      Private Prosecution for Offence under Sec5 POA 1986. And a Breach of Personal Rights. Let us tell Police to stop filming me when on the street without my permission. This is a fascist dictate. Get rid of you councillors who support this, that means. Council have no police powers. Send the same letter back to the Council as a person you have the right to seek redress in a Court of law. A number is also not a signature.

      This has nothing to do with being alarmed anbd distressed and it's not just the police (read the letter), it's about being peceived as a conducting in anti social behaviour. I personally don't think it is but you and I aren't in the position to determine that.

      @@HoratioChinn Anti-social behaviour (according to the 2014 act) means "conduct that has caused, or is likely to cause, harassment, alarm or distress to any person".
      There are also two additional meanings, both of which apply to residential premises and neither of which apply here.
      The standard of "harassment, alarm or distress" continues to be that a "reasonable person" rather than a "gigantic snowflake" is the person feeling harassed, alarmed or distressed.
      In the context of Reggie's video, the only people who might reasonably be said to be engaged in "conduct that has caused, or is likely to cause, harassment, alarm or distress to any person" are the police officers who repeatedly tried to coerce and bully Reggie into refraining from a lawful activity.

I read the letter Not to engage threaten to engage in behaviour which may cause Harassment Alarm or Distress. But its ok for them to do it to Reggie and that's ok . That was my point.

    That woman in the video was an absolute disgrace and clearly a nasty piece of work. They are basically trying to scare you into stopping and will know if you take them to court they will lose. No doubt you will take care of them as you always do. Keep up the good work Reggie.

    Reggie, I can assure you that you need to follow this up with a formal complaint to the police. The only offence committed was the police officer stopping you from carrying out a lawful activity - I believe the officer would receive a warning or reprimand for the way you were treated and spoken with…go for it👍👍

    May I suggest the good people of Blackpool, and countrywide start making "Alarm, harassed and distressed" complaints about all the unwanted filming by CCTV cameras of people in public. If it works against you Reggie, then surely it works the other way around also.

      Absolutely agree, I wrote to Blackpool council making this exact point two years ago about a CPW they issued to another auditor - just sent them the same email demanding that they switch off all their CCTV cameras and body warns as I will be visiting Blackpool in two weeks time.

    Great update. I would challenge this vexatious and unlawful twaddle as a pre-emptive strike against a CPN - I would also raise it with the Local Government & Social Care Ombudsman. From published guidance on ASB “It is essential that officers do not use CPNs to curtail reasonable or innocent activities, which others simply do not like, or those which do not fully meet the tests”. I will make several complaints to different governmental bodies with absolute pleasure.

    Have you spoken to a solicitor?
    The basis of their complaint is that you filmed people in a public place. I don't remember you making derogatory remarks and I did watch the original video. The phrase 'in an effort to provoke them' makes a pretty big assumption based on nothing obvious.
    I'd say you have grounds to fight this and win.
    'Entering businesses and police stations', is not unlawful, and neither is filming them.
    Go get em!

      Snowflakes that hate freedom of the people from doing legal activities. Trying to stop people from doing a legal activity is a crime in itself. If they get away with this then anyone, I mean anyone with a camera would be subject to the same charges, including a family taking photos of family enjoying a day out at the seaside.

      Photography itself is not illegal but what can be classed as 'anti social behaviour' can be interpreted broadly so doing something legal but persistantly and impacting other people could fall foul of it. Personally given what could fall under anti social behavour I'd doubt it would be totally quashed if a Community Protection Notice was actually issued after this warning letter.

      Reading through the legislation it doesn't look like you can appeal against a 'warning' only against the 'notice'. Which has to be against the laws of natural Justice

    I would question the legal status of that letter. It asks for a signature, not a shoulder number.

      They definitely did this on the basis that Reggie is a known Auditor. This should have no affect given it's a legal document.. But yet again, we see "special" treatment towards anyone who decides to Audit.

      This is just a warning letter so has no legal status. If he fails to comply with the warning they may then issue a CPN which does have legal status and if not complied with can lead to a criminal conviction. Reggie would have 21 days to appeal the notice in a magistrates court though reading the permitted grounds for appeal he could maybe claim the requirements may be partly unreasonable.

    I do street-photography in my town everyday, I checked the legality at my local police station, and was told "You can do it , but some people might not like it" and was advised to print out some sort of ID to give people a clue what i was doing. (I made a lanyard with a youtube logo on it)
    Highly doubt they can seriously tell you to stop based on this.

    Reggie, this must surely be an unauthorised warning and should therefore be vigorously contested. Exercising your right, in the way you certainly did in that video, can not and should never be regarded as unlawful or harming in any way. If that were the case, it would surely be the end of our fundamental human rights. Do everything in your power to seek redress and put an end to this utter nonsense, right now!.

      Agree to above. Is that actually a genuine letter? It seems very amateur in its presentation. No contact information, no real validity as to whom its from. A scribbled number in biro just doesn't seem very official to me. I'd be tempted to try and enquire more about the true validity of this letter. Also why wasn't it delivered via say recorded delivery? I feel that police officers have better things to be doing than acting on behalf of Postman Pat and Mrs Goggins.

    Im not sure how these allegations meet the legal definition of anti-social behaviour. My advice would be to lawyer up and get the police/council to send a retraction and apology.

    He who makes a claim bears the burden of proof"-
    This maxim is so powerful and so relavent because every written instrument you receive, either through the mail, attached to your conveyance, or in your hand will nearly always be somebody making a claim; usually there are multiple claims in every written instrument.
    *If somebody makes a claim verbally, ask them to put it in writing.
    The basis of each claim will be that an act/statute/regulation/policy or something of that nature applies to you, (that's a claim).
    To be able to know whether the act/regulation etc in question applies specifically to you, the (claimant) would need to have first-hand knowledge of this, (so that's another claim).
    There is a claim of jurisdiction over you.
    A claim that a corporation known as "HM Parliament and Government PLC" or "The Council" etc has jurisdiction over you and can make you do things.
    Usually there is a claim that you owe some corporation some money, so there is a claim that they have a true bill. For there to be a true bill the (claimant) is indirectly claiming to be in possession of a legally binding contract between yourself and a man or a woman from that corporation.
    *Corporations/companies/logos do not make claims, men and women make claims.
    The (claimant) nearly always claims to be immune from their own legislation, so much so that you will need to go online and find out who is responsible for these claims.
    The (claimant) seems to believe that leaving his/her name and signature off the document means that he/she isn't liable; wrong.
    If no man or woman has taken legal responsibility for the written instrument in question the CEO, or the most senior employee is liable (vicarious liability).
    Once you have a name the burden of proof is on that named individual (claimant) to provide the physical presentable evidence to support their claim(s). If the claimant fails to present the material evidence to support their claim then that claim is fraudulent in nature, which is a CHARGEABLE CRIMINAL OFFENCE.
    The burden of proof always lies with the claimant, so keep it there where it belongs. Never allow the claimant to shift that burden by making claims of your own. Stay focused on the claims being made against you, stick with this method and you will succeed 🙏🙏

      It's the local authority, police, or in some situations, social housing landlords.
      Magistrates deal with appeals against CPN's.

    Just sent a FOIA request to Blackpool council asking for copies of the complaints received. Specifically asking for details of complainant to be redacted. It’s not much and I’m sure they’ll try to weasel out of providing it but I’ll do my best to get what I can. Take care Reggie

    Reggie the First thing you need to do, is a GDPR request to the council asking for all of the data they are holding and processing about you, this will have to include the complaints that have been made about you, dont ask for the complaints specifically in your request just ask for all information,if they don’t provide them in your request they won’t exist but you can then go back and ask for them specifically if they provide them this time report them for a breach of gdpr, then a second one in to Police, guaranteed there have been none from the public this has come from the police and the council looking at a way to retaliate against you, if you establish that there were no complaints, it’s misuse of powers, misrepresentation, and unlawful processing of your data.

      You're jumping the gun, this letter is just a warning, you can comply with the request or just ignore it. There in nothing you can do until a CPN itself is issued (if ever) if he does not change behaviour and then you have the right to appeal it.

      If the issuer is acting out of personal feelings, retaliation (possible in collusion) against policy then they need to be dealt with by the council or police.
      If it is a copper then it could be a section 26 charge

    You can fight that CPW within 6 weeks at a magistrate court, as far as I know. The Black Belt Barrister mentions a CSPO (which is similar) in his video with the title "Prosecuted for THINKING and Prayers", so watch this video. The police memo says you can film in a police station. A solicitor will make short work of this CPW.

I used to work for the company that operated the covert cameras in Brixton and the vast majority of people would never know that they have been subjected to facial recognition or that their image has been stored. And people only become criminals after they have been convicted of a crime.
