Here just shared the steps which we have followed, Note: We are not the attorneys and we prepared the documents as per the above links
- I539 for primary applicant

- Reason for extension letter to uscis (you can check it out from the above other links)
- Bank statements and payslips for the sponsor.
- VISA documents and I94 for the sponsor (if applicable)
- Filing fee 370(for i539) and 85$(biometrics for each person)

I wish them approval, just thinking about the worst case scenario which might help someone…So can they extend their stay even if their application is denied ? Or is there any other alternative?

1. Let's say the 6 month end date is October 1st and I am applying the extension on September 1st. If the decision has not been made by October 1st or before my I-94 expires , is it legal to stay with the application in progress or until we have a decision?
2. For some reason after my 6 month stay period or after my I-94 expired which is October 1 and I get a decision on November 1st that the extension is rejected, when do I need to send my parents back to India? Do we have any buffet time to book tickets and send them back or need to go immediately once we get the decision as rejected ?

@@ArthiPrem yes it was very strange for some reason CBP haven't updated their i-94 system with correct i-94 number also didn’t find any stamping on passport. CBP system showing previous year traveled info (dates , expires ) same time we could able to see the travel history tab was updated with with recent Arrival dates. we only noticed wrong i-94 number and dates while trying to apply for extension it was last min we had only two weeks left before over stay , suddenly flight got cancelled.
Finally some how got another flight they left US already on time, just wondering if you know any info how to updated I-94 if we found any system errors please share so could help others similar situation incase . Always good to notice their i-94 was updated correctly once after arrived which we missed to do .

Hi Prem and Arthi, if b2 visa holder’s Indian passport expiring in 6months from Port of entry date, can we apply for stay extension? We need to apply for passport renewal also. When we apply for stay extension will they denied if passport validity less than 3months?
If you are asking for extension till passport valid it will not be denied I believe say 3 months extn in ur case
@@ArthiPrem thank you for replying. My mother in-law just arrived last week and her I-94 valid till 23rd April. But her passport expires end of May. She has B2 visa validation till 2024. I called vfs global New York and asked them whether I can apply for passport renewal now immediately so that before I apply for B2 stay extension she will have 10year valid passport, but vfs replied that for passport extension application they required receipt notice of b2 stay extension. In that case if she apply stay extension 45 days before i94 expire, will USCIS see passport going to expire in 2 months(Apr, May). Apri 23rd already under i94, only May month is left. In that case how USCIS will give another 6 months stay? Also vfs global saying she apply passport extension after got receipt notice from USCIS. Please advise.

When should parents leave if the extension was denied?
If extension was approved, can we apply ITIN and show them as dependent in our Tax application? Do you know anyone tried it?
Here is my thought It will make complication for your tax filing especially when you apply with ITIN. US resident alien should be greater than 183 days in US . B1vistor was designed to stay less than 180 days reasons so this way B1visa not qualify US residency . Due to pandemic they giving grace extension. IRS May ask for additional evidence which they request for original passport/ true copy to prove US residency then it delay whole process of filing could take serval days to resolve.
Got it but even if its delayed by couple of weeks. We could get tax benefit right. Have anyone talked with tax agent on this looks like lot of parents are staying more than 183 days due to pandamic.

We are not attorneys and I read the below things in forum which will answer your question
Once b2 extension persons leaves US, their pending B2 extension will be automatically abandoned by USCIS.
Since the petition is invalid the biometric appointment will be automatically voided
There are no bad consequences on future entry to US either. Don’t worry.
Their stay in US after i94 expiry till their leaves while application was pending will be counted as ‘period of authorized stay’. Its legal.

Hi prem, we applied extension and my mom stayed here for 11 months and she left India in January. We have done the biometrics. The case is still in finger print received status and not approved. We are planning to call my mother again next February. If she didn’t get the approval notice before that can she travel or any issues will come.

Last time I extended b2 visa for my mom from 14 July 2022 to 13 July 2023 and then again extension applied and apprived from 13 July 2023 to 1 Sep 2023 due to medical reason.
My mom travelled back to india, should it be more than 6 month cooling period as last time I extended two and total stay was 1 year 45 days.
