Thanks for the comment. I have seen these types of legal issues tried - and fail. I don’t think there is much to them at municipal or district court level (I don’t see most judges daring to dismiss based on such arguments). To change this I suspect someone with deep pockets will have to appeal such a decision and take to the appellate level. Interesting and creative arguments for sure.

Question: this is the third ticket infraction I’ve gotten on this type of violation. It has to do with cameras at traffic lights, and is the most insidious of all of them! And the light is red on a four-way stop, but as you’re turning right, you can see that there is no traffic, crossing your path, but only going into of the opposite directions. The problem is if you don’t make a full stop before you turn, right, they’ve got you. Everyone I’ve noticed does not make this full stop, but slows way down to a crawl to see if there’s any traffic or pedestrians. This one frustrates me big time, as it seems it’s just a way for the city to make money!
I do see these types of "violations" which is frustrating. Sometimes an argument, if true, is that you stopped before the stop line and then had to proceed forward to see the entire intersection - but the camera (and officer, if present) only sees you rolling through the intersection and not the complete stop prior to the stop line. Another course to take is to study the MUTCD - which has certain requirements for signs, markings, etc. Has the government complied with these requirements (it's a lot of work for a "ticket" but sometimes principle is important too). Speaking of principle, if you are permitted a contested hearing, voice your concerns (and make an argument) to the court. Sometimes when judges repeatedly hear the same issue they may use their discretion and dismiss the ticket. Good luck.
I have to go to court today for an unpaid ticket, I had gotten a ticket for expired license plate during COVID I sent a check that was never cashed not sure it was lost, everything was closed at that time , I totally lost track and thought they forgave me for it lol 3 yrs later I have to pay over 300 dls but didn’t open up the envelope til literally due date to make payments and when I went to court to arrange payment the court was closed because of Cesar Chavez day 😩 so had to schedule court and is today and I’m not sure what I’m doing, never been in court before.

However, on the ticket the officer wrote down the incorrect intersection so my plan is to argue that the officers testimony does not match the ticket, and that this serious error can cause too much speculation on anything else the officer may claim as it does not match the accusation.
Great question: First, there is a complicated answer but second, there is a common sense answer. Traffic court is pretty relaxed and evidence is admitted far more commonly than other courts. If there is a prosecutor present, there may be more push back but here is what you need to do: -Bring at least two copies, as the court may keep your copy in the small chance of an appeal. -Do not edit the video - this may appear like manipulation. If it is long, be prepared to inform the court where the action occurs so they can jump to it. -If possible, and especially if your digital evidence is in an uncommon format, bring your own laptop or other device through which you can display your evidence. -Inform the court at the start of the hearing that you have a video and wish to admit it as evidence. The court may want to hear from you what the specific video will show and even, how it is important. Be prepared to answer questions such as, the date/time of video, location of video, who filmed the video and that it is a true and correct copy. If you were not the person who did the filming, you will need the individual who was, who can identify the video and validate its authenticity (a Declaration from the person may suffice) -Finally, read the local court rules as each court may have different rules for identifying the video. I am in one court that demands the defendant to provide the video to the prosecutor and court one-week ahead of the contested hearing. In summary, take two copies, be prepared to authenticate the video (when, where, what, why and who did the filming) and bring the original version (do not edit the video (i.e. don't chop it up)).
How would you go about being ticketed for running a redlight? I never ran the light i was behind 4 cars and the police was behind me. We were at the light for 2 to 3 min and then i decideded to take a right to turn down the road to U turn in front of the green light on the otherside, and as soon as I took the right he immediately turned his lights on. First, the strength of your defense somewhat depends on the language of the Statute. You'll have to testify or provide a decalaration supporting your assertion. The more details from you the better. Likewise, the fewer details from the officer, the better for you. Did he see you with the phone in your hand? Did he see you looking at the phone? Was it dark? Was his view unobstructed? This information is important to have if the State/City wants to prevail.

He took me my driver license and everything from the truck and put three tickets…truck out route. Earbuds ticket. E improper phone use. Never was the phone my hand anyway he assumed I was an a call. I got stopped in NH, for going 50 in a 30 but the cop did so while driving behind another car less than car length away and claimed he used Radar which to my understanding would be difficult to get an accurate reading with the other car in front of him.
Sorry to hear - if the officer is saying he had a radar reading but yet, there was a vehicle between you and him, he's not being honest. This would be impossible as the radar is not hitting your vehicle it is hitting another vehicle. You need to fight this!
Hard to say - likely it will NOT if everything else on the ticket is correct. There are some judges I know who might rule in your favor but most won't. I think I would need to know more details to give a better response, however.

I contested a red light tickey in Puyallup. The video they provided does not show the driver. I asked for it to be dismissed based on not able to see the driver. Now the court sent me a mitigation hearing notice. Why would a court send me a mitigation hearing notice?
Sorry I didn't see your comment but thank you for it. I do not know why you received a mitigation notice - if you contested the ticket, you're contesting not mitigating. When I have defended red light tickets with no proof of the driver (i.e. Lynnwood), the case usually is found in favor of the alleged driver due to the inability to prove who was - in fact - the driver. Anyway, I would call the court (if it's not too late) to see why the mitigation hearing notice was sent.

Got a ticket for a faded license plate I think it’s clearly visible. I thought it was going to be a fixed ticket but is not. Um…I don’t really know enough to know if I can give advice. If you can, be sure you contest the hearing. You have a time period when you can do this so be sure you request a contested hearing timely. If you do this you have several options.
I was given a running a red light ticket . The traffic lights werent working and I thought the officer who was present was directing traffic. So when the cars in front of me went I followed. I requested discovery from the clerk who told me the prosecutor will have it. I pleaded not guilty and scheduled a pretrial conference with the prosecutor. Do I have a case for a dismissal.
To be fair, it's impossible to say without actually looking at the evidence or reading the local court rules. However, in infraction cases (non-criminal - although there could be a similar argument in criminal courts) if you properly request discovery and it is not provided then the case can be dismissed. However, setting a pretrial suggests your matter is criminal - is it? Regardless, the facts sound a litle suspect - you cannot "run a red light" if there is no red-light functioning.

Don't pay it??? In order to even be able to defend myself, I was forced to pay the 'bail' amount before being able to defend myself legally. This not only sounds unconstitutional. But also goes against everything that the democrats talk about with this thing called "equity" they love talking about. This punishes poor people who don't have that in their bank. Being forced to pay bail on a fucking traffic ticket their not guilty of. Just to be able to legally defend themselves sounds like straight up tyranny. I was just forced at the court to pay in order to schedule a hearing to contest my ticket. How is this constitutional? In forcing someone to pay in order to defend themselves. @@legaleaz can confirm it is this way in southern california, as my ticket states that "you may be required to submit the bail amount" when contensting violation and requesting "court trial", and "trial by written declaration" expressly instructs "submit the bail amount" as the second order, the first order being to appear in person or send a certified or registered letter postmarked not later than 5 days prior to appearance date to request court trial. 'may be', baby.

Don't pay it??? In order to even be able to defend myself, I was forced to pay the 'bail' amount before being able to defend myself legally. This not only sounds unconstitutional. But also goes against everything that the democrats talk about with this thing called "equity" they love talking about. This punishes poor people who don't have that in their bank.
Being forced to pay bail on a fucking traffic ticket their not guilty of. Just to be able to legally defend themselves sounds like straight up tyranny. I was just forced at the court to pay in order to schedule a hearing to contest my ticket. How is this constitutional? In forcing someone to pay in order to defend themselves. This country is progressively getting worse.

@@legaleaz can confirm it is this way in southern california, as my ticket states that "you may be required to submit the bail amount" when contensting violation and requesting "court trial", and "trial by written declaration" expressly instructs "submit the bail amount" as the second order, the first order being to appear in person or send a certified or registered letter postmarked not later than 5 days prior to appearance date to request court trial.
