What the Brunei Sultan promised was for Sulu to collect taxes and basically ruled as a warlord but because they didn’t turn up, the promise was null and void. When Sulu was incorporated into Philippines, they never included Sabah because Sulu KNEW THEY DIDN’T OWN SABAH! The biggest mistake was, discontinuing the rental payment which resulted to a breach of contract. It which case, the heirs of Sulu came into default. To regain control of Sabah and demand payment for the arrears based on current market price and maybe including the illegal use of natural resources of Sabah which is not stipulated in the agreement, destruction of environment, compensation for the human rights violation, and etc.

That Sabah or North Borneo was once part of the Brunei empire is not disputed. But the Philippine claim to Sabah rests on the assertion that Brunei gave the territory to Sulu in return for assistance in the 1660-73 Brunei Civil War. However, the sources supporting this notion give the year of transfer as either 1658, two years before the Civil War broke out, or 1704, 31 years after it ended. The span of time covers the rule of different Brunei sultans.
Brunei has never accepted or acknowledged that North Borneo was given to Sulu. A narrative in Brunei states that although an offer of land may have been made in exchange for military support, that support never came so the deal was never concluded. No Sulu sultan or other authority has been able to furnish proof of ever receiving the territory from Brunei, or of having governed it since.
Britain annexed Sabah as a crown colony in 1946, after the chartered British North Borneo Company acquired it through a sale from the German magnate Gustav Overbeck, who had obtained the cession from the sultan of Brunei in December 1877. Since Sulu was making representations to the territory then, Overbeck also went through the motions of a cession with the sultan of Sulu some three weeks later. Two competing title deeds were obtained, signifying rival claims to ownership and sovereignty being given away.
Both title deeds were for a permanent cession, but only Sulu has tried to overturn the agreement. Sulu representatives have since tried to use the title deed granted to Overbeck as proof of Brunei having ceded the territory to Sulu. Even before the founding of the Republic of the Philippines, successive Spanish and US colonial administrations had already rendered the Sulu sultanate defunct. Any credence in the Philippine claim today is highly contested and purely historical in nature, which is rejected in international law.
The Manila Accord of July 31, 1963 facilitated the formation of Malaysia with Sabah without hindrance from the Philippines, while granting Manila the option of continuing to entertain its claim. However, conditions were set by both the Philippines and the descendants of the defunct Sulu sultanate. Manila wanted a UN-approved plebiscite of Sabah residents endorsing the creation of Malaysia, and the Sulu partisans wanted the continuation of the RM5,000 annual cession payment (later increased to RM5,300) from Malaysia.
Malaysia met both conditions. However, after the February 2013 attacks on Sabah by armed militants from Sulu which violated their part of the agreement, Malaysia discontinued the payments. Philippine partisans have also described the annual cession payments as “rent” to support their claim of ownership.
The persistent claims to Sabah, whether from Manila, Sulu or both, are disreputable and without foundation. They are a continuing irritant to the Philippines’ ties with Malaysia and risk a rupture in otherwise healthy relations. They cannot continue to be a weighty albatross because no sovereign nation can accept such blatant and baseless claims on its territory. As with his immediate predecessor Benigno (“Noynoy”) Aquino, President Rodrigo Duterte had said he would study the Philippine claim before proceeding with it. That has been some years now and he, like Aquino before him, has decided not to pursue it.

The sultanate of sulu did not give up the rights to the british. In fact, the british were paying rent approximately 3,000 mexican pesos at that time. Which also means that sulu maintained their rights and never gave it up

Philippines claims Sabah on the basis that Sabah was said to be once under Sulu Sultanate. Descendants of former Sultan of Sulu claim that Sabah belonged to Sulu Sultanate because Sabah was given by Brunei the original owner to Sulu as a gift. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans.
In fact on 29 December 1877, the Sultan of Brunei ceded the whole of Sabah to BNBC/British and concurrently appointed Baron Von Overback, the co-owner of BNBC as Maharajah of Sabah and Rajah of Sandakan and Gaya. This cession agreement was documented.
When BNBC went to Sabah to begin their business, Sulu claimed that Sabah belonged to Sulu. BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak'' agreement was signed on 22 January 1878. BNBC understood that this "pajak" was a "cession", so did early generation of Sulu Sultan accepted it as "cession". Only later generation of descendants of former Sultan of Sulu claimed that the "pajak" agreement was meant to be "rent" or "lease''. Still there was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. The two above events led to an overlapping issue on Sabah.
What ever it was, the above agreement and overlapping issue were superceded by later event. On 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory.
In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner of Sabah Britain had full control and sovereignty over Sabah and they could do what ever they wanted. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain.
What ever happened to Sabah after that was under British jurisdiction. Even though British had full control and sovereignty of Sabah, they still honoured the annual "cession money" payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed in 1963, still honoured the annual "cession money" payment as consolation for the Sulu Sultan. The term "cession money" was used because to use the term "consolation" was felt to be too degrading. Thus the term "cession money" was continually used as used before by the British.
On 31 August 1963 Britain gave independence to Sabah and before that on 22 July 1963 Sarawak was given independence. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says:
"I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia".

you forgot about that Malaysian Government pays an annual rent to the heir of the sultanate of sulu and those heirs has receipts of that payments.its not a baseless claim. The heirs has the right to take back their assets if you discontinue paying your rental fees . simple as that.

@@reimac1061 Yearly payment is not kept secret. It has been known since the founding of Malaysi because British transferred the obligation to the newly created country. What is illegal was the tranfer for how could a lessee, a private company, transfer unilaterally the rights to a certain property to other party? This is an extreme case of injustice and by that time sulu did not react because you dont wanna mess with the goons of Mama Beth.
