      This is in parallel with actions and this is exactly the opposite of what is happening and how it should be happening it is how free world is resolving conflicts with codified rules of law now by anarchy and random shelling of civilians it is probably not as quick and effective but it’s not resulting in the killing of thousands of civilians… the other way of solving the situation with actions are being enacted by different processes happening at the same moment in a different manner than this formal situation and have a different purpose… 🇨🇦 (NATO Canadian)

    Ukraine should be given immediate emergency entrance to NATO, and declare Putin's Military is committing War Crimes, give them a short deadline for withdrawal, and any declaration to use or actual use of nuclear weapons will signal Russia has declared war not only on NATO, but on all the citizens of the world.

      No. The Court has made a ruling. And will fallow further processing to enforce.
      Within law the guilty has an opportunity to see there wrong doing. If they refuse than the Court will impose further actions. ..it gets worse for them if they do not respond..trust me.

    Fact: Donbass was repeatedly bombed starting in 2014 by the Kiev regime. Donbass people had no legal representation even after their referendum to be independent. These people's rights were completely stollen from them, Nobody cared. 14k innocent people and 150+ children died since the kiev regime placed after the American Coup. What a tragedy... UN and the West high officials should have known better and did nothing ( God knows why, NATO expansion? American LNG? Bioweapons LAB's in Ukraine backed to be backed by NATO? People have the right to know the truth. Stop the Anti-Russia propaganda and fake news. West was never interested in diplomacy, only in the appearance of it. If they really craved for diplomacy to begin with, they would never have sold weapons to Ukraine and pushed for Ukraine's neutrality and for compliance with the Minsk agreement. So it appears that the west created this war, not Russia. People deserve to know the truth!

      What happened in 2014 was because of Russia; you'll have to research it without using biased sources. They didn't have any influence in Ukraine once the president at the time fled. So they put troops into the donbass. I can't be bothered to type it all out, but just look it up yourself. This is the second time Russia has invaded ukraine.

      Well, western people ( including myself ) have to generally remember one thing, there is an information war going on as well. The fact that information was turned into a war machine so quickly in the last months means that the controls were already in place for several years, waiting for this, in most western offline and online journals, most Internet suppliers and most, if not all, western media outlets. And in Europe too.
      The ability for people to understand what is really going on is directly related to the ability of people to be free on their own and have their own opinion, not a biased, political one.
      look for Anne-Lauret Bonnel Donbass documentary - French war reporter that fled with her team to Donbass to investigate with their own eyes and their own ears what happened in Donbass for the past 8 years.

      look for United Nations on conferences where Russia, India, China, and some countries of South Africa speak. Look for what they are saying, specially China. All other nations say the same because their orquestrator is the same.

      I won't suggest you look into RT channel because it's probably not available for you anymore...
      What about human rights? Human rights are not to be confused with politics.
      South Africa proposal in UN for Humanitary Resolution in Ukraine was neglected in favor of politics.
      You should take a small time to understand for yourself what is happening, so you can help others.
      We are nothing, maybe little soldiers with great power if backed by the truth and combined.
      Everybody has good intentions, but not everyone knows where the good intentions are.
      Everybody likes the truth, but not everyone knows where the truth is.
      It is easier to believe in big lies that it is to believe in hidden truths.

    Like many of you, I watched the events unfolding in eastern Europe overnight with deep concern for the people of Ukraine, as well as a growing anger at this affront to peace and order on the international stage. An unprovoked attack on a sovereign nation is a troubling development, the likes of which we have not seen in generations; we likely have not yet seen the worst human consequences of this act of brutality.

    It's too bad that they couldn't make this order earlier before all the young lives were lost and the Ukranians have evacuated their homes... but at least now they can send the order to the Russian government and they will have no choice to either follow the order or make an appeal if they try to make an appeal the United Nations should evaluate whether it is necessary that Russia be in there intermittently or if they need to withdraw until their appeal is heard.

    How will NATO enforce any judgment here with regards to the actual invasion without full scale world war?
    And economically, what does the world look like if Russia, China, maybe others that side with them, saying its an us vs them world now.
    Ultimately, through isolation, and silencing, extremism will prevail, lack of understanding will persist, and lack of global peace will be the status quo.
    Somehow, NATO needs to protect Ukraine's sovereignty, without creating an escalation of conflict through no fly zones, or direct intervention.
    While there is death and suffering going on now (all over the world, its not like its just Ukraine) it cannot be as bad as a WWIII and even worse the potential of nuclear war.
    While we sit at home as keyboard warriors, its likely not helping finding a solution.
    most of us have lived in a time of peace, we take that liberty as given, like were self entitled to it.
    No, it was fought for, our forefathers and mothers blead for it, and millions died for this freedom, or perhaps more of the world would be living in a totalitarian regime.
    About time we remember the atrocities and horrors of the world wars, and that we really do not want another, and we should strive to make every effort to facilitate peace, even if its means getting bloody yes, but not at a cost of half the worlds population, and a scorched earth.

      The UN Security Council could ask for volunteers to send a peacekeeping force in to ensure the court's ruling is upheld. Except Russia still sits on the council and has a veto...

      @@cYYAN88 Are you sure you aren't confusing it with the International Criminal Court? All UN member states are party to the International Court of Justice.
      It also seems doubtful to me that this would be a criminal issue for "any gover[n]ment official in Russia" (except perhaps, where there were criminal issues based on other law, for invalidating a defence based on the Genocide Convention).
      From the order: "The Court reaffirms that its 'orders on provisional measures under Article 41 [of the
      Statute] have binding effect' [...] and thus create international legal obligations for any party to
      whom the provisional measures are addressed."

    Correction: Putana initially claimed it was a “Peacekeeping Mission” so there was a false pretext to the Russian Federations false pretence. Ironic but expected from a scumbag thief whom surrounds himself with like minded individuals. Well done ICJ now let’s see how justice truly handles these types of crimes because I can’t imagine a criminal court case where the defendant doesn’t show up and gets any leniency.       No jurisdiction upon Russia, USA and some other countries. Some of ICJ judges were put under USA sanctions, during Trump's presidency, because they have been investigating war crimes of USA soldiers in Afghanistan and Iraq.

      In international public law the execution of any decision or international legal provision against the will of the other nation basically means necessity of war. You can not force someone who is equal to you to do anything unless you really physically force him. And the court is only a symbol and has no real power to enforce its decision, neither have we established any such organization. You have to understand, would we want to establish such an organization, it would need to be more powerful than a nation to be able to enforce something upon a nation. That would effectively mean that we would act similarly to Jonathan Locke and Jean-Jacques Rousseau's ideas of a state (Locke calls it a Leviathan) that we all would give up some of our freedom in case of a nation it would be sovereignty (some states do that today by unilaterally setting forth that they accept universal ICJ jurisdiction, but nether the U.S. nor China or Russia ever did so) to create something (we maybe would only have to expand the already existing UN) that would be able to force its will upon a nation and said nation would lack enough power to resist and would be restraint to comply the order. But such seems to be unrealistic in 2022. Possibly in 2050 or 2100 when a global crisis will become so tremendous that not even a superpower like the U.S. will have any hope of managing it alone. Such a situation would be effectively very, very close to a United Nations of Earth Federation scenario. Basically we would convert today's kind of soft-law character of international law to a hard law like national-law character and build that on top of our national laws which would then in return mean that above layer would be just like in Europe European Law is right now today. But can you imagine the United States or Russia or China giving away their leading positions to join something common, in which maybe 50 African nations with 2 European small nations would enforce some kind of legal restrictions on the U.S.? Sure, that would be the dream of someone like me... But yeah... Unrealistic at this time.

    If member countries having a dispute and one them filed a case against other in icj does the icj decison binding on the other country ,who has not appeared in the court or not responded to any order during the entire proceedings? Assuming that there were no agreement before between the two countries. Plz answer .

      It was USA vs Nicaragua case. Btw, USA is only state that was ruled as terrorist state... Why would USA admit itself to that ruling?

      Nothing. They are under USA sanctions since 2020.
      In April 2019, the United States revoked the visa of the Prosecutor of the International Criminal Court, Fatou Bensouda, in anticipation of a later investigation into possible war crimes committed by U.S. forces during the War in Afghanistan;[50] the investigation was authorized in March 2020.[51] In June 2020, Donald Trump authorized sanctions against ICC in retaliation for the aforementioned case.

      Обратитесь письменно к госдуме рф с требованием предоставить вам возможность обратиться в международный суд ООН с исковым заявлением к США.

      Международное право основано на прецендентном праве.
      Т.е. Судья принимает решение на основании решения ранее вынесенному другим судьей по схожим обстоятельствам.
      Если есть различия в решении, то судья обязан обосновать отклонения с сылкой на нормы законодательства.
      Четко и ясно, без разночтнниц.
      Именно по этим причинам все чиновники и путинские олигархи решают свои "теры" в Высоком Суде Лондона. (неожиданно да?)
      В этой ситуации прецендент есть-Гитлер. Решение суда согласно преценденту. Все остальные действия будут согласно Нюрнберга.

    ICJ didn't work in 2014 when Russia took Crimea , why would it work now.

      No Nato country has been complicit in genocide in any country of the world. Arab factionalism did that all by itself in Iraq and in Afghanistan the West sought to give freedom to the people from estremist Taliban. Stop blaming the west for trying to rid the world of horrible murderous dictators like Ghaddafi,Hussein,The Taliban,etc. Furthermore Nato fought on behalf of Muslims oppressd and killed by Putin's cousins, the Serbs, in Bosnia and Kosova. People should not live in fear anywhere in the world.

    3. Judge Xue states that Ukraine’s contention is based on a mischaracterization of the Russian
    Federation’s position on its military operations. She notes that the Russian Federation invokes
    Article 51 of the United Nations Charter on self-defence and customary international law as the legal
    basis for its military operations. Nowhere has the Russian Federation claimed that the Genocide
    Convention authorizes it to use force against Ukraine as a means of fulfilling its obligation under
    Article I thereof to prevent and punish genocide. Whether the Russian Federation may exercise
    self-defence as it claims under the circumstances is apparently not governed by the Genocide
    Convention.

      @@wolfofmagdeburg yep. Except they do more than that. They provide security for civilians trying to escape... security that is only being provided right now volunteers like myself and others. Untrained, and out of shape volunteers... verses trained soldiers that are allowed to use force to defend civilians under them.
      That alone would drop the civilian body count by a lot.
