The defense explains why. What probably happened was she took his gun from his night stand probably fearing he might shoot her because she was going to tell him she was leaving. She did that when he went into the kitchen to get a drink. They argued and he wrestled the gun away from her. She most likely never pointed the gun at him but he got mad she took it.

A person in a struggle over a weapon will keep their arms close to themselves. It's a self-preservation move which the body acts independent of external factors. - For him to "Sneak" around TO HER SIDE OF THE BED to pick up her phone, WITHOUT HER NOTICING (cause there's no way she fell asleep in 1 minute--and WHY would he EVEN THINK that he could secretly take a phone to someone who HAS NOT had enough time to even begin to nod off)
- He walks into the closet to start looking thru it
- For some reason, she gets up, (doesn't say "hey, where are you going with my phone" --- and since it's so DARK, doesn't even know he took it, but is now mad enough about him "taking the phone" that she decides to get his gun?) walks around to his side of the bed to get his gun

- Shoots her once in the chest--oops I mean, SHE pulled the trigger

Nah. I think he’s guilty.
Prayers to her family and friends. Pray for healing. The higher power see all things. May her soul rest in peace.
He's a COP. What did u expect??? This dude is TOTALLY GUILTY. But it the police dept-- and the sh*t they cover up is unfathomable. Hope her spirit HAUNTS him to the end. God comfort her daughter, cousin, sister and the rest family and friends. So sad
Patricia had a BEAUTIFUL 😍 smile.
The people on his jury should never serve again. Spivey is 100% guilty.
Watching from Nigeria
Why is he not in prison?
Because he was found not guilty, that's why!
Jury failed
@@AHamp123 that's your opinion, but you weren't on that jury now was you?
34:24 ok, let’s IMAGINE his story is true- he is at fault for being a police officer and having a dangerous gun (if it’s faulty and so easy to fire on accident).

A Thursday episode? 😊 Nice 👍
Proficiency in English grammar not required to become a police officer in the U.S.
nope
They aren’t the grammar police like you.
A person in a struggle over a weapon will keep their arms close to themselves. It's a self-preservation move which the body acts independent of external factors.
They alleged her arm was raised above her head as she was shot. He shot her in the arm as he twisted the gun away from her. Then shot her again to put her down.
If she went into the closet with a gun, then it's likely he was threatening to harm her. What was on the phone? If we knew, it could had been his reason for the altercation.
No justice for her. I hope he is reading these comments. Killer is free
What was she hiding on the phone? It was mentioned multiple times and they never followed up on it.
That’s his version….excuse!
@@DVelez-wz3fe If there was nothing on the phone, that would be a win for the prosecution. Very strange that it was mentioned multiple times in this video, then dropped before revealing what was on the phone.
THAT WAS HIS STORY!! He just shot her because he didn't want a divorce which would have given her the house or other property.
Listening to a killer remember his victim. Just warms my heart. Feel so bad for him.
