I have a feeling that the guy doesn't know himself. He did some shit in a drug induced haze, and now he himself has a hard time figuring out. He isn't a some kind of a clever mastermind who came up with the scam scheme, just a disposable junkie whom the handler sent in to catch the cheques. I'm not defending him and he deserves the punishment, but I don't think he was intentionally trying to deceive the judge (at least not for all things that didn't add up).

The judge was fishing for more people for the prosecutor to charge and find a way to send the defendant to prison and claim that he gave him a chance to come clean. If this guy had told the truth he would likely have been killed in prison (or the state run treatment program he would have been sent to) and both knew it. I think the judge had seen him on so many charges in the past that he wanted an excuse to send him to prison and he found it, using a ruse he knew would work. He didn't care that he could have literally cost the defendant his life in prison. I do agree with the judge that all of the names the defendant stated on the record were made up out of thin air, I don't agree with the judge forcing the guy to either give up information in open court or go to prison instead of treatment, though.

The perp just couldn't help but lie, and the judge knew what was up. He deserves every minute of prison time he got.
What was truly hilarious is that he kept changing who wrote the checks... egad. That is red-flag city right there. I noticed there was an adjournment in the middle. It wouldn't surprise me that the judge did that to affect his memory of his lies.. and even if he didn't.. the perp made a complete hash of his original assertions anyways.

Its very weird, we don't take white collar crime or fraud very seriously in US criminal justice. I just saw a meme where a homeless dude robbed someone for $100, turned himself in the day after the crime, and got 15 years. Meanwhile, an executive with an MBA defrauded people to the tune of 3 billion dollars, and they gave him three years.
I personally think it's a big problem. Americans get so focused on stuff that's inconsequential or totally trivial when it comes to crime. They miss these kinds of crimes, which are extremely destructive. Very few people will ever get robbed in person, but almost everyone has had a credit card stolen, knows a senior who got defraud, has had their information stolen, etc.
I don't get it. I don't understand why these people aren't getting more serious sentences.

so the judge denies the request for probation, and gives him 12 months.... you wanted how long? Do you believe that he will be rehabilitated more and change his ways better after say.... 5 years in jail, rather than be even more incapable of returning to society and living legally?
The US has the highest incarceration rate in the world, apart from a few tinpot countries. The financial cost of these incarcerations must be significant, as well as the social cost.
I'm not yet at the end of the video, to understand if/ how many times or for how long he's been incarcerated before, which of course would be relevant.
This judge would do well in the french legal system, where there is a combined role of investigating and judging. He's doing a job that should have been done by cops and a prosecutor.... he's done very well.
Ahh...so the defendant has gone to prison before. It seems he knows he'd find prison a very unhappy place. It seems he's been on probation a number of times, with unsatisfactory results. If he's had 12 months sentences before, perhaps he could have got 2 or 3 years, but if his previous sentences had been short, then 12 months sounds like he'll remember it forever, and perhaps modify his behaviour.

      @wolfumz หลายเดือนก่อน +2

I suspect this guy realized halfway through that he was violating "street code," and was switching on his fellow criminals, who were involved in the cheque cashing scheme with him.
Depending on which state you're incarcerated in, having a record that you snitched, or named someone else in any way, that can be a problem for inmates, if someone finds you. If there are any court documents that make it seems like you cooperated with law enforcement, you can get your ass kicked, or get killed.
So I suspect these other people provided the stolen cheques to him. So, instead of saying that, he tries lying and says he randomly found the cheques, in an attempt to follow "Street code". This lie did not go well for him, he was obviously unprepared and thought the conversation would revolve around giving him another chance.
I spent ten years working as a drug counselor for probationers, I know the profile pretty well. This guy reminded me of clients I've seen in the past.
Anytime you're applying pressure to one of these guys, and start their answer with, "I'm going to be honest...", you can basically guarantee whatever they say next is a lie. Someone how is being honest, and just going off memory, they will just give you the answer straight. But if someone is lying, they will try to make themselves appear honest with these kind of qualifiers.

Exactly. Most people don't understand courts of law. They operate the way science operates. Empirical evidence is needed to convict (in science, empirical evidence via results either prove or disprove hypothesis or theories).
All the judge needed to do was establish the facts, and then question the perp about methods and those he was involved with (to try to catch more fish with the same hook and bait). The perp knew that if he gave up other names he might end up losing his life to those other perps. So he lies and simply guarantees a max sentence for what he did based on the original facts.

I live in a small town in southern Minnesota.
One day, we got our bank statement. There were pages and pages of .99 cents transactions for games and we were overdrawn.
Immediately went to the bank and spoke to an accounts manager who promptly accused our 5 year old son for the charges.
Yeah, that didn't go over well and we got into a heated argument.
Anyways, we sat there and on a piece of paper, listed every single transaction.
While doing that, a farmer walked in and said he wanted to speak to the bank manager. HE had his statement which showed hundreds and hundreds of transactions for games on his account.
Come to find out that there were several people in town that this happened to.
Our money was returned back to our account as were other victims.
The person who did this was arrested but we never found out what had happened to her.

Perfect example of the endless attempts dishonest people will go through to avoid responsibility - - to avoid actual consequences for their bad acts. Takes 25 minutes lying to the Judge until the Judge Finally Gives Him the "Chance to PROVE WHAT ? " You were all over the place at check cashing places - - THEN When He KNOWS The Judge Is COMPLETELY Not Accepting Any of His Made Up Crap Responses He Gets To : "Please Your Honor - - I'm Not Trying To Lie To You - - I Don't Want To Go To Jail". These People Really Think They Can TALK A JUDGE OUT OF SENDING THEM TO PRISON FOR THEIR CRIMES ! Can you imagine all the people in this man's life who he talked endlessly to = getting favors, chances, rides, cover stories - while he went around making money by taking money from people and doing false check writing and fraudulent "Business Deals"? He Would Have NEVER STOPPED.

My son has gotten into trouble time and time and time again. I don’t know why he can’t seem to learn from his mistakes and he’s a liar and a thief. I did not raise him that way. He was greatly loved from birth, was just the cutest little boy, and I did my best to teach him right from wrong and not to lie. I just really don’t know what happened! He wasn’t spoiled but got everything he needed and I corrected him when he did bad things. I was careful to tell him HE wasn’t bad but what he DID was bad. Just the usual kid stuff like lying or taking things that weren’t his. And I loved him. I told him I loved him, I showed him I loved him, and my heart is broken because of and FOR him. He’s almost 50. I finally just cut off communication with him because he called from jail and lied through his teeth about why and he blamed other people. I cannot do it any more. I literally put him in Gods Hands. I will continue to pray for him, and pray that he won’t hurt anybody else. This guy here, I’ve heard those excuses and how he blames somebody else and POOR ME.
