    Sir what in case magistrate has not jurisdiction nd according to him detention more than 15 days is also necessary. ..he himself authorise further detention in judicial custody or he has to commit the case ,to magistrate having jurisdiction... Kindly reply sir

      No
      It can be granted by the magistrate not having jurisdiction also

    Sir what is meaning of remand under section 309(2) if in custody ...pls explain ..can magistrate order for police remand even after taking cognizance..or even when he already gave police remand of 15days under section 167(2) ..what is the difference between these 2sections

      Magistrate usually orders the Judcial Custody in S.309(2) after taking cognizance

      Sir agar 15days police custody ho chuki hai ..or some how case CBI or other investigating agency ko commit kar diya gya hai ...Tu waha par always judicial custody hogi ?

      Maximum cases me Judcial Custody hi milti hai.

      Court isme mandatorily police custody nahi milegi aisa mention nahi krti but haa kai Judgment me 15 din ke baad Judicial Custody hogi aisa hai mention.
