    I took his advice and spoke the the prosecutor before court and took a plea deal and got my traffic ticket dismissed. Thanks for the advice

    I've watched about 100 TH-cam speeding ticket videos about court. This was the best one. Thanks

    I'm in the trucking industry, so as you would know, we are one big red target for law enforcement, and I have become quite desensitized by law enforcement confrontation. Something I *ALWAYS* do whenever I'm stopped, or in the face of law enforcement accusation is to invoke my right to remain silent pursuamt to the Fifth. I do not answer any questions related to the scope of the charge. This can go a long way with the court, especially if the officer continues to pressure you about the charge that he/she is alleging.

    Never had a ticket in all my life, I’m in my mid thirties had a terrible migraine and was going home to get Prescription migraine medicine and I told home that. I also gave him the brand name and generic name of the medicine. He still wrote me a ticket....ticket says 81 in a 55 ( should I contest it?). I hope one day they can understand what it’s like to have a debilitating chronic neurological condition

    What about if your driving on a very busy road. How is the officer certain that it was your car that he clocked?

      A proper tracking history is important. Without it, an officer cannot tell for sure that the results are accurate.

    A thorough, dedicated effort. Thank you for the information. Always good to know what works and what doesn't from someone who litigates and observes in courtrooms every day.

    My father had a -57 record at the time of his death. Speeding 145 in a 35 is never a good idea.

IT CAME TO THE POINT THAT I HAD TO PAY LAWYERS EVERY MONTH.FROM MY PERSONAL EXPERIENCE I CAN TELL YOU ARE A GREAT MAN AND WHAT YOU SAY ARE ACCURATE AND CORRECT. everytime i've been to court the cop says he had the radar calibrated that morning. EVERY TIME. (even though they most likely didn't) I also live in VA

    • @NicholsGreen

      Yes, some officers think no one will know whether they are telling the truth and this is incorrect. There are way to detect some lies and this is where a good attorney separates themselves from the rest.

    going slower does not necessarily mean more fuel efficient most modern cars are at the most fuel efficient around 40-45 miles per hour.

    Hey, if I called you, would you able to give some.tips? I have a speeding ticket for 27 over but it's not reckless driving. My girlfriend was in major pain, and I was taking her to the hospital. I have a prescribed bottle of medicine to prove it. I live in California, and everyone was doing 80 at the minimum. That's just how it is tbh.

    I also wanted to ask, can one insist on why officer pulled them over before handing over license and registration?

    • @NicholsGreen
      @NicholsGreen  7 ปีที่แล้ว +15

      In Virginia, you can ask, but the officer doesn't have to answer. And you are required to produce license and registration regardless.

    Hi, I live in Western Australia and Im in the process of fighting a speeding fine. But today I got pulled over cause apparently my car is red flaged as a disqualified driver owner due to loss of points. My car was seized for 28 days leaving me a disabled person who lives in the country with no transportation. On top of that I've been charged with driving with no license. When I rang the Department Of Transport (DOT) they told me that speeding fine I'm disputing has been taken off my license already and I've been suspending for three months from driving. Surely this is not legal I cant afford a fancy lawyer can you recommend anything to for me read or advice to help me represent myself.

    I just got a ticket in Hungry Mother state park for 59 in a 40. I was driving my S2000 after winter storage. I drove my much slower CR-V all winter. I felt i was just cruising normally on a 2 lane road however I did fail to notice the 40mph sign upon entering the park and was ticketed. I have no violations whatsoever for the last 15 years or so and no serious tickets ever. Any advice on trying to minimize the damage as far as insurance and license points.

    OMG-My-God, an actually helpful video about fighting speeding tickets. So many BS videos by people either trying to sell you something or "sovereign citizen" morons.
    Sometimes I see vids by people who mean well, but don't teach anything -- these people just got lucky. I sat through 15 min of a guy who just delayed and delayed and then the cop didn't show (this was in CA, not VA) for the court date. Well good for you! I am very glad you got out of your ticket that way, but that is not an effective defense!
    Thanks for this.

    Is it legally for a police officer follow an over speed car without lights up?

    • @NicholsGreen
      @NicholsGreen  5 ปีที่แล้ว +10

      in Va an officer can speed without their emergency lights on if they are pacing a car.

    • @NicholsGreen
      @NicholsGreen  5 ปีที่แล้ว +7

      Talk to a local attorney but it is pretty common to prosecute people based on the testimony of a non law enforcement witness. We see this all the time in car accident cases. it's just unusual in speeding cases.

    What about the angle of deflection defense? Is it relevant on presenting reasonable doubt, if the officer can't prove at what angle he used LIDAR/RADAR? (Have court in a week from today.)

    • @NicholsGreen
      @NicholsGreen  4 ปีที่แล้ว +9

      Cosine error or angle of deflection as you call it always helps the driver by lowering the speed measurement except in very specific moving radar in opposite direction situations when the cosine error effects only the ground speed measurement. So if you prove an officer was measuring your speed at an angle while the officer was stationary then what you are proving is that you were driving FASTER than the officers measurement.

    You spoke of "Pacing" as determining speed. What about "Breaking the law to enforce the law?" Without emergency lights that officer is then breaking the law, or am I mistaken?

    • @NicholsGreen
      @NicholsGreen  7 ปีที่แล้ว +5

      Police in Virginia are allowed by law to break the speed limit while performing a pace or calibrating their speed equipment under V.a Code 46.2-920(D) "D. Any law-enforcement vehicle operated by or under the direction of a federal, state, or local law-enforcement officer may disregard speedlimits, while having due regard for safety of persons and property, (i) in testing the accuracy of speedometers of such vehicles, (ii) in testing the accuracy of speed measuring devices specified in § 46.2-882, or (iii) in following another vehicle for the purpose of determining its speed." So they are not breaking the law.

  • @texknight67
    @texknight67 6 ปีที่แล้ว +38

    If someone told me their speedometer was broken, I'd include a defective equipment citation with the speeding ticket.

    • @NicholsGreen
      @NicholsGreen  6 ปีที่แล้ว +92

      That is why you don't talk to cops.
