Do 501c3 board members have to be US citizens?
Answer: There is no requirement under the federal tax laws governing United States 501(c)(3) and other tax-exempt organizations that Board members be U.S. residents or U.S. citizens.Jun 8, 2022

I can’t speak to NY state law (which probably allows it) but im not aware of any rule in the federal tax code that prevents non US citizens from serving on a board.
