This quest stumped me too at first. You have to tell him "ok, I will go back" and he will immediately disengage you and walk into the bathroom. At that point you have to pickpocket his key while he is at the urinal and proceed to his office using the now unguarded elevator. If your lockpick skill is high enough you can bypass the pickpocket option and proceed directly to his office using the elevator. Don't forget to grab the skill book on his desk after you retrieve the sensitive files.

Then use the Cottonlark Feather to tickle the man’s undercarriage when approaching from behind. You’ll be able to get the key even if you’re Level 1 Pickpocket.
I have seen multiple videos of people arrested for entering witness rooms in courthouses, being at public parks past hours or protesting inside a DMV and they all scream the same thing: “YOU CAN’T ARREST ME ON PUBLIC PROPERTY!!!” as they are arrested on public property. Public property is just a fancy way of saying Government owned, taxpayer funded. The public does not “own” the actual property and you bet your ass when push comes to shove…you are getting yeeted out the door.

there is no expectation of privacy in public. publicly funded and publicly accessible buildings indeed fall under first amendment proection. you are also constantly being recorded out in public by comercial and private security, traffic, private and public dashcams, teslas etc. i wonder when the last time you signed a release for any of those recordings?
