      @Ruru Home second degree murder requires malice aforethought, but is not premeditated. first-degree manslaughter is called a 'crime of passion' i.e. in the heat of the moment which involved no prior intent to kill. second-degree manslaughter is death by negligence whereby you kill someone accidentally but due to a fault of your own e.g. dui.

    Update: They were all sentenced in December 2023 to life without parole. I really wish they would have allowed cameras in the courtroom during sentencing so we could look at Franecha's face. She probably still doesn't think she did anything wrong.

      @PanderTech That doesn’t matter. It’s called felony murder. If someone dies while you are committing a felony, you are charged with murder. You don’t have to be the one pulling the trigger. The person could ever die of a heart attack, you still get charged with murder.

      @Saxoner Serb you do realize she's still young right? She clearly doesn't have enough life experience to apply reason to her actions. She probably wasn't aware of the consequences at the time and she had no one to tell her wjat she was doing was wrong, I'm not saying she should be exempt from prosecution but you have to take into consideration on what could've gotten her into this situation. You wouldn't have to steal if you are well off and you would clearly know this isn't how you go about acquiring the stuff you need if someone had taught you better. But stiff like this should be handled on a case by case basis.

    In case anyone is interested. All three perpetrators and currently in Georgia Prisons serving Life without parole.       @Gabriel Moeller Okay, if you’re ever arrested, I hope you’ll be satisfied to be found guilty before there’s ever a trial. Just tell the judge as soon as the charges are read you’d like your sentence right now. You obviously don’t believe in the American principle of trials. You can just go to jail as soon as the judge reads the charges.
      As for those who believe in the regular justice, it goes like this: there needs to be probable cause for arrest, some facts to support charges (which will be read in court), BUT the person is not found guilty until after a trial at which time they have been proven guilty beyond reasonable doubt. Many people are arrested and later set free because they are found innocent and/or charges are dropped.

      Read the book Starship Troopers for a lecture about how we treat kids worse than animals. If a dog pees on the floor, do you ignore it for years then suddenly decide to shoot it in the head? No. You maybe paddle the dog a little or rub his nose in it and tell him NO until he gets the message. But we do that to people. We ignore the crimes of kids for years until the crimes get bigger and bigger and we let them off because they're kids then one day they grow up and we decide to either put them in jail for life or execute them. It's kinda cruel when you think about it and not entirely their fault because they were never told NO. I'm not saying we should let criminals like this off, but as a society we need to do better with showing them right from wrong and holding them responsible for their behavior starting at a very young age.

      People often don't understand that if they are in any way involved in a crime that also resulted in someone's death, even if they only played a small part in that crime and didn't commit the murder themselves, they are still guilty of felony murder.
