      Hey Brian, I have quick question I am hoping you can answer. My fiancé has two children she will be bringing with her. Do I just list them on the 134 and submit one 134 to cover all three of them or do I need to have 3 separate 134s, one with each of them named as beneficiary? Thanks@@backwithbryan

    Hi Bryan, i must express my appreciation and gratitude for your continuous guidance on the K1 fiance visa process. My USC fiance received our NOA2 letter which reflects a USCIS approval date: March 15, 2023, our NOA1 letter is dated: January 28, 2022, however, he haven't receive the NVC welcome letter as yet as at April 21, 2023. Nevertheless, we are being patient for the NVC letter. The NOA2 letter also indicate a expiration date of July 17, 2023. I, at this time would really appreciate some guidance on the salary figures for the affidavit of support; he has 3 children for whom he has shared custody with his ex-wife by which the divorce settlement/ agreement is that he has the children every other weekend and I have 3 children as well. My USC fiance submitted all of his children and my children information when he filed the I-129f which was approved. I however, intend to take 2 of my children with me at first. Please note that all the children are below 18 years old. I at this time would appreciate your assistance to know my USC fiance salary requirement considering the fact that his children spends every other weekend with him and he will be providing financial support for me and 2 of my children. Your guide guidance is eagerly anticipated.

    @14:09 you said #10 what is your relationship to the beneficiary.
    That’s not what number 10 is on the image you’re showing nor is it on the current form for the I 134 .

      The form I used is the old one. So you need to use the current updated i134 form.

    Please sir just let me know when to submit this form. My case is at NVC right now. Please clear me one thing that my fiance have to take this form with her on interview day or we have to submit before to Uscis??

      This form will be use for the interview. And with evidences attach to it. That is the important thing. The petitioner that lives in the USA. Needs to fill this form. And sign and date it. And submit all financial evidences to send to the fiance. Either mail or email. As long it’s in hand before the interview date.

    I know USCIS use to not want any sections blank, even if it dnt pertain to you. At one point , they wanted people to put N/A in sections that they didnt need to fill out; USCIS didnt want any blank boxes. I wonder if they are still doing that

      Yes. You can write N/A on each blank space.

    The form gives 2 options for the basis of filing - "Myself as the beneficiary" and Another individual who is the beneficiary" which is why I find it confusing that you would check that in reference to yourself. I think that if there was an option of "Petitioner," then you could.

      Intended. Because that’s the support of the co sponsor.

    I have a question if my fiance does not have any assets(he is in Nigeria) he is just a low-income but I did not fill anything out since the currency is not the same. but for my assets do I have to screenshot my amount in my bank even tho I made the 30k yearly threshold, do I need to fill out the assets or what? i feel weird screenshotting my amount in my savings to show them. AND what do you mean by total income? like if I made 30k a year that is how much per month right?

      So if you have a paystub of what you make. That can be used as evidences for your income. If you have checking or saving accounts of how much you saved and have retirement or stock investment. Use those as evidences
      But if you make at least 30k in your income. For the whole entire year. Annual income. Print out a paystubs for like a month. And also have an employee employment letter from you boss and that they can write out a letter for you regarding pay and income as well. You can use that as evidences.

    Your birth certificate , passport, are they going to be photo copies or you’re sending original? And for tax return are u sending all pages? Plesse specify as it helps viewers and thanks for the view it really helped.

      Yes all photo copies. Do not send originals. Unless USCIS tells you that you need to send the original documents to them if they get suspicious . So in the meantime. You can send it all duplicate photos copies.

      This is from USCIS AND STATE GOV:
      Edition Date
      01/04/23. Starting March 6, 2023, we will only accept the 01/04/23 edition. Until then, you can also use the 10/18/22 edition. You can find the edition date at the bottom of the page on the form and instructions.

      You can sign that two months before the interview. That’s totally fine. As long it’s signed and dated. That’s all it matters.

    Hey Bryan is the l - 134 needed by everyone to have it and do it is the me to have it in my time of interview or we send it to NVC I just want to be sure on when do we use the l-134 when he fills it in he send it to me or he uploads it online for the NVC or it’s just one of evidence for me to have on the day of my interview?

    My lawyer on line 21 put " I do not Intend to make specific contributions" She explained to me that there is nothing specific needed to list since you are married everything will be joint and this form is used for a lot of different things. However if everyone else is checking the "I attend to box" then I think i may change it :/ ?

    Greetings, further to my question to 2 days ago re calculating the Affidavit of financial support for my K1 and K2 visa..base on his current dependent + me and 2 of my 3 children proposed to immigrate with me to be with him, his annual salary fall short for the household count for 7 people, can i show evidence of my bank account in my country that can make up the difference to be 100%?

      You can show all your investments for your financial to provide for your fiance interview
      Such as bank statements , investments in real estate or stocks / bonds , retirement accounts and pension or anything that deals with saving.

      You need the petitioner to fill it out and submit all the evidences prior to the interview. So that you have it ready by the interview date.

    Does the beneficiary bring the I-134 and supporting documents to the interview or does it need to be submitted in advance. If so where does it get filed?

      Bring to the interview. With all supporting. Documents. And also all relationships documents as well.

    On the latest edition of form I-134 it does not ask for my fiancé’s passport information. Am I using the right form? Because I was watching your video and I don’t see, but you mentioned it.

      As long as the form is signed by the petitioner and he sent all the evidences for that to you.
      Because you will need to use those for your interview time.

      @@kathg-f9c the form you needed to do is I134 - a that’s gonna be the sponsorship of where they need to fill out the forms and submit all their evidence as well to you. Plus, the petitioner is still fill out the 134 form as well and his or her evidence.

      Yup add it. Cause its evidences of retirement funds and investments as well. Every little thing make a good evidences.

    Hello Bryan .
    I just received this from the NVC , and I am confused . The NVC said “ we received your case January 12 th 2023 , and we will notify you when your case get transferred to the us embassy” . Knowing that my approval date was October 24 th 2022. And I contact the NVC in December 2022 and they said we recently received your case it is waiting for the input in our system.please any input from you ! Thank you in advance .

      So that means. Your case is not in the system yet. Once it’s in the system database. They will send you an email of the welcome letter of your new case number. That way you can track it to see where is your case will be at your fiancé abroad embassy country.
      Right now. It’s at NVC. Which is good. But it needs to be process from there. Crossing fingers for you. Goodluck and keep me posted. Almost there.

      But in December 14 th 2022 they said my case is received recently . Today January 20th saying my case was received January 12 th 2023 . Something is not right !!

      @@chafeakerkache6429 so you need to contact NVC and let them know that you didn’t get an hard copy of approval letter. And you need it asap for your evidence.
      Also send them a message that you are missing your welcome letter with your case record number.
      They should send you both information that way you have your evidences for it. Hope that helps.
      You will need both approval letter and welcome letter for your fiance evidence. Cause she will need it for the interview. Since you got approved and your case is ready at her embassy. You need to provide that to her and ship it all to her before her interview date.

      Nope you don’t need to upload anything to the CEAC site or anything. You will need to submit the i134 forms and sign and date it. And send it to your fiancé. So that she will be ready for the interview with that evidence.

      The i134 form is to be filled up by the petitioner that lives in the USA. That is the person that’s going to be writing the form. That person is going to submit all the financial evidence to the beneficial that lives abroad. that’s including bank statement, savings, checking stock, investments, retirement, and etc.
      The beneficiary that lives internationally won’t be filling this form.

    Hi Bryan, I am somewhat confused about the welcome letter. I received notification via e-mail from the NVC stating that my petition was received at the NVC and that it was being sent to the Embassy. It included the name of the Embassy and address as well as a case number and USCIS Receipt number. It did not have instructions on how to proceed on the next steps. It was the same letter you previously posted. I don't think this is the "Welcome Letter". I think this is just a notification from NVC updating me on the status of my petition. Am I correct? Thanks.

      I believe that the actual Welcome Letter comes from the US Embassy and not the NVC.

      If you she works. Then you need to change her income and her work on the i134 form. Then make sure you say she works in her country. And make sure you can still support her as well.

      Because your fiancé will need all those hardcopies for evidence to present it to the embassy for their interview. The interview person will look over all those papers and hardcopies in order to make sure everything is submitted correctly and to process your case.
      If you email your fiancé with all those documents, your fiancé would do a lot of hard work of going to the print shop printing all those paper over there.

      One more question, I was looking at the instructions for the i-134 and it says to submit a letter from the bank officer saying when my account was created, how much has been deposited so far, the current balance. Do you think it would be possible if I just provided pay stubs and a few bank statements that show this instead? I'm having a really difficult time trying to tell customer service at Wells Fargo what I need and came across your channel as well as a few others and many people seem like they don't even get the letter from the bank. They just get pay stubs, tax info, bank statements, along with their letter from their job and that's it. What do you think?

      @@Strong2091 if you have checking , savings, investments in stocks , retirement plans, life insurance, pay stubs from your job for two months. Then use all of those as evidences. Along with the copy of the i134 with date and signing on the forms.

      It’s up to you. I would leave it out. So that you petitioner will be the one fully support you. That’s what I did. I left my fiancé (beneficiary ) with no income.

      Put your new job on the i134 form. And submit your 2020-2022 tax transcripts. Even if your making less in the previous years. Just let your fiancé know that your making more money this year. And make sure she says something to the interview on your job and how much you making now.

      It’s prefer to be either type it out. Or write in pen. I don’t think you can do both. So make sure you are doing what needs to be done.

      To support a foreign national with the declaration forms, you need to show income or financial resources that are 100% of the federal poverty guidelines for the respective household size. And it’s based on your state.

    Hi if I gross $36000 on 1099 by driving with Uber and I claim almost $10000 on car payment, maintenance, phone bills and more. Is it enough to file the I-134 declaration of support? I know 1040 is different.

      @@johnjunior22 if it’s over your state poverty line of 100 percent. Then you’re good.
      But make sure on where you live, your poverty line has to meet at least 110%. . For example, in the state of Hawaii as long as I make about 25,000 in a year, I’m good.

      When you add your assets in the field. It’s the total amount of assets you have in your pay and investments.
      So when you add your checking account. And if you have 401k. Stock investments. Or retirement funds or or property ownership
      You can add that all together.
      It’s pretty much how much you have in your accounts in finances.

    Can you say if my USC Fiancé (petitionioner) shared custody children who, as per the court's custodial arrangement, spends every other weekend with him (the children do not live with him, they spend every other weekend with him) and for whom he does alternate claim on annual tax returns are considered as part of his household size/ count in calculating the household size. He has 3 children with his ex-wife and they spend every other weekend with him and they are dependent on him so I need to know how to treat his situation for determining his current household size and the fact that I, the alien fiance have 3 children, however, I plan to take 2 of my 3 children with me. Please note that our I-129f petition was approved on March 15, 2023, as such, we are awaiting our welcome letter from the NVC and I need some guide re Affidavit of finance support eligibility. I look forward to your response to my question, Kind Regards.

      Nope. The beneficiary can do the form and that person will sign or the petitioner (sponsors ) will fill the form and sign it.
      Not both. But it’s ideally the petitioner will do the forms. Cause it’s their financial evidence that they need to support the fiance coming to the USA.
