I used to handle liability claims for a big insurance company. At least in my company/office, we did NOT look for ways to deny claims. Our jobs were WAAAAY easier when we could just cover and pay everything. When people lied and did stupid shit, then it becomes a pain in my ass because denials are way more work than paying.
We'd do recorded statement to determine liability or ensure coverage was appropriate and claimants would talk themselves right into fraud or fault. I'd even ask leading questions trying to help them, and they'd still be too stupid to not bury themselves.

As a log haul trucking company owner , I deal with insurance alot. My policy for one truck is 100k cargo value and 1 mill umbrella on top of truck and trailer value and under or un insured policy.
I have had cargo and damage claims and the insurance company will do everything they can to avoid paying. They have lawyers who find the smallest of loop holes to not pay. It their job.
By you lying to them, you just gave them a free DONT PAY card. They may know your lying and still take your money and not call you on it. But once a claim happens, they call you on the lie and say good bye and keep your money.
I seen it happen to other trucking companies.

    • @ViolentMLG
      @ViolentMLG 3 ปีที่แล้ว +8

Very true. That doesn't even mean the officer is in the right for giving said citation either. I was in an accident around 2 years ago, I was not at fault. To make a long story short, I was given a citation for an improper lane change even though that wasn't the case. I believe the officer misunderstood the situation.
Regardless, you can still dispute the citation in court, so its not something that can be considered as fact until its ruled on.
The INS situation went as annoying as you think it could go, especially given the citation, but I stood my ground and they eventually backed down. This is pretty unheard of, and I've been screwed in a few situations by insurance, but I learned my lesson, don't back down, regardless of how bad the situation looks. In the end, just don't waste your time with the company and tell them to see you in court.
Also, just an FYI to the point rob was speaking on, he was speaking about how committing fraud (lying) will get you no coverage but they won't refund your premium, I'm not sure if this is state-specific but they will refund your premium. If you lie and your policy is void then it technically never existed. You will get all of your premium's back, however, you also will be considered to not have insurance for however long you were with that company, or in other words, you have history of having no insurance, and over-all, I do not recommend lying for coverage, its just dumb, but yes, you will get your premiums back.

@@ViolentMLG That is the case in California and Texas. This is call a policy rescission and the policy premium is refunded up to the point of misrepresentation whether it be at the a specific policy renewal or since the policy inception. The premium refunded is also prorated so it would be less then what you actually paid the agent that sold you the policy but pretty close.
Every claim is case by case. The laws of the state, city, county, etc all effect the claim as well as the policy agreement. Also even if a coverage issue is deemed to be material the insurance company the company still has the discretion to extend coverage if they want to . This may be done if you are a long standing customer with little to no accidents (they may not want to lose a customer who has paid 10k in premiums over the last 10 years with no incidents over a 1k accident) or if the accident is minor and the company stands to lose more in rescinding the policy than paying out the claim (such as a 800 fenderbender when the policy rescission would result in a refund of 1.5k).

@@lordvader3538 You can usually make more money by parting out the car if it's an enthusiast car, like the type people like to heavily modify. If you don't want to go through the effort of parting out the car partially or completely you can just swap out the more valuable parts to then sell in a market place or if you want to buy the same car again, you will want the parts to salvage the custom parts to install in the new car.
Consider the worth of the vehicle and the insurance payout. It may be a total loss but you could just tell the insurance you want to repair it anyway so you can they buy the same car again and swap out the parts to the new car, part out the totaled car after getting what you need and then junking it.
There is a YT video where a kid talks with the insurance company over getting back his modifications and he goes to the insurance lot with tools and swaps out his wheels, suspension and other parts.
I totaled a car and my insurance payout for a car that is not on a loan was max $4,000 for total loss. I just chose to rebuild it anyway and I was paid $3,500 instead. It had over $8,000 in installed aftermarket parts. I could buy the same car for between $2,000 - $8,000 depending on condition and since I have spare parts from the wrecked car I could save money by buying a car with a bad suspension, wheel bearings, bad engine, transmission etc.

Just one correction, the garaging coverage issue would result in a rescission of the policy. The insurance company would refund the policy premium paid. At least that's the case in California and Texas. Policy premium would be refunded up to the period where the misrepresentation is present. So most policy premiums are for 6 month policies. If the policy was for January 2021 to June 2021and the accident happened in May and the policyholder only started garaging the vehicle in Florida in December 2020, the misrepresentation occurred at the renewal in January 2021 so all premiums paid from January 2021 to present would be refunded at prorate. If the vehicle have been kept at Florida address since May 2021 then the misrepresentation occurred when the policyholder renewed the policy in June 2020 and all premiums pay from June 2020 to present would be refunded prorated. Now the is just a general example. All claims are handled on a case by case basis and everything is dependent on the laws of the respective state and the policy agreement. I am an auto insurance adjuster. Just my 2 cents for those that want it.

The real issue here is that they told the insurance that the car in is Mass but they left it in FL and let other people drive it around FL. So as somebody who used to sell insurance, I saw this way more often than I should have. People lie to save money. They think it's inconsequential, until they get dropped by their insurance company or a claim will not be covered because they didn't tell their insurance company something truthful. Also, the process of your insurance company stepping in when you are being sued by the other insurance company, it's called subrogation. You are literally paying your insurance company to provide you legal services in the event of an accident. The other thing people don't think of, is commercial activity on a personal policy. If you have a personal Auto policy, and you do something like Uber or Lyft, or food delivery, and you get in an accident while on the job, your insurance company has every legal right to not cover it. If you want insurance for a commercial purpose, pay for commercial or business insurance. It's more expensive, and there's and there's a reason for that.

As an owner of an insurance agency I love this video. Rob is dead on that when there is a large claim the insurance companies will do a thorough investigation. If they find you lied or misrepresented material info like where the car is garaged or who regularly drives the car, they will definitely decline the claim. The most common gap I see is kids graduate from college and then move out of their parent’s home, but take the parent’s car. The parents keep the car insured con their policy, not knowing they now have no coverage. What is equally as bad is that the kid had no uninsured motorist coverage to protect them if they are injured by a drunk driver with no insurance. This is why everyone should have their own independent agent.

If you're going to try something like this, to protect your backside, everything should be "owned" by a corporation that you happen to be the owner of. If the car is totaled, the insurance company can't sue you personally, they have to sue the corporation. You can do things to dissolve the corporation and migrate all that it owns to a new corporation that the insurance company can't sue. Some shady rich people use tactics like this all the time to limit their personal liability and save money. If there is a loophole, it will be abused.
