    Generally when I get into an argument about paying for someone elses mistake, if it gets nasty, I close with "if this $50 is worth more to you than my continued business, then by all means I will pay it, but you won't be getting another dime from me going forward." I've had tremendous luck with it, and usually cooler heads prevail and they see it my way. I've also offered to pay half if it ends up being a service I like or something I can't easily replace.

    Put some white river rocks in the bottom of the vase. Maybe a small strand of white fairy lights, hide them in the rocks and light them up for ambiance ❤️✨

    If you have the email assuring you of the remaining session, I would forward that to them with the statement that you wouldn't have booked the session if you had to pay for it (that's entrapment, bait and switch to get an extra paid session from people). Explain that if it's worth it to them to lose a customer and future income over a mistake they clearly made, you'll pay the 50 quid (at some point) and explain the situation with the name of the service on all your social media advising people to avoid their service.

    Their mistake is not your responsibility. Especially if you can prove their mistake. I work for a solicitor firm up north and if it is your word against theirs, noone will touch it with a barge pole. If they send it to a debt recovery company then challenge it. Also if theres a marker against you for the debt, go to citizens advice and have it removed from your file because companies are so quick to do this and it's not fair. It damages peoples credit for years and needs no proof of missed payment.

    Put some decorative glass marbles in the bottom of the glass vase to give it a pop of color! shop.houseofmarbles.com/category/marbles/

    It will cost more for them to sue you than the money owing. I am not sure how that works in UK, here in Canada it would never happen. We have a starting limit to sue someone in court and I think at this moment the amount must be 2500.00 otherwise its not worth the while to bog up the system. If you have confirmation that you were informed twice that you had one more session then you are good to go to prove that you were told something therefore you acted. I would not pay a company for this type of error. What a good way to increase their sales. Imagine if they did this to everyone on a regular basis. How much money are they making by doing this. What bad business practice. They would not get a way with that here in Canada. Thankful we have the Consumer Protection Act, to protect consumers! Its a great law.

    Achillea sold me on that bag. Key holding perfection. I love when your and Joel's filming overlaps and I see segments here that I saw on his vlogs separate, but now from your perspective. Christianne's video of your hike was wonderful. She's quite talented.

  • @susieb8661
    @susieb8661 4 ปีที่แล้ว

    Style ideas - A mirror in the entry is nice over the table for final check before you leave - and yes another order of the willows will fill that vase better (or another something to mix with it). Put a silver tray or box to house the keys / sunglasses.

    • @susieb8661
      @susieb8661 4 ปีที่แล้ว

      PS - If you have an email from the person saying you had the extra session that's all you need to prove it - and they can't say another word. But they know you had that conversation if you don't have it in writing - So hopefully they'll grow a conscience and leave it be.

    It is so frustrating when you try to do the right thing and then you're given wrong information. I normally don't like to give my opinion on how to handle a business situation, but since you asked in your video I will give you my "two cents." A company who values you as a customer and hopes for repeat business/good referrals should accept their error in advising you that you had one more session and excuse you for any money owed. That being said, I think that if you received a service (whether or not you thought you previously paid for it), then you should pay for it. However; since you were ill-advised, you should be given a grace period or a payment plan (maybe 5 or 10 quid per month) to pay your debt.

    • @tinaw.6178
      @tinaw.6178 4 ปีที่แล้ว +1

      Yeah, it totally sucks but you did receive the service so you do need to pay. Also, you as the customer should keep up with your own number of sessions.

    • @dobiebloke9311
      @dobiebloke9311 4 ปีที่แล้ว +2

      Fred and tina - I disagree with you and here's why. According to Lia, she asked twice and was given the same erroneous information. That more than satisfies her responsibility for keeping a track of it. It was pre-paid. They shouldn't tell her she's got one left, if she doesn't. As far as she knows, she's already paid for it, so she is due it, particularly if they insist she does. They had two opportunities to get it right, yet they couldn't. That is their fault and not hers.
      Think of it this way, what better sales pitch to squeeze another play, than this very act, if it were done intentionally. If it was intentional, the company should be brought up on charges. If it wasn't intentional, they should eat the price as the cost of doing business, not to mention to maintain their good reputation, should they have one.
      I would do as Jerry McKuen suggests, for such a nominal fee, I'd pay it, with the warning that they will not only get no more business from me, but I'll be sure to tell all my friends, family and neighbors, what they have done. Sorry Jerry, I wouldn't compromise and pay half for their mistake. It will be all or nothing. Of course, I would make them start the process to sue me first, before I paid, as at least then the company would have to pay the penalty a lawyers fee. Good luck, getting your 50 quid back after that bill comes to your door. The smart thing is for the company to eat it and any smart business would.
      Having been in business myself for many years, let me assure you, I would never even suggest that Lia pay it. I would apologize and just hope that Lia would forgive my business for such a transgression. Anyone who doesn't see that, has either never been in business, or at least, doesn't do business as I do.
      I've been in similar situations and the cost to my business was much more than 50 quid, but I ate it as that was the right thing to do. No business can afford bad advertising and bad word of mouth, is the worst you can get. Eat it as the cost of doing business, and you will make that money back soon enough.
      But go ahead, sue someone like Lia for your own mistake, and I assure you, that is probably not your only bad business practice, and you won't be in business for long anyway.
      I was on the other side of it once, as a customer. Early in the morning, nobody on line behind me, and the teller totally messes up my order. Half the mistakes were in the stores favour and half were in my favour, and I told her, this is terribly wrong, and you forgot to charge me for this $80 boat cover. Just wipe it out and do it again, which she did, and she came up with another wrong tally, and still, you forgot to charge me for the boat cover.
      Now she and I are totally calm, and there's no upset going on between us, but I said, let's just have the store manager come and give it a try. So she calls him over and for whatever reason, he shows up all ticked off about I don't know what, but nor do I really care. He rings up my items and this time, it's done right, however he too, didn't charge me for the boat cover.
      So, I told him, your tally isn't right, you didn't charge me for the boat cover. Now, the boat cover is the biggest item on the counter, right in front of everyone, so it's not like it's hidden behind something. So, he looks at me and says, Are you telling me that I don't know how to do my job? I said, no Sir, I'm just saying that you didn't charge me for the boat cover, and I tapped my finger on it, so that there would be no missing it.
      He said, yes I did. Now you can either pay your bill and leave, or you can just leave. I said, OK. I paid my bill, he put my goods in bags and I walked out of there with a free $80 boat cover and a clear conscience. How many times do I have to point it out and yet be treated rudely for it?

      I think it boils down to - if they correctly told you that you had 0 more sessions, would you have scheduled the 11th session? If you would have then their error wouldn't have caused you to make a different decision. Then it would be fair to pay them.
      But, if they would have correctly told you that there are no more sessions left and you wouldn't have scheduled that 11th session because you are low on funds, then you shouldn't have to pay.
      So basically, it's what you would have done had they correctly told you that you had no more sessions left. And only you know that.

    Great vlog! Lia, you are relatable! I don't know anyone who has their keys ready when they need them. We're with you, Lia. Their mistake - they pay for it. You did your part. They're being unreasonable. Just a suggestion for the table, you could get a decorative box with hinged lid to drop things in. They're always handy, but not visible. One stupid suggestion, a different color pussywillow would pop a bit more against the wall, if they accept returns. Maybe a color that would go with the print you're considering and the decorative box I'm pushing you to purchase. I know, it takes time and money and I have neither either. Love those vegan bags! Can't wait for more footage from Greece! Tyfs.💕🥂

    Well, Lia, since the mistake was theirs, they cannot hold you liable for paying for the session, as you were given to understand that it was already paid for by yourself. If they can't keep better track of things on their end, then they shouldn't even be in business. Love the vase, btw.

    I don't know if this legal situation is still going on but if it is, or if anyone else finds themselves in a similar pickle, in the US, we would call what the service provider did creating a "detrimental reliance". Not sure if the law works the same way in the UK, but in the US, you'd have a valid defense against paying that bill.

  • @203maxwell
    @203maxwell 4 ปีที่แล้ว

    if they said you had one left, and you verified it, then that was their error and you did everything you could. if it's their error, they should pay for it. Another example I can think of is if you owe somebody money, and they write you a receipt, and it turns out you underpaid and they miscounted the money, once the transaction is complete, the balance shown on the receipt is what they go by

  • @Zstray17
    @Zstray17 4 ปีที่แล้ว +1

    If you buy a certain amount of sessions, you should know how many you have, because you should value your money and time. So partially on you. However, if you ask them, they check their “system” it should be an accurate number. In the end though, you’ve opted to pay for a service, and they should be willing to take the hit to keep a customer. Mistakes were made on both ends. Your suggestion of the calendar so both parties know was a great idea. Good luck to you, I think you should stand your ground.

  • @christophermckinney3924
    @christophermckinney3924 4 ปีที่แล้ว

    If you are sued, always counter sue for something. Even if it's weak. It forces the hand of the other side. The whole purpose of a law suit is to create a negotiation by which to resolve disputes. You can't negotiate on equal footing if one party sues and one party fails to. ALWAYS counter sue. Of course I'm an American and that's how we do things. But be prepared to spend a few thousand to keep a few thousand.

    Do you have a system in the UK like we have in the US called Small Claims Court. Small disputes, under a certain amount, are argued before a judge but without attorneys. I guess you call them Solicitors or Barristers (I never understood the difference.) But the proceedings are argued by you and a person from the company suing you before a judge. It's quick and not complicated. The judge makes a decision right then. The company arguing with you should realize the cost of using an attorney to sue is extremely prohibitive, so I'd just stand your ground. Even if you get a threatening letter: that's a scare tactic. They seem to be just making noise hoping they can scare a "weak" woman. Stay strong and bully's will go away.

      Excellent advice! I totally agree with you! Most companies will back down when you let them know that you have no qualms about seeing them in court.

      Yes we have a small claims section that sounds very similar. From memory there's a fixed fee, plus a percentage of the value to submit a claim. Unlikely to be worth it for £50. It's more likely to be handed to a debt recovery agency.

    • @rjdavid3
      @rjdavid3 4 ปีที่แล้ว

      @@ethelmini Interesting. Even if there is a debt collector, the amount owed still has to be valid. Lia could, in a strongly worded letter, claim the charge is false and explain why. In the US that would open them up to a lawsuit, even for a small amount, as it would violate our Federal Debt Collection Practices Act. Cooler heads should prevail at the company for 50 pounds. And we could sue for false credit reporting as it adds a false blemish to our credit rating.

    Hey Lia! Firstly, I'd like to thank you for your videos. Whenever I watch them I get a dose of good vibes 😍😚😊😁You're so gorgeous! And you're doing really important job by sharing what you want to share in such an intelligent and elegant way. As for the situation there, I can only say that myself I always have to muster up some courage to confront/complain and it's never easy. So I wonder how it ended (if it did by now)? Thanks again!

    Hi Lia! I don’t think you read comments this late after posting but I wanted to tell you that you and Joel have inspired me to do Vlogtober and I even filmed in a hotel bathrobe! Obviously, it made me think of you guys so I gave you a little shoutout at the 10:05 time stamp of today’s video. It’s definitely not much but I wanted to say hi just in case you wanted to check it out!

    In the states most companies would not go to court for that amount of money. If there was a contract that you executed when you started using the fitness center, you should review it.

    This session deals sometimes can get very confusing, so the best you can do is make 2 cards if they are not organized enough, every time you get a session they need to sign your card, and also you sign their card with the date on it.
    I would pay them and write them a note letting them know how unprofessional and disorganized they are, but tell them you can only give 10 pounds every 15 days for example or 20 days, you know, actually the woman that made the mistake is the one that should pay but she isn't going to, knowing that they would never have you back, and you wouldn't want to go back either (hope it helps).

    If you have the proof that it was their fault when they go to sue you they cannot get their money because you kept records.

    Lia, I have a quick suggestion for the vase with the Pussy Willow. Change the color of the wall behind it because the clear vase and the white branches get lost with all the white behind them.
    Just a thought.A bit of work I know as it seems that all your walls are white.... JRS

    Don't pay it! Pay your taxes because the government can throw you in jail for not paying your taxes. This company you're arguing with, tell them to go ahead and take legal action--it will cost them more to take you to court than the cost of the session. On your side girl, don't let them bully you.

    Lia, please do a proper English tea for your US TH-cam followers. I myself would love to see what that consists of. How you brew your tea and everything that goes into and along with a proper tea. I am a tea drinker and am curious about the afternoon ritual. I was also wondering what your favorite kinds/flavors are, ( English Breakfast, Earl Grey, etc.) I really enjoy your videos. In regards to the whole being charged for another persons mistake, you shouldn't have to pay but in this day and age don't be surprised if you end up having to. Businesses don't care about anything but the all mighty dollar and are certainly not going to accept or admit they made a mistake especially if there is money involved. Keep up the great work Lia, you and Joel are doing a great job.

    Lia - you can rely on reliance based estoppel if they try to sue you: en.wikipedia.org/wiki/Estoppel_in_English_law
    I don't think they will bother suing you for £50 - it will cost them more to go to court than they will recover and they won't be able to recover their costs for a small claim. Just ignore their demands - you are in the right.
