      The DA AND the Judge, In the pretrial hearing the video showed the girl plant the bottle AND lie to the other cops so that was clearly PLANTED evidence so the defense moved to omit the bottle BUT the Judge overruled allowing the bottle to remain as evidence. That is outrageous!

      @@ultraman33624 Actually judges have what's called "absolute immunity", and qualified immunity is not a defense against evidence tampering or perjury. If the man wins and files a lawsuit, the cop will claim QI, but I don't expect it would go in her favor. Judges generally don't give QI to cops who lie on the stand or plant evidence.

    Here is the issue. That officer "In plain veiw removed and "cracked open a sealed bottle of alcohol from the door pocket to then toss it into the passer front seat. As that would mean she was also oblivious to the full weight of the bottle when she picked it up and how much contents she poured out. All oversights on her part and further reason to scrutinize the DUI charge.

      The prosecutor wants to get a guilty verdict to prevent a civil rights lawsuit. She knows that the first cop has no credibility, she's claiming there's no relevant physical evidence, and without either of those, we all know there's no case for the DUI.
      (Is the suspended license charge legitimate? I don't know enough about state law to make any comments on it.)

      One article said that his refusal to take the sobriety test is why they were able to arrest him (they didn’t tell him that refusing would mean arrest) but what’s crazy is that the officer has NOT said that on the stand. She hasn’t mentioned that part at all! It’s like shes saying he showed enough signs of being inebriated + the suspended license…. they haven’t painted a clear picture

      If he swerved, I would like to see the dash cam to prove it.
      She said his speed and no headlights drew her attention but the location where she stopped him was in the city with street lights. If he had traveled a little further south of where she stopped him he would have noticed his lights were not on.

    The only probable cause of DUI they had ( Bad Evidence ) the woman officers words was the bottle that she emptied her self. He was still detained with handcuffs for the drivers license charge not DUI so she created probable cause with her criminal action. She lied to her Sargant on scene when he asked if she had enough to arrest . She said yeah lot of booze in the car. I found a little vodka bottle. Her boss asked open? She said yes.

      Yes she did. Lied to the sergeant. Before that, she tested the lie on the back up officer and allowed (by omission) that officer to place it in the arrest report.

      She OPENED the bottle!!! It was a small bottle of vodka and you could hear the seal pop when she opened it. She claimed she only realized it was an unopened bottle after she opened it. Then she poured it out and put the empty bottle in the passenger seat!! Then she lied to her LT. And said the bottle was empty and opened.

      Exactly! Then, she testified she didn't test the other cup and neither were considered as evidence of impairment. His eyes which I doubt she saw at night behind glasses, his speech-- the sound on the video clip played doesn't indicate he was slurring he was VERY clear in what he says REPEATEDLY, and his "aggression" towards having been told contradictions in the reasoning for his arrest and despite REPEATEDLY advising the officer he had nothing further to say being pressed on the matter. What happened to the marijuana she claimed to be smelling? When she couldn't substantiate the arrest they lied to cover the rest. Is it common protocol for one officer to ask the others is they had their body cams on? Apparently in this police force it is because noone seemed to think it out of the ordinary. The defense attorney should have pressed harder on having the officers identify which protocols they were following. They claimed to pull him over for driving erratically and speeding now it's changed to headlights?!?

    1. You smelled marijuana, and found none, so one can conclude that your smeller is not functioning at all, since you found none.
    2. You smelled alcohol in insulated cup, since your smeller is not functioning at all it is reasonable to assert that, you are wrong. If you thought, that alcohol was in the insulated cup why not test it? You let custody of evidence be compromised by having it towed with vehicle.
    3. Did defendant submit to field sobriety tests? Was defendant given tests by blood after arrest? What were the results? Should we just take your word, when you smell nonexistent marijuana and alcohol, that your visual assessment is that he was impaired.
    4. If you were falsely accused of something would you get angry? Just maybe that would explain his "aggressive behavior" which didn't occur until after his arrest and "charge of DUI".
    5. At the scene you did tell the arresting officer that there was an open container. You also told the Sargent on the scene that there was an open container as well.
    6. The only "evidence" of DUI was your personal observation? Much like your smelling marijuana I would assume. (Strike that your honor)

    This is a whole waste of tax payer money to have a case when this officer clearly planted evidence. Never want to take accountability and just say they made a mistake. The most that should be concerned about is the suspended license but even that is circustantial as to whether he knew about it. She needs to be held in contempt for lying under oath because that evasiveness is only showing she is lying trying to cover her behind. I hope yhis jury sees through this mess and doesnt take all day to make a decision.

    All charges should be dropped. This officer told the male cop she found alcohol in the car. He said it was not open. This cop responded yes, open. The male cop then says ok. That was all the basis for the DUI. All three officers then turned off their body cams to confer. They even ask each other where their cams are off. The victim was not fumbling with his papers in the visor either. This whole incident is a shame.

    she is a liar, plain and simple a liar. He should be cut free. I need to keep it real, he is guilty of one thing. Driving while black, I hate to go there but I can't figure it out for any other reason, I can't. I just wish he did not say a word but he did. I hope the jury is a jury of his peers and all that it implies. I am so tired of our court system being used for other motives than the law. I don't want to get political or focus on race but that is the theme. Race has been an issue for years for improper arrests, politics has been added some lately and now if you are aware of your civil rights that is now a reason to cuff someone up and stuff them in the back of a cop car. Anything short of full compliance to what ever law enforcement wants turns into a bogus charge or some 'trumped" up charge. This guy should be released, all charges dropped, given an apology and a nice check for his rights being violated. So sad, I also think the judge is part of it now with some of his rulings, just a shame. People wonder why the "system" is not trusted even more now, videos don't lie. What the cops do now to combat videos is turn their mics off. I say if a mic is turned off it is an immediate dismissal of that police officer and all charges dropped. Enough already, enough. I am so sorry this man is being treated like this. One last thing, the public defender means well but she is challenged a bit. Look forward to his full exoneration.

    In NH case law has established they have to prove you read the letter of license suspension, the state mailing it alone isn’t sufficient. The judge I prosecuted in front of was the judge that was overturned in the case law. Winning a OAS was impossible unless they confessed to it.

    If she did that to the sealed bottle in order to charge him, she’s guilty of planting evidence 100% and needs to be fired and charged.
    If an officer acts in good faith, even if they make a mistake I’ll back them.
    As far as the address goes, that’s his fault, if he doesn’t check the address that his licence has on it that’s no excuse to deny not getting notice of a suspended licence.
    Did he take a PBT or chemical test at the station?

      The address on his license is where he lives. The notice was not sent there. Everyone agrees on these facts. So ... by your own standards, it's not his fault.
      Second, is there any sign that she acted in good faith with regards to the bottle? She claims she didn't realize it was sealed until watching the video later, but certainly she knew it was full when she picked it up. However, she didn't inform any other officer on scene that (a) it was sealed, (b) it was full, or (c) that she poured it out.

      If she did that to get him charged then she deserves everything she gets, but I don’t believe he was charged with it.
      If the suspension notice wasn’t sent to his home address, and that was the address on his licence then despite not knowing how that could possibly happen he obviously can’t be blamed for not knowing, I agree. But where does the PO Box come into it, who gave that address?
      Did he pass or fail the chemical test?
      Because I personally feel DUI is one of the most disgusting offences that someone can commit, it has killed entire generations of families, unfortunately usually leaving the DUI driver alive, those crashes involving DUI drivers are NEVER an accident, they knowingly drive with the knowledge they may kill.

    How it works is once on the job you bring 100s if not 1000s of good cases or tickets. 10 MPH+ over the limit and blatant infractions to earn a good rapport with the judges and your supervisors. A rookie such as this has no proven record with the PD, Court or the public. She is an absurdity. A major case waiting to happen. Get rid of her before her first re enlistment or probation. ASAP!

    She saw a "black man" driving & profiled him, full stop! Then she took advantage of the situation when she saw the "SEALED, UNOPENED" bottle & made the decision to open said sealed bottle, (if you watch the video, you'll hear the seal break when she openes it!) Then she tosses the bottle w/some liquid still left in it, back into the car, then yells "DUI" to get "points" on her job!

Then she should be fired & NEVER be allowed to work as a police officer position again, as long as she is on planet earth!
    1st - You don't ask him if he knew his license is suspended, you just "Ass-U-Me" he knew! 2nd - You didn't do a breath-alize to verify that the man was in fact, intoxicated. 3rd - You don't have the content of the cup tested.
    But, the thing that stands out the most to me is, "Oficer Oliver "IS" a lier.......period!!! She is willing to "FRAME" a man to fit her racist naritive!
    If you watch her deposition, basically all she says is "I can't recall" or "I don't remember".......when the answer goes against her, but her yass can remember everything else about the stop when it's against the defendant!
