I think it’s the time they need the children to help them out of some trouble. And Judge Middleton is very kind….maybe a little too kind in some instances. It’s almost funny when he talks about someone who has missed several court dates then says “at least you’re here now”. Even when they lie to his face still no consequences or very little. And he always is more concerned about a defendant’s home or their children than the person does. I get he’s concerned about the kids but I’ve seen so many of the same ones return and return. Also seems like it’s such a small town and he knows just about everyone so he feels bad about any punishment. This courtroom appears to be unlike any other….everyone can talk and judge talks about how well or how long he’s known you or your family. And the prosecutor Mr. George either reduces and/or dismisses the charges. I understand small towns…spent many years in one but the courts are not like this one. And I think I heard him say on one case that he had sat down with the prosecutor and they agreed to either dismiss charges and plea to almost nothing. The victims don’t seem to get much justice at times….or perhaps I’m too hard-hearted.

If more people were sent to jail for 30-60 days the first time they're caught with a warning that there will be more jail time with the next offense they may think twice. As it stands with all of these deferred prosecuting programs there's little to no actual consequences which drives these people to steal more. It's sad that we're coddling criminals so much now.
The problem being, Val, the US has thirteen per cent of it's total population incarcerated - & it is your taxes that contribute to that imprisonment, so, in effect, Middleton is (in part) diverting your moneys to other more significant causes; he is also reducing the risk to many offenders becoming institutionalised - & that is key. On the whole, I'd agree with your sentiments, but it's been proven, time & again to fail...Personally, I'd put these youngsters on a chain gang, mending roads or breaking rocks in a quarry - something productive yet harsh - they'd be so tired at the end of each day, they wouldn't have time for larceny, or indeed any other form of criminal activity...

It matters that she has children. Not out of sympathy, but because they'd end up in the State's care while she serves time. CPS isn't your nanny while you're in jail. ... Of course, it's much more complicated than that. There are complex arguments to be had over what should be done with the children of offenders, especially serial offenders. However, if she doesn't have friends or family who are willing and able to take care of them for her, then her criminality would essentially get her free childcare from the State. Even if they fined her the costs, there's substantial risk, as a serial offender, that she'd never fully pay back the taxpayer. That, or she may choose increased criminality over raising her kids, knowing that they'd be taken care of. She could even come to enjoy being released from her parental responsibilities, regardless of the cost. That'd eventually result in termination of her parental rights. If her parental rights were terminated, then her children's care would fall on the State. If they're more than a few years old or have challenging issues, then they'd probably never get adopted. The Foster Care system is expensive and isn't exactly known for preventing criminality. Whether it's better to force her to provide and care for her children than to incarcerate her is, again, highly debatable. However, there are so many factors at play that it's probably the most practically favorable option for minimizing taxpayer costs. She should have to face the consequences of her choices, yes, but when the costs of imposing those consequences would cause more cost to society than they would prevent, then the calculus changes. There's no good solution, just a least-bad solution.
People need to be held accountable. She should serve her jail time in one term, pay restitution and what ever fines. This is not her first go around with the law so any leniency should not given.
Aw, come on! We all forget measly little theft charges that happened only 2 years ago, judge! Ya know how that stuff can just slip your mind! 🤦♀️😂 What a moron.

A woman with children would be eligible for Welfare, food stamps, medical coverage and likely housing help, so her excuse is BS. I wish judges would call these women out when they say it was for their children. Then we can also say, why are you having children without the means to take care of them. There IS birth control
It makes me so mad when women start crying about possibly going to jail and having to leave their kids. They should think about possible consequences before they commit crimes!!!! I do not feel sorry for them 😡. She’s lucky she got probation and only 30 days. And having to do jail time when it’s convenient is absolutely ridiculous!!!!! What’s the point?????
I would be scared to use my kids as an excuse for committing a crime or use any stolen money on them. But some really don't care because they have no concept of responsibility or repercussions

It’s always, “I start a new job tomorrow.” Never a strong enough sentence.
People need to be held accountable. She should serve her jail time in one term, pay restitution and what ever fines. This is not her first go around with the law so any leniency should not given.
I guarantee she spent very little on her kids! She's trying to garner sympathy by saying she spent it on "diaper's and food for her kids"
She really should have practiced her crying better, that was pathetic, just like her life 🤭
Aw, come on! We all forget measly little theft charges that happened only 2 years ago, judge! Ya know how that stuff can just slip your mind! 🤦♀️😂 What a moron.
She never bothered to check in with pre trial community corrections while out on bond. Anyone else seeing a problem with her getting probation besides me?
How would you like to spend 90 days in jail? Sound good? LOL, I died laughing. What a savage and perfect delivery.
Boy, she doesn't miss an opportunity to lie.
She sure doesn't sound very sick.
"I can't go to jail. I got babies!"
"Then I suppose the father will have to watch them."
I like her she literally turned on the water works when the Judge said 90 days jail. The second he changed his tone all tears cleared up. He should've made her do the 90 days but ppl get away w retail theft
Good call by the judge to give her probation. Mercy is necessary
This judge is to easy going to this thief !
3:17 You can use gift cards at ATMs?! Maybe she took debit cards. I thought she took Walmart gift cards.
Your honor, can I pay my fines using a gift card? 😂😂
"...for my kids". Right. And I'm the reincarnation of Cleopatra...
Can’t he charge her with lying under oath?
*parents
Temptation supported by legal system with tons of sympathy for criminal and no consideration of victim.
"The incident that caused my client to take the gift cards..."
Well at least he's Helping Out ❗ Thank you Judge 🤔⚖️
I could not buy food or diapers for my kids with stolen money. How can this woman sleep at night.
Evidently, quite well, it seems.
It is a recently discovered breed of Homo Sapiens, David - the Entitled.
But drugs yes
I would be scared to use my kids as an excuse for committing a crime or use any stolen money on them. But some really don't care because they have no concept of responsibility or repercussions
& therein lies the difference, Seashelle - you possess a moral & ethical code of conduct, that is your life ethos - it is innate.
And her lawyer lying to court saying no criminal history? 🤷🏻♀️
They only know what their client tells them. That’s why you don’t lie to your attorney.
This is a compulsive liar in action
Amazing that these defendants think the judge is an idiot who has never heard a mistruth before
There are very few things that are worse than a thief.
Who leaves unspent gift cards? Don’t believe it
Just love Judge Middleton xx
It's very offensive when judges or our justice system fails us! Too lenient on criminals only let's them continue to harm more victims and you're responsible for that.
I really like Judge JMids, but too often he's too soft. That's my only complaint about him. He's great at landlord tenant because he understands that involves people's housing, but with criminal matters, he's very lenient, too much so.
I agree should have gotten serious time
Her tears didn’t last very long
Every time a terrible person with kids gets caught.
They throw the kids in the ring to get them out of trouble.
So glad you use them as scapegoats for your terrible choices
I cant watch Judge Middleton anymore. Yes he is nice but he doesnt believe in consequences
Was she "concerned about her kids" durung the time she was stealing repeatedly, committing criminal acts?
She sure recovered from her sobbing fast @5:04
Jesus please us, this female should not be a parent.
90 DAYS SOUNDS GOOD TO ME
"I have job interviews." Aaand drink.
I have children and I have NEVER stole or shoplifted from anyone 😠 Absolutely no excuse to steal and then try and say it was for your kids 😠 How'd that work out for your kids with you going to jail now 😠
Why would you use the gift card at the atm to take out cash to pay for diapers? Why wouldnt you use the gift card to pay for them? If you're gonna lie, make it somewhat believable
Thats a lie the only way to get cash back from a prepaid gift card is cash back at a store. They dont work at the atm
Love how she stole $4k and got 30 days jail and a year of probation 😕
Considering she had a prior criminal history, it was far too lenient.
