Police custody =15days judicial custody =60and 90 then 15,19 if judicial magistrate first class give 7days police custody then it (15-7)=8 days left so, whether this 8days shall be included in 60 or 90days custody or not?

For the purpose of computation of period of 90 days or 60 days as the case may be, for the purpose of sec 167(2) of crpc
1. The day of arrest of the accused has to be excluded
2. The day on which the accused was remanded to be executed.
3. The day of arrest of the accused and the day on which the accused was ramanded, if different, both have to be executed.
4. The day of arrest of the accused only has to be excluded and the day on which the accused was remanded, even if different, cannot be excluded.
