      @@towingislife6619 I believe the video answers your question. I was a ski patroller in Colorado for 15 years, responded to hundreds of collisions mostly between OOC boarders hitting skiers although the opposite was also true. That's why tighter slope restrictions popped up in the industry in the 90's and actual skiing police were utilized at certain ski areas for a number of years. The worse cases were those of OOC boarders and children skiers with one fatality as a result that I responded to. Think about that. Take your daughter skiing and watch her be killed while you are skiing with her. Luckily the boarder was found and arrested because the distraught father was able to id the bastard who boarded away with a smirk on his face after hitting the kid. This was an extreme case yes but as I stated, skier/boarder collisions were rampant and OOC for a good while in the 90's and 00's. God knows what's happening since I retired a few years ago. Oh wait, the video answers that question too.

      He just has the wrong timing and lost control when he realized he mistimed the moment the skier will make his turn back to the right. High speed + poor control and technique + misjudgement = accident. Totally the boarders fault.

      @@patriot2372 it’s easier to slow down on a snowboard than skis, you just do a hard turn on your heel edge. Those that don’t know how to carve to maintain the right speed or preform a hard stop on a dime aren’t even worthy of being considered novice snowboarders. As someone that has rode both snowboarding is far easier to control once you’re not a beginner than skiing. Skiers tend to be Jerrys or slowly zig-zagg the trails anyway

    this guy should not be riding anywhere near that fast if he can't avoid someone that's in sight as clear as day. this isn't about whether you're a skier or snowboarder, this is about being on the mountains and riding without control. this guy needs to know his limits and based off of this he is way out of his league to be going at such speeds

      I disagree I think yes, it was the snowboarders fault, however it’s extremely difficult to pass someone on a narrow path when they are turning from side to side blocking the way

      It’s also up to the downhill not to cross into uphill riders line without looking up. Same as if you must always look uphill when starting down the trail. The snow boarder was trying to go around and the skier cut him off.

And the boarder came from an adjoining trail, and was quite a distance behind him in the video and coming fast (and out of control). You will NOT find in any known responsibility code any language about not crossing into the uphill skiers line and having to look up. The only obligation to look up is when starting out on a trail or when entering a trail. SO, that doesn’t apply to the skier here. You don’t get to make up your own rules !!!!
      You need to read the responsibility code because it’s reckless people like you who cause accidents.
      For your education, rule #1 states “Always stay in control. You must be able to stop or avoid people or objects.”
      Clearly, the boarder was out of control and couldn’t stop in time.
      And that’s the ONLY rule that applies here.
      PERIOD !!!!

      @@heitorcorneliusYou’re correct that was not the case here. You need to look uphill when starting out or entering a trail. Other than that the entire responsibility falls on the uphill skier/boarder to be able to stop in time and avoid objects and people below him or her.

      The skier was turning like a normal person on slope.

      Skier obviously never had the wind knocked out of him with all that whining. Furthermore both parties are at fault, skier should’ve checked before making such long turns; especially on a narrow pass and snowboarder should’ve noticed the skier was a novice and the run was narrow.

    Not about being a skier or snowboarder, one of the first things you learn is that you're responsible for the people in front of you because they can't see you . You have to make sure they won't move into your way and you have to make sure you're going at a controllable speed if you're coming from behind.

      @@yosour6733 thats not at all how it works. As the up hill person, it is YOUR responsibility to avoid downhill traffic, no matter how slow they are or how wide their turns are. If you can't control yourself at speed, know when speed is ok or avoid an obstruction, maybe find another activity that you won't kill someone doing.

    This happened to me decades ago by a fellow skier. I was standing at the top of a hill and skier flew out of the tree from above me and his ski landed between my binding and my leg causing me to immediately be knocked over full force into ice dislocating my shoulder. When you are not expecting the collision from behind the body is simply not ready for the impact and the pain coupled with the breath knocked out of you is immense. All the skier said was "sorry dude. You OK?" No, I'm not F%*!king OK! In this video the boarder had lots of time to avoid this collision. It's not a boarder issue but a negligence issue.

      Coming to a stop in the middle of a run is negligent. If you are going to stop on a run you stop on the side of it. You face up the hill watching for incoming skiers/snowboarders. When travelling/carving extremely slowly you don’t take up the whole run. I would have avoided this guy. But don’t act like this skier is without fault. The skier should be wearing a helmet too….

    lets not make this an argument between snowboarders and skiers, it doesn't matter which you do as long as your out there having fun. Now, I ski and board and in my opinion this is the fault of the snowboarder. Downhill always has right of way, the reason, well none of us have eyes in the backs of our head and we should be looking downhill. If the skier is taking a wide line (which is fine) then the snowboarder needs to slowdown until he can find a safe time and path to pass the skier, the skier has done absolutely nothing wrong here. I would add that the only time in my opinion uphill has right of way, is when the person downhill is stationary, in which instance they should check and wait for a safe time before moving off. People who have commented blaming the skier need to seriously think about the safety of others before hitting the slopes again. What might have been the outcome if the skier was a child??????

    I don’t care who was responsible for the crash and don’t want to blame anyone. It’s just that I find it quite rude(to say the least) not to check up on the snowboarder who’s lying on the ground and not giving any signs of being conscious. And second thing…why was the skier not wearing a helmet..? Most of the times you need one because of situations just like this one.
    FYI: I worked in a ski resort long enough to see and experience many crashes, mishaps and other stupidity that could(mostly)be completely avoided following the right approach to the winter sport(doesn’t rrally matter weather on skis, snowbords, ski bobs, bikes or wathever else you may use to bomb down the slopes)

In regards to the first part of your comment, that woman could've been experiencing mild shock, so maybe don't be so hard on her. Not everyone thinks logically in emergency situations, especially right after the incident. Plus, she may have given the guy muff to mouth resuscitation after the camera went off.

      The ski resorts do post signs about the skier code. I think they should be more vocal day to day to people as they get on the chairs. Some dumbass people might not even read or get the code.

      @@Ghost-hf2xg If I were confronted with a medical emergency where I had to choose between helping a friend with unknown injuries and the person who hit him, I'd prioritize the friend every time. I'd be legally and morally obligated not to harm the unconscious boarder and to help him if expedient, but little else (and it would be more consideration than he'd shown the skier).
      I would actually not make physical contact with the boarder. He's unconscious with a possible neck injury and I'd be very mad at him. Nothing good could come from that. Better to flag down some help or (if friend can be calmed down and told to sit down) ski really fast to the nearest lift and inform ski patrol of the accident.

      This has nothing to do with being a skier or snowboarder. A friend of mine got hit by a skier last week on a trail just like this, fell over and broke her wrist and the guy didn't even stop. So in this video it's a snowboarder but it's not like skiers never do this.
      Guy was totally out of control and should not be going at that speed if he can't control it, easy as that

      Indeed. Slow zone flags are meaningless if patrols do not enforce them. A good example is in Solitude near the Powderhorn lift. Skiers and boarders go away too fast in the slow zone area and I haven't ever seen a patrol there even I skied 39 days in Solitude this season.

      @@ST19859 ​ Riders and skiers in front always have the right of way. Always. There is no "cutting in front" of someone. It is always a speed or space issue if you hit someone who turned in front of you.
      Also, that skier's form would not suggest novice. Notice nice skidded turns, skies near touching, etc. This was not a novice by any means. Maybe not advanced or expert, but unlikely to be a novice.

    I made a noise similar briefly following a bike accident. I was able to calm down and identify that I wasn’t so much making that noise as was the air coming out from my punctured lung! That looked like a very hard hit.

    Your responsibility code for all skiers/snowboarders:
    1. Always ski in control. You must be able to stop or avoid people and objects.
    2. People ahead of you have the right-of- way. You must avoid them.
    The Snowboarder violated the first two rules of the responsibility code. The skier was not starting out or entering a trail and was under no obligation to look behind him for approaching skiers or snowboarders.
    Many people are making up rules that don’t exist in any known responsibility code. In any case, you can expect to find the two above rules as coming first in any known responsibility code for skiing/snowboarding.

    Please! if you go skiing or riding; KNOW YOUR LIMITS. I have been skiing for two decades and snowboarding for almost that long as well, I see stupid novices do shit like this almost every time I go (doesn't usually end up this bad, but sometimes can be far worse). Respect the limits of your abilities on the mountain, and if you choose to push them, only do so on open terrain that you are extremely comfortable riding on... If you don't you might be sending someone to the hospital, and you're lucky if that someone is you.

    Person downhill is allowed to aimlessly wander in any direction with their eyes closed and headphones on, still legally the fault of the person coming from higher up hill.
    People online or on the hill can claim what should have been done is obviously, but when you pass by thousands of people a day 100-170 days a year, year after year you eventually come close or to a situation like this. Even if you accurately guess 99.999% of the time if the person in front is going to either keep going or abruptly turn a random direction, full time boarders and skiers pass by that many people in a year easy. All it takes is one bad guess one of the times you're not doing a school zone speed.
    Where I'm from if a pedestrian gets hit crossing a highway it's the vehicles fault. At the same time if the pedestrian values their life or health they should look before they step foot on the highway and they should continually check if something new is coming. They definitely shouldn't be running around on the highway in random directions without looking.
    When I'm on the hill I'm constantly checking for faster traffic coming up behind me, especially if I'm about to do an abrupt turn.

    Had the same thing happen to me in Snowshoe, WV on a slope called Widowmaker...the snowboarder hit me from behind...never saw him or heard him...he was about 14 years old and should not have been on that black diamond slope. Put a dent in my helmet...knocked me out momentarily. I ended up with a compound fracture of my thumb where the edge of his snowboard hit me...also bent one of my ski poles 90 degrees...his dad had the nerve to yell at me like it was my fault...while I was bleeding all over the snow...then when his son realized he had a broken arm...which was bent like an L shaped pretzel...dad said, "your arm is fine..." lol... Ski patrol showed up and gave me the father's information in case I wanted to talk to a lawyer...I didn't...hope they learned something from that...

    What scares me the most are the comments.
    I've been skiing for 57yrs and riding for 25yrs, and in this case, the skier is 100% innocent, and the rider is 100% at fault. The skier is not taking up the whole slope, he's making regular-sized and reasonable turns on the right 2/3rds of the groomed area. He's crying because he was completely blindsided, and probably has broken ribs if not worse.
    The rider is going way too fast, and makes a bad/stupid decision to pass on the right, seems to have 2nd thoughts (watch it in slo-mo) and catches his edge and clouts the skier. He, at least, has time to prep for the collision. Just an odd decision to go to the right. He passes the camera person on the left, and she's behind the downhill skier, so why the boarder decides to pass the skier on the right is just and odd and a bad choice. He should have stayed completely to the left where there was tons of room.
    Of course, he's just laying there thinking about his future. He's likely fine, because he had time to prep for the collision, unlike the skier.
    The comments about the boarder being more injured, and the skier taking up the whole slope are just crazy, when the video evidence is right there. Makes you wonder about people's skill level and makes me even more concerned about safety on the slopes. I've gotten 51 days in this year, and I wear a padded backpack, which would help in a blindside hit from behind. It's crazy out there even when there's no one on the slopes!

    I got hit from behind by an Aussie snowboarder at Lake Louise, years back. I appeared to be alone on the trail,( it really was pretty empty),and the next thing I saw was a beautiful blue ski. I didn’t even hear him so I didn’t tense up. That’s what saved me from any injury( I was 50 when it happened). He screamed” are you okay”? I assured him I was but pleaded with him to slow down(because I knew he didn’t have the skills). He was mortified, the poor kid.

      You shouldn't. If you're looking behind you then you're increasing the likelihood of you causing an accident, something I've seen happen many times. The only time you should look uphill is if you're crossing the slope. If everyone just avoided everyone who's below them, which is easy if you're riding within your ability, then there would never be any accidents.

      You can go whatever speed you want. Every skier should practice maneuvering at different speeds. It's not about going as fast as possible if you're out there to learn a new trail or get a feel for some new equipment.

      andre tarp -Listen moron--I started skiing in 1980. I once skied too fast into a trail merge--Ski Patrol stopped me and pointed out the danger. I have never repeated that. I switched over to Snowboarding 4 years ago and was crashed into by an out of control rider--I lost 4 weeks of work. I ride according to the code and am constantly on the look out for jackasses like the guy in this video. Riding is a blast but carelessness and cavalier attitudes can ruin a day and could cost someone thier way of life. All I am saying, think beyond yourself and the moment. Read the code and follow it.

      Check Colorado & Utah law:
      Skiing is not a contact sport and being blindsided by another skier or snowboarder is NOT an inherent risk under either Colorado or Utah law. Colorado law presumes that the uphill skier or boarder is at fault in a skiing accident, because the overtaking skier has the primary duty to avoid the skier below. In Utah, skiers are required to exercise “reasonable care” to avoid collisions. Usually, this also means the uphill skier must yield to skiers below.
      Thus, one of the key issues in any skier/skier case is who was the uphill or overtaking skier. The nature of the injury often gives substantial clues as to how the ski accident occurred, the speed at which the skiers were skiing, and the relative angles to each other.
      All skiers are under a general duty to ski cautiously, within their ability and to maintain control and a proper lookout. If a skier fails to ski in control or to maintain a lookout, the skier is negligent and responsible for the injuries and damages that result from the collision.

      Skier was taking up the lane snowboarder was trying to slow down but he couldn't predict where the skier was going because the skier was curving to wide. It's definitely the snowboarders fault but the skier shouldn't be curving that wide

    The snowboarder had the responsibility to divert to the ungroomed snow off of the trail for safety, or to plot his route in relation with others properly. He failed at both.

    Actually, after making a pause, you have to look up the slope to see if somebody is coming before entering the slope. They should have let the snowboarder pass.
    You can blame the snowboarder for Not having control at that speed but when your not riding, you should give space to those riding, especially in such a narrow slope. Those two sikers were just entering unexpected and in the wrong moment.
    Those are quite common rules. At least here in Switzerland.

    same thing happened to me when I was snowboarding, only I was in front and the Skier plowed into me like a missle, he was out cold! If you are riding you only need to pay attention to who is in front of you I should'nt have to turn around and watch my back.

    Speaking as a snowboader myself....the snowboarder in the vid was completely at fault in the collision. That boarder got no control, going at speed that was way beyond their skill....just so much stupidity

      He did have control, what happened was he went to turn right as the skier was going left, right when the boarder went right the skier turned right. The snowboarder then tries to stop but catches his edge causing him to go into the skier.

If you're putting yourself in a situation on an easier trail like this where you have to guess what the other person is going to do in order to not run into them, you're probably doing something very wrong.

    Some people don't seem to understand the "yield to downhill" rule, but it works the same way as cars. If you run into someone/something from behind, it's always your fault. It doesn't matter how they got there or what they were doing. The sole exception might be that guy that wandered onto a closed race course, if you've seen that video. Blaming the downhill person is equivalent to blaming the tree if you happen to hit one of those.

    This is 100% on the boarder. In this case the snowboarder was clearly not in control. If you “know the code” it’s your responsibility to be in control and avoid downhill riders and objects. Silly, also. There was plenty of terrain open to choose, if he was a better rider, and had been in control. I’ve been snowboarding for 20+ years and have also been an instructor btw.

      EXCEPT for the fact that the skier using almost the full width of the run is a bit of an issue. If you're on a narrow run and using 70-80% of it, you're making it hard-er up hill to avoid you. Yes you can slow down, but there's a bilateral aspect to this to at least make it easier for people to avoid you. Skier isn't completely off the hook on this one.

      @@MattsBaseballWorld I understand the perils of trying to make an argument in youtube comments. Please understand also that this is not a boarder vs. skier thing for me. However, as a PSAI-AASI certified instructor, it's my job to make people aware of the rules. The rule (that could cause you to lose your pass, or even put you in legal liability for the injury of others) is:
      *"It is your responsibility to ski/ride in control, and avoid downhill skiers and riders." * Full stop.
      The only other rule in the responsibility code that puts ANY liability on a downhill rider is that "one should not stop where they cannot be seen from above." If the uphill rider or skier can SEE you, it's 100% their responsibility to avoid you.
      Downhill skiers and riders may be doing stupid things! This includes taking up the whole "run", or even sitting down in the middle of the slope. You have to slow down enough to control yourself and pass them cleanly with at least 10' of space. If ski patrol had witnessed this collision, they would have pulled the boarder's pass, and both parties would have exchanged information as in an auto accident for insurance purposes. The analogy of being rear-ended in a car applies to skiing as well. 99% of liability is automatically assigned to the person behind. While it's technically "nice" and "good form" to allow people to pass, it's not the rule. Skiers and riders need to know this, and behave accordingly.
      All of that said, this was not a narrow run! (An example of a narrow run is when you have a cliff on one side and a high wall of snow on the other.) All of the WHITE STUFF in the video is perfectly ridable terrain. AVOID. CHOOSE ANOTHER LINE. GO AROUND. If the boarder insisted on staying on a single width of cat track groomer, he should not have been going that fast for his skill level. The whole of the terrain in the video is perfectly ridable. That boarder could have used any of the snow around to avoid the skier. That's why I said it was "silly". The boarder was riding above his ability and caused a needless collision, and possible permanent injury.

      There's just a difference between right & hurt, and adapting & safe.
      The skier is completely right to be able to ski wherever he wants, yet, the result is he's crying like a 5yr old.
      A smarter skier, would realize space is limited, with respect to novice/int skiers. Advanced skiers/boarders, no problem, they'll go up on the right or have fun on the left of this run. This snow boarder couldn't do that... such that idiot met up with the skills gap.

    Looks like the snowboarder was expecting the skier to keep going to the left and they attempted to avoid by going right. The immediate change in direction with the skier threw him off guard, snowboarder looks as if tried to stop but looked down behind, caught their heel edge and went flying into the skier. They should have stayed high on the left and passed (even at speed) without incident. Guess no outcome to what happened?

      @@dimis2140 if you step off a curb, in front of a bus when its descending a snowy hill, then you caused the accident. Same logic applies to cutting off an uphill skier. We are obligated to look uphill and yield to people above us. That is the specific rule when starting downhill.
      The Alpine Respondibility Code specifies exactly this. I quoted it above. People are allowed to ski and ride fast. Thst's why some of us go. No one can't stop on a dime, just like that bus on the hill. Accidents happen when people misunderstand the rules... like when people refuse or neglect to yield the right of way when they are required to.

      @@dimis2140 In normal cicumstances, you're right. If everyone was on course from the top, without stopping, you'd be right.
      But the fact that these people were stopped and pulled to the side gave them an obligation to look uphill and yield to the rider uphill of them before dropping back into the narrow, bottlenecking piste.
      Google this image: Alpine Responsibility Code. #4 clearly states "Before starting downhill or merging onto a run, look uphill and yield to others". I'm not making it up. 40+years on the slopes. 31 years riding. I know the rules.
      The bottom line is that this accident doesn't happen if the skiers properly observe this rule and yield the slope to the rider who was on course, above them.

    Obviously snowboarder ultimately at fault because of speed and has the ability to foresee what is below. But, (just a question) is it reasonable for a skiier to do S-turns going side to side across the entire downhill path as if nobody will want to pass at even a slightly faster rate? On a busy slope, does everyone uphill have to hold up their run so the slower downhill skiier can use the entirety of the run without leaving room for others to pass? I don't know the answer.

    This happened to me when I was 11 years old. I was minding my own business night skiing with my dad on blues squares and a snowboarder hit me and put me in the hospital with a concussion and two contusions.

    That man can really whoop. That said, skiers can be very tricky to predict. He was in the middle of the run and looked as though he was going left then he swooped right just as the boarder pivoted right. I've seen this happen on the hill many times. Had a skier do this to me at high speed (I was on a board) but I was the one down hill.

      The skiiers were stopped on the skiers right of a narrow patch of groomed. Then they both merged together, and proceded directly across the trail to the far skiiers left. They essentially obstructed the entire trail, two skiiers, making erratic direction changes, instead of proceding directly straight on fall line of the cat-track. Because of the erratic, entitled nature of their lines, the snowboarder had no clear safe lane... they blocked them all. He tried desperately to shoot the gap between them, but the skiier turned back into his path at the moment of impact.
      You'd have to be an idiot with zero experience on the moubtain to think that 100% of the blame for this accident falls on the rider. He did his absolute best, and was f*cked over by a couple of entitled jerks who wanted to schuss down a narrow track and occupy it all.

      -They started downhill without looking uphill, as the responsibility code obligates them to do.
      -Because they did not look uphill before starting downhill, they were unaware of the rider who was already on course at speed, and so did not yield right-of-way to the rider as the responsibility code obligates them to do.
      Pretty cut and dried. If they had never stopped, it would have been the riders fault, and his responsibility to avoid skiers below him already underway. But because they stopped, they assumed a responsibility to not start downhill into someone's path who was already underway. They did not observe that responsibility and as a result they caused a collision. End of story.

    My lady got smoked by a boarder from behind this past spring. The guy asked her if she was ok and ghosted before she could even answer. The edge of his board got her on the forehead. Luckily she was wearing a helmet. She’d be scalped or dead. Her arm is still messed up. People can be pretty shitty

      Skier was taking up the hole track snowboarder tried to doge the skier but because he was taking up the hole track skier went into the snowboarder

    1st mistake being stopped on that narrow ass trail. Saw the boarder and tried to beat him to the spot. Maybe look up hill before unneeded S turns or be courteous let someone else pass

      @@smiler0charon Person downhill has the right away in a straight situation, but when your zig zagging it's proper hill etiquette to keep either the whole left lane open or the whole right lane open for passing, you can clearly see the boarder thought the right was open to pass, then the skier cut across both lanes. Not only is this the skiers fault for hogging the road but he would be kicked off the big hill where I'm from for not having proper etiquette because the big hill is ment for speed so if your going slow then keep an open lane at all times 🤷‍♂️

    Why is this a skier vs boarder discussion? One person was downhill of the other doing safe controlled turns - the other was "travelling" fast and clearly unable to give way to the downhill person = bad accident - no question the person uphill was in the wrong - as someone with EMT training it seems as tho the result was a bad case of having the wind knocked out of him but hopefully (luckily??) it wasn't much much worse.

      Your analysis is exactly right concerning fault. I am the man in the red coat, and had the wind knocked out of me. My then 8 year old son is who recorded the collision with his helmet mount GoPro. My injuries were two broken transverse process in my back. Recovery took a few months, with the help of physical therapy.

      I was knocked out before and actually, the noises that came out were involuntary. It took me a while to realize what I was hearing came from me and to stop it.
