      in this video he says the officer has to tell him under what section... he doesnt. only when you are charged you have to officially be told the section. he was only investigating and only needed to say the reason why to the suspect. all was done correctly, he investigated, told him why and let him go once he established no crime was committed.

    So basically he's detaining you to see if you have a drone. If you do have one, you are free to go as no crime was committed. If you don't have one, you are free to go as no crime was committed.

    Reggie my son that was totally brilliant. Seems like these cops have taken it upon themselves to take away the publics right to film. Aggressive officer shouting a load of babble while he tries think up a crime he can do you for, accuses you of being aggressive because your reply was interfering with his ability to think. The police refuse to follow their own policies for photography They REALLY do not want independent auditing , i wonder why.

    What an embarrassment, "you've got nothing better to do" personally I think finding poorly educated Police officers who are quite happy to abuse their powers enforcing "laws" the are obviously too lazy to learn, or they lack the capacity to apply those laws in a fair, reasoned and mature fashion, is NOT a waste of time. The rights of the individual are trampled underfoot again with false detainment and ridiculous threats.

    If there is a sign on a door or entry way, unless otherwise stated, the sign applies to the area past the door or entry way.
    If the sing on that entry way was a 5mph speed limit sign, it doesn't apply to the road in front of the entry way. It applies to the area past the entry way.

    What a complete fool that copper was. If I lived next door to him I’d be asking over the garden fence if it was an offence to carry a game controller in public. If I worked with him I’d be saying ‘mate, you made yourself look a complete tool there’. The PCSO was like a little child having been made a toilet monitor.       The detainment was presupposed on a false premise; therefore it was an unlawful detainment, i.e., a criminal offence. The Officer who committed the criminal offence needs to be arrested and charged accordingly.

    Reggie is brilliant. It takes a lot of confidence to do such audits and the way he handles a pack of contentious officers by simply knowing his rights is impressive. We should all strive to have the same knowledge as Reggie so that if you do ever encounter such officers you are prepared. Also to note, most people can get flustered when confronted by officers, the adrenaline rush gets to them and they slip up or aren't as concise as they could be in the heat of the moment and the officers pounce on that. Reggie has incredible composure. An example to us all. Keep going Reg!!

    I'm stopping you because I'm unsure if you're breaking the law! That's called an investigation and is not a basis for detainment. Nor is flying a drone above buildings that aren't subject to the official secrets act or into restricted airspace. This detainment was a 100% illegal and clearly (based on his personal opinions and knowledge of auditing) retaliatory stop.

      I personally think the police are concerned that they will be seen to be idle layabouts, certainly not turning up at many crime scenes anymore, 4 days to turn up to a burglary woke an 83-year-old woman at 2am to give her a "crime number" or whatever for insurance, no investigation whatsoever

    I do not believe a copper can detain anyone for any other reason than to conduct a search because they have reasonable suspicion that the person is in possession of drugs, offensive weapon or articles connected to terrorism (with some other very specific exceptions not relevant here). They have to tell you why you are being detained for a search.
    This video shows none of that, therefore illegal detainment.
    Please tell me if I am wrong or not.

    What a clown who should really look up the law before he calls you out in breaking the law. Flying a drone over the police station is in itself not unlawful unless the CAA disallows it fir being in a restricted air space. Take this further Reggie as it is clear he should not be a cop.     Well I ascertained from the comfort of my armchair that officer is a complete idiot who doesn't know the law. and I didn't need a drone to do it. Plonker.

      Under Modus Ponens law he is affirming the consequent, i.e., assuming the consequent implies the antecedent, rather than the antecedent implies the consequent.
      In laymen's terms: he assumes an offence has been committed without having any evidence of the offence, and without being able to actually articulate the section of law which has been broken.
      It's like saying, "I don't know what offence you have committed, and I don't have any evidence to imply you have committed an offence; but, I believe you have committed an offence and i'm going to find out [a] what that offence is, and [b] what evidence there is for that offence".

    Hi Reggie Photo, the catalogue of compound error the man gets caught up in is almost incredible!, to start with he did not introduce himself properly, he then fell into the trap of claiming that he was applying laws that he knew nothing about and using his suspicion alone without any necessary foundation.
    In the end he has to take the walk of shame without the slightest sign of humility or contrition, I think the term 'butt hurt' fits him quite well.
    Some people might suggest that your provocative behaviour was not reasonable or necessary and that might br true but it is part of standard police procedure to learn to deal with 'awkward customers' in a calm and respectful manner and absorb any and all provocation, failure to do so in any way let alone all ways is not acceptable and if it takes the activities of people like you to expose those deficiencies then good on you!.

    A quick Google search will tell you there are only 3 occasions when a police officer can ' detain' you. All other times they need to arrest you. This was totally unlawful and if you can make a complaint at the very least.

    That sign must apply if you are entering the station. It is NOT legally enforceable on the public footpath. Unless restrictive bylaws have been sneaked in.

    You cannot be detained until they find out if you have committed an offence. This resulted in a payout by the Met Police a year or so ago by Iain Gould (solicitor) who fought a case like this and won compensation.
    And here's the big one......section 25 of PACE was repealed in 2006 and replaced by section 24. It's not a power to detain it covers powers to arrest.
    I sent an email to the Chief Constable Michelle Skeer regarding this incident.
    UPDATE...... Received reply from Chiefs batman. He has forwarded the complaint to PSD. They can't do anything because I'm not a witness. But if Reggie has complained it will be taken into consideration.

      It remains that right up until a conviction......or not.

      @@budgetnuclearweapons7858 They can't detain you to do an investigation to find out a crime, they can only detain you to search you under any relevant legislation, Misuse of drugs, section 1of PACE, et Al. Otherwise you could be stopped and detained on a whim until the police find a crime.
      See Walker v The Commissioner of Police of the Metropolis. (2014). EWCA. Civ 897.

    6:00 And one minute after the start of the encounter, PC 154 now makes the biggest mistake of his life (other than being born, but that's not fair on his parents who probably love him to bits) and detains Reggie when the law he's quoted doesn't exist and therefore makes the detention unlawful. He can't use the excuse of not needing to know every single bit of the law when he had more than enough opportunity to be informed of the law before he came out and approached Reggie. There was no expeditious reason to detain Reggie as he wasn't running away so PC 154 had time to inform himself beforehand. And when it comes to complaint and civil case time, the police can't use the excuse that he acted properly even if just a bit mistaken - that didn't work in Julian Chamberlain's case and he got £5k as a result.

    Flying a drone over a police station is not a crime.. hence Section 25 of PACE doesn’t apply since you can be arrested for any offence.
    That was an unlawful detainment.. the police cannot detain you until they figure out if a crime had been committed…

    Somebody needs to educate him on the laws of photography in public and the laws on the sky.He also needs to be educated in how to properly investigate a person and a situation.I really hope you take this further.

    That sign is meaningless and the police don't have the authority to dictate what hobbies people conduct in the street. People need to go to this police station and record it constantly because that poolice sergeant said it was against the LAW.

For those not aware in a nut shell about twenty years ago Barbara Streisand didn’t want a photographer who was doing some sort of art project thing to video her posh house from the air (I think)and made a song and dance about it in court. In the end photos of the house and presumably gardens etc of it ended up on the news and hundreds and hundreds of nosey people came to visit.

    8:45 And now the most serious mistake committed by PC 154 - section 25 of the Police and Criminal Evidence Act 1984 was repealed in 2006. If he meant section 24, which being kind to him due to his emotional distress, he was really thinking of, then he would would've got away with it if he actually arrested Reggie and not just detained him. Reggie would only have to give his name and address after arrest not just by being detained. Detainment only allows PC 154 to investigate and the first thing he should've done is look at the controller and tell Reggie to bring the drone down.

The Reflective Practice process aims to challenge officers where they may fall short through constructive conversations with their line manager to identify and implement any necessary learning. This may include, but is not limited to, additional training, closer supervision, refreshers of guidance etc.”
