    "Prosecutorial discretion" Literally means our laws mean nothing if the prosecutor decides not to charge. This negates our entire justice system and needs to be corrected. If you don't like having a two tiered justice then this is critical.

      Prosecutorial discretion is necessary, as it treats individuals as individuals. The problem can be when guardrails are widened to allow for discretion when it isn't in the best interests of the public.

      @@revkallisto How many people selected for Jury duty even know about Jury nullification? I'd say not many. It ought to be a standard practice on the part of the judge to instruct the jury prior to their decision. I sat on jury duty one time, and the man was guilty as sin but the way the prosecutor charged him, when the judge instructed us we had to find him innocent. The guy was charged with "Receiving and concealing stolen property." The judge instructed us "If you believe he is guilty of stealing the property, you must find him innocent of "receiving and concealing". The defense lawyer said something like, "No matter what you think of this man once this is done, will you make your decision based on the law".
      As I look back on it, on it obvious the prosecutor and defense got together to bring this about. The defense in his closing made a point to say, "His client could have been charged with both Stealing and receiving and concealing, but he wasn't thus you must find him innocent of receiving and concealing. It's sickening what America is becoming.

      Prosecutorial discretion was used rarely and used for specific circumstances. For example, using it as a bargaining chip for a plea bargain. Or not pursuing an offender who simply made a mistake.
      Now, however, it is used to send political messages. Not prosecuting illegal immigrants so they can avoid deportation. Not prosecuting certain protestors because they agree with the message. It is being abused, which is unfortunate.

      To your point, discretion is "the freedom to decide what should be done in a particular situation." The prosecutor (AG) is exercising discretion. You can argue that it's an abuse of discretion, or unfair or whatever, but it's by definition an exercise of prosecutorial discretion.

      1) This is about federal memos about federal laws sent out by the (single) US Attorney General. No other AGs are involved.
      2) Prosecutors are part of the executive branch. They have no control over the "court system," which falls under the judicial branch.
      3) The exercise of prosecutorial "discretion" has been "policy driven" since its inception.
