    Pirating switch games I can understand, but Nintendo not allowing us to access old games from their retro consoles is beyond me. A better idea is Nintendo to make cartridges of all of their retro games from each console. From Nes to N64. But would be impossible for gamecube or higher excluding the DS due to how many GB/TB would be needed

      Its the Disney Vault mentality. They want full control of when we can say their old games because they believe they are milking it for maximum nostalgia fomo.
      If we know they only rarely put out game other than Zelda, Metroid and Mario, they believe we are more likely to jump on it. At least thats what they believe.

      That's why they know it will get them nowhere with lawsuits against someone for doing it with older games up to the Wii U. Even if they do make money off games on Switch Online subscriptions, last I checked, it will only be counted by individual purchases. Now, of course, fair use is such a broad term, it's difficult to properly enforce it, even if it's considered the legal definition of fair use (pirating abandonware is considered fair use, but that doesn't stop companies from filing lawsuits), it's usually up to a company's or an individual's interpretation.

      Meh, these pirates deserve it, I do agree with allowing us to access old video games though, I mean I still have my original game boy, and I am 100% sure there is a way around to put even the wii, GameCube, and wiiU games onto the switch. Bunch it all together and call it Portal Pass, then charge $150 for the game. I'd buy it so long as it comes as a cartage even if it's stuff like portal pass 1 2 3 4 5. etc.

    if i had a chance to speak with nintendo, id tell them this: im against piracy, but i do sympathize with pirates. your company is known for your incredible artworks, your games, and you just throw it all away on a daily basis.
    "we do not throw away our games." currently your using nintendo switch online, a service you used to provide for free, people prefer to own there games and thanks to your old cartridges litterally dying nobody gets to play them anymore. you treat pirates like the enemy but i dont see it that way. piracy is not the enemy, its a sickness, a sickness caused by poor merchant-buyer relations. bad choices like forcing someone to pay a subscription or destroying old eshops and ruining old copys of games, its just toxic.

      I’m so happy others agree not being able to own the games is BS. We shouldn’t have to rent these games like it’s so greedy what they are doing. I remember hoping they would release a n64 mini and they never did and it’s a damn shame. I mean at least let me buy and own each of my favorite n64 games on switch Nintendo damnit.

      I pretty much had to Pirate the Wii U library just to even get some of the games to work. Like, I had to do it just to play splatoon, because I don't want to be paying an obscene amount of money just to play a game. It's bad enough Comcast makes me pay out the ass

    The reason people are pirating is because Nintendo switch sucks, The game lineup is not enough and the quality isnt great. Nowadays theres alot of glamour and shine but no story line or character development in games they have no soul, no life, no fun factor. Its just very robotic

      Not to mention a lot of the games are pretty much neutered without paying for Nintendo switch online. Back on the Xbox and 360, we had proper Halo, you had to pay for multiplayer as a subscription, but you at least got a base game with a campaign, and local multiplayer. It's been ages, but I don't think I can even do multiplayer without NSO on SMM2

    In France, it's legal to dump your own games. If you modify your console, that's the grey area. But you can reply that "it's my console, I paid for it, I do what I want as long as I don't play pirated games and I don't care about warranty". If Nintendo doesn't want its game being pirated, then it should cut the retail prices of its games. But I understand why Nintendo does that. The Switch is still sold. When the Switch, any versions and models, will be replaced by a true new gen of console AND Nintendo doesn't create any new games for the Switch, then we enter into a grey area. So... But for that video, crime doesn't pay.

    Can't complain about "potential profit loss" when you have an infinite supply. That's like me complaining that I could have "potentially been rich" by now, but I'm not and I'll blame some random guy for it. If I have a portal to The Realm of Infinite Butter™and France sneaks in and takes some while I'm not looking, I lose literally nothing. What Nintendo is doing is for power and control over others' property, plain and simple.

      What's even worse, is the fact that plenty of these games are things that they didn't even distribute in the first place in other regions, look at the satella view, the only way you can play this is if you know how to hack a Super Nintendo, or use emulation. It doesn't matter if you even have the legitimate hardware to do the job, because the service is dead!

    If Nintendo made actually good hardware worth the price (cough cough the switch barely being able to run pokemon scarlet and violet), then people would be less likely to pirate. Most of the people pirating the games are people that want to play them at 60 fps and not 10 fps.

      let's be honest here... the reason for scarlet and violet's performance wasn't hardware. It's not got the graphics or the number of models needed for the hardware to struggle... unless of course the game was just badly designed at the engine programming level. There's examples of better looking, open world with intricate situations, games like TotK running leagues better than S&V. The switch is fine, the problem is a problem pc gaming created, like many of the modern problems of gaming... PC gaming made it so that devs could be lazy and just say "Ah, they'll just get better hardware, so we don't need to code effeciently" instead of doing the proper thing and making proper running code. Honestly, with how little advancement there's been in the last decade on graphics, there's literally no reason a gaming system should have hardware more advanced than the Wii (to keep it on nintendo (or the psvita if you wanna go with something else)) as there's not been a substantial enough jump in hardware capability in relation to what the games present us, to justify anything more costly than that.

    So the mig switch doesn’t actually allow you to play Roms on the switch because the mig switch requires the game id to run correctly and the best way to get it is to dump your own games. There’s not a lot of sites that offer the game Id with the game rom. The two are most of the time separate. So the mig switch has a way to stop people from pirating on it but due to Nintendo’s poor security. The game ID’s are still around on the web. Like seriously the idea of them being upset because they don’t want people to mod there own switch’s or provide new accessories is ridiculous when there security is so bad. I mean the whole entire game of tears of the kingdom was legitimately leaked a week before release. Let’s also not forget that Nintendo was talking about getting rid of third party controller support so they could sale more pro controllers and joycons.

    As long as it’s not used to gain an advantage in multiplayer games or to circumvent the security of other players, I consider modding to be effectively harmless. However, refusing to pay any amount for even Nintendo’s biggest and most acclaimed games is just scummy.
    Nintendo’s legal team seems harsh and erratic at times, especially compared to some other companies, but to refuse to pay for the games Nintendo is currently selling is disrespectful to the developers and teams of people whose livelihoods depend on the success of the games they work so hard to make.
    I myself don’t like how strict Nintendo’s legal team is. I wish they put out official game OSTs on streaming so we wouldn’t have to rip them and put them on TH-cam videos they then take down. I wish they provided official ROMs of their legacy games and encouraged emulation and modding. I wish they just discounted their games every once in a while.
    But I also have the utmost respect for Nintendo’s development teams. They are true masters of their craft and deserve to see their games sell well, especially in series like Metroid that have historically sold only decently.

      Yes agreed. I also especially think making mods for games never released outside of Japan where Nintendo has shown little or no signs of releasing it outside of Japan anytime soon should also be legal. Japanese copyright laws are very specific in that while much stricter than typical copyright laws and having an absence of fair use; they really only have power to police material being released in Japan. Which basically means as long as the emulation/ROM/Modding is set to where anyone except for Japan has access to it, there are no laws being violated. It's why the fan translation patches of Mother 3 and Fire Emblems 1-6 and 12 are perfectly doable. Though in the case of FE7 and FE9, there are Japan exclusive hard modes too.

      Yeah. While I don't pay full price for every Switch game I get (which is usually the case for a second-hand shop selling older games), I'm still paying and buying the content legally, so that's still the important thing.

    TBH, I never tried it despite I have(HAD.... and "had" is because it stopped working or charging at all...) a switch, or now two, I still am unsure about going for NSO because I'm more of a PSN & Xbox user (PSN at most) but a surprise there was a "free" version at all, thanks for that notice, but I might have missed it so I better wait....

    I love how some people are so paranoid about "You're stealing games" so your basically doing the work for Nintendo and spreading it's so called "Don't you dare pirate" messages? This is a multi billion dollar corporation who couldn't give a crap about you. NSO has been a joke from day one on Switch. The games are laggy, they don't always work well, and the Switch hardware is reaching its end of life. And despite that, they spend more money on lawsuits than in new experiences?
    The only reason pirates exist is when a game company knowingly and willingly locks it's classic games behind a paywall and "Drip feeds" them to their paying customers. They also do nothing with many of their IP's after a certain amount of time. Also, could you please explain why it also extends to games made by other companies on their platform? I get suing for their own games, but not if it's a game from another publisher. They bought the right to sell it, not own it. So why are they suing for that? Even if Nintendo doesn't own the publishing rights themselves? They have done this as well. A game company that spends more on lawsuit than on quality games is like a publisher spending on the best computers and tech, but not hiring employees to actually "create the game". Doesn't work and neither does Nintendo.

    I can sorta understand wanting to make sure you can play the older games, however there is no excuse for stealing current nintendo games. Their avaliable everywhere and everyone's got to deal with paying full price, I do preorders not for any specific bonus stuff but so that 1 I'm guaranteed my copy of the game on launch day and 2 I can slowly pay it off at my own pace. More people should try doing it that way if 60 is too much right now, Gamestop always let's you do that.

      I'm with you. Though I tend to hold off for sales, and I can't remember the last time I pre-ordered a game, and it certainly wasn't often that I did. But still, if you don't support what you love, it goes away.

      People who download Switch games for free weren't gonna buy them anyways. Piracy is a non issue and people overblow it far too much. Like oh no, Breath of the Wild only sold tens of millions of copies, Nintendo is gonna go bankrupt if someone gets it for free.
      Here's a question, what's the difference between pirating the game and buying a used copy other than legality? Are you gonna say that used games are just as bad as piracy and that used games shouldn't exist either?

    If he didn't send the consoles back with hacked games, he likely would have done OK in a lawsuit as the console is private property. You can legally do or have done to it whatever you want. If they win that lawsuit, the law is unjust. Now pirated games, that's a different story. Simply paying someone to mod a game console though has been proven legal in prior lawsuits. They shouldn't be able to win that part.

    First Nintendo shutted down 3DS and Wii U and sooner than we tought the same will happen for Switch, but not before Switch 2 in next year 2025, what I remember Nintendo said they want Nintendo Switch will be a long living console so Switch will be alive a long time in the future even after the next Nintendo Switch console whatever it will be and the rest of this year 2024 looks surprisilly good on Nintendo Switch with a lot of awesome games like The Legend of Zelda Echoes of Wisdom, Super Mario Party Jamboree and Mario & Luigi Brothership can't wait i'm so excited Nintendo will never die: Here we GOO! 😍❤️‍🔥

      Leo-pd4fc: Nintendo switch 1 online services will only close during a long period of Nintendo switch 3 and that is only if Nintendo switch 3 is an upgraded online services, it will take a really long time while that online services is going on to close both Nintendo switch 1 and 2 online services. Does are only guessing base from the pass. Nintendo DS online lasted a really long time compare to the Wii, since they both close during a long period of the WiiU online and after Wii there was Nintendo 3DS online and then WiiU online services. Then they repeat the same close formula, with Nintendo switch payed services, after a long time of Nintendo switch payed online services they close 3DS online and WiiU online this year. Notice it is always the hand held and the first one that is online the longest before closeing.

    Crime does not pay, because when you get sue from nintendo for selling pirated copy of there game even if you do not make any profit, as long as you receive money doing something illegal is still illegal and that is why he got sued, also since he have to pay 5millon in damage to Nintendo, so the only way he can pay of the damage that if he does another crime like selling illegal drug, or it is Jail time.     I'm excited to hear that Nintendo is taking action. What I think Nintendo needs to do is make a new mandatory update for the Nintendo Switch that will brick the system if somebody goes out and purchases an unlicensed product and hooks it to their system. For example, if somebody puts in unauthorized unlicensed accessory on their switch or in their switch then it will brick the whole system to where the user will have to go out and buy a whole new Nintendo Switch console. That would teach people a lesson to not screw with Nintendo. I'm all about owning only officially licensed Nintendo products for my Nintendo Switch. Once again I am excited to hear that Nintendo is taking action against these pirates and mods douchebags.

      @@diosoth Piracy is not equivalent to stealing. Stealing would be physically taking property away from the person who owned it, which would reduce it's quantity per item. Piracy does not achieve this. The modern term of piracy in this case would be copying a game without paying for it, but the original game still remains within the owner's property. Obviously it is wrong to commit piracy, but if the service restricts me from using their product, I will resort to not using their product or commit piracy if no other options.
