      That specific k1 case was received USCIS on 12/31/2018 and visa approved at Manila on 12/19/2019. Note: this was all pre-pandemic.

      They are processing spouse visa cases first. Most likely as more and more vaccinations are available, the consulate will resume business as usual and process all cases, on a first come first served basis.

      Covid has held up interviews at consulates and has delayed ongoing cases. Currently I am expecting a big surge of new applications to be received by USCIS between April and October. So I also anticipate that cases submitted by April may take about 9-12 months for K1, and 14 to 18 for Spouse. Cases submitted after the surge might expect a further 6 months delay to be added to processing time.

    I have this question :Once the visa has been granted to travel on a CR1 petition and the foreign spouse land in the US, he /she will have to wait for up to three months to obtain the green card and he/she can not leave the US before the green card is issued?

      Best practice is to wait until the green card is issued. However, the visa itself serves as a temporary green card, so in theory your spouse could immediately leave the USA.

      You can apply for tourist visa. Typically they are not available for purposes of meeting someone you want to marry and live with.       There is currently a ban on visa issuance to Nigerians so yes, this has caused difficulties. My clients are still getting their visas, but only after delays due to the extra time it takes for consular staff to agree to use their discretion to approve spouse and fiance visas despite the ban.

    Hi there, I have a question about the k1 visa. My fiance's country was a ban from the USA, do you have any suggestions or advice for me on how can I bring my fiance to the USA.

      What happens is that the consular officers can use their discretion to waive the ban in the cases of immediate relatives of US citizens. So that means if the consular officer feels your fiance visa case is bona fide, he can also recommend that it be issued regardless of the ban. I have helped many couples from "banned" countries get their visas. So assuming you meet the eligibility requirements you should move forward to apply. In addition to what is currently happening, as I expect President Elect Biden to work to un-do many of President Trumps policies, I also expect that most or all bans will be lifted soon. So either way, with ban, or without ban if you are eligible to apply you should proceed regardless.

      Depends. If you won lottery and had DV lottery interview and were denied, then that reason for denial might haunt you. If you just did not "win" the lotter then should have no effect.

    Hi, very useful! Am I understanding correctly that if the US citizen lives abroad together with their spouse, the US citizen has to move back to the US in order to have a US domicile and be able to sponsor the CR1 for the foreign spouse? This would imply that during the whole CR1 process, the couple will have to live in different countries even tho they are married, correct? Thank you

      I lived outside the USA myself for about 20 years, and I understand exactly what that is like. One of the services I offer is to help expat couples exactly in your position. Good news is the two of you can remain, together for the entire process, then both relocated together to the USA. What I help the American prove is his/her "intent" to relocate to USA, and to resume domicile there. So far all of my expat couples have gotten their visas without separation.

      Sorry, I don't know if there is any benefit from filing online. All my cases we submit hard copy and with PLENTY of unsolicited evidence of bona fides, and so far that has worked out great for my clients.

      There is no requirement to meet recently, like with a fiance visa, but you must meet in person at the wedding, or afterwards.       Whenever you start, the current backlog is ahead of you. I expect that applying for K1 in the near future will take about a year, applying for spouse visa in the near future about 1 and 1/2 to 2 years

      You can apply for visitor visa at any time. The more obvious that you have "immigrant intent" the less likely the visitor visa will be granted.

      Correct, It means that starting in March 2022 you were no longer eligible to apply. To become eligible again, get on the plane.

      To meet one of many simple eligibility requirements you must have met in-person within 2 years of applying for k1. To obtain approval you must also meet the complicated requirement of demonstrating a bona fide relationship. For proof of bona fides, how long you have know each other, the quality and duration of your relationship all matters VERY much indeed.

      If you have a visa you can use it, however each entry is at the discretion of the border crossing inspection officer. If he feels that you are a risk to overstay or anyway abuse the visa, he might deny entry.

      US immigration will accept a "web wedding". However they only accept it if there is proof that after the wedding, you and your spouse met in-person, before submitting the spouse visa application. Some of my couples are doing the "web wedding", followed by applying to the Phil embassy for a visa to enter the Philippines during the pandemic as a "spouse of a Philippines citizen", then traveling to Philippines during the quarantine, satisfying the "in person" meeting requirement, then applying for their spouse visa.

    Hi Fred, I want to go to my boyfriend country and marriage him and apply for a CR1 Visa.. but he was engaged with a lady and she applied for a k1 visa but there relationship do not work out and she cancelled the process at the embassy stage hope it won't affect when i apply for my husband after married?

      Having recently had another relationship also with an American Citizen or resident and seeking immigration to the USA is a red flag.       Each entry is at the discretion of the border inspecting officer. If he feels there is a chance your fiance or spouse might overstay he will refuse entry.

      USCIS says " it is delayed in initially processing payments and new cases due to a higher than normal influx of cases and social distancing in mail rooms". So my cases are recently taking about 8 weeks before payment is cashed and receipt is issued.

      If she wants to change her name to yours, then she should apply for a new passport. The spouse visa process takes about 18 to 24 months these days, and her passport is only needed about midway through, so you do not need to delay sending in your application, and afterwards she has plenty of time to get her passport.

    Hi! Great video! I'm from India and my SO is planning to file for k1 visa. I don't know if that's going to take less time than the other one. Plus, we didn't meet in person though because of the covid and some of my family restrictions. Can we file for a waiver for the meeting requirement?

      If your fiance can demonstrate a compelling reason why an in-person meeting is impossible or extreme hardship, then he could apply and include a waiver request. Likelihood of success for the waiver depends on how good the reason was. Likelihood of visa issuance, assuming the waiver was granted would depend on how good the evidence of a bona fide relationship is. And without having an in-person meeting and all the evidence that results from such a trip, you have greatly reduced your odds of success. When I work with my couples I first council them on what they should do, then how to document what they are doing, and finally I present their bona fides as an integral component of a VisaCoach "front loaded" application.

      @@Visacoach Thankyou for your reply! Well, our relationship is pure and we are in love and want to be together soon. I would suggest you to my partner, so that he could look into it. I don't know if the Indian embassy is taking k1 cases or not. Covid ruined everything. Him and I, are now planning to meet in person somewhere else, like you said without a meeting a waiver would have a less chance. I have to take a step anyway by going against my own religion stuff in order to make my relationship work with him cuz in the end I have to spend my life with him. We have been waiting for really a long time. Last year, due to the covid and still.. it is hard to meet in person. Do you think.. k1 would still going to take time? As, I have read many comments.. people have been waiting for year or more on it.. now it's biden's gov. here too!

      If she is lawful resident in France she can be processed and interviewed by the US consulate in Paris. When working with my clients to develop their application with high quality supporting evidence of a "bona fide" relationship, we go over an entire rainbow of what might be useful to include. Often if one "color" is missing we emphasize a different one. I also help each couple draft a letter to describe their courtship, relationship and plans for a future. This is used to put everything in perspective and to paint a sympathetic and understandable picture of the couple. Should there be issues or potential "red flags", we "get ahead" of those issues by explaining in the letter what happened and defuse potential misunderstandings by the reviewing officer.

      I expect a lot of cases to be submitted this year. I especially expect a large surge of cases between April and August. I expect that if you submit K1 application between now and April it may take 9 to 12 months, after April 12 to 18 months.

      Normally the interview is held 5 to 8 months after USCIS is finished with their reviews. However depending on the destination country and how the consulate's hours are affected by Covid, it could take much longer.

      It is possible to obtain waiver to the in-person requirement if your American bf has a valid reason for not traveling. Sorry, pandemic is not a reason that they accept. So probably means you will need to wait till travel restrictions are lifted. At that time he should hire me, so we can do most of the work on your application before he gets on the plane, then he and you can follow my guidance and checklists to do what is needed during his precious trip and we can submit your application immediately on his return to USA.

      Well, if you are married, your K1 is automatically invalid, and your only path is to apply for the CR1. And if you are not married yet, you can certainly change that by marrying, abandoning your K1 application (as you are no longer eligible) and then apply for a spouse visa.

      Unless your BF has a convincing reason such as a medical condition that makes it impossible to travel to meet you (not covid) then he will not be eligible to apply without first having an in-person meeting. If he is confused about this, that is a sure sign he should seek professional help and advice.

      Initial processing, review of documents is normally conducted by clerical staff. interviews conducted by consular officers.

      As you changed your name, you obtain police clearances in all names used, ie: maiden name and married name as well.

      If this was a spouse visa, and NVC has scheduled the interview, then you had already paid the interview fee at NVC, but forgot what you had done. If you are using professional help you should contact them to confirm and guide you forward.

      If your case was extended due to covid you probably can continue it. If your case was denied due to your abandoning it by not attending the interview, then it is dead, and you need to reapply.

      You demonstrate that you "get what you pay for". Rapid visa's business model is to let you do all the work and then they "print the forms" for you. For advice, personal guidance and support this is where you get VALUE by hiring VisaCoach. Sorry, I do not know your case, sorry but your description has been vague. I answered, If "A" is the case, then this is the answer, and if "B" is the case then here is a different answer. Whether they accepted your excuse and continued your case, or did not and denied your case, only you or the consulate know the answer. And if you currently don't know, then ask the consulate. They surely will tell you if your case is denied, or still pending.

      As a follow up to your previous question about having a material age difference, "not sharing a common language" is another red flag that will cause suspicion. And to be successful needs to be overcome. The question is far more complicated than "fiance or spouse visa?

    Hi Fred, my fiancé and I have been together 9 years. He left for Florida nov 2019 due to family commitments (Mothers health) he has a green card. I am a British citizen born UK. We had not planned for us to live together in usa I only work term time (off during all the school holidays so planned to visit 3/4 times a year) as I have a career here and 2 Daughters aged 21 and 15 (not his children) but then covid happened and as we are not married I had no rights to go to the States during the uk travel ban. We now want to be married and make the move to usa (not wanting to be apart again) for obvious reasons. What is the best option for us? We planned to be married this summer.

      Marry apply for spouse visa. The US resident becomes US citizen during the spouse visa process in order to speed it up. Note: if he becomes a US citizen the spouse visa process takes about 14 to 20 months, if remains only a lawful resident thej process takes about 4 to 8 years.

    Hi Fred, I want to bring my fiancée by spousal visa after I got married. But based on one of my friend’s experience , wedding in Church by Pastor is invalid which means marriage certificate signed by Pastor is not eligible . U .S Embassy do not accept that.
    So if that is true, where should I get my marriage certificate after I got married in Church for approval .??

    Note : My fiancée is from Burma ( Myanmar ) and crisis in Burma has been getting worse from February 2021 and escalating day by day and I am worried about my fiancée but it’s so much risky to go to Burma and get married.

      You contact the authorities in the country where you plan to marry and ask what the procedures are to become lawfully married. If using a local officiant it would be shocking that he or she does not already know and can not clearly advise you (and follow) what the local procedures are.

    We applied for our fiancee visa back in March 2019. My fiancee is from the Philippines. We received our receipt a month later. The last letter I got was in July of that year saying our case had been Sent to one of the processing places. Can you give me an idea of how much long we'll have to wait? This has gotten so frustrating. If there's any hope you can give I would greatly appreciate it.

      Sounds like your case has been in process at USCIS for 21 months ? when normally USCIS takes only 9 months. I have no idea why it has taken so long, do not know your situation, and have no way to forecast how much longer, etc. I suggest you ask this question of USCIS directly, or hire an attorney.

      @@Visacoach I figured it was taking so long because of covid. I have an attorney but he hasn't been much help except for filing the paperwork. I'm wondering if I would be better off hiring you to take over my case.

      Sorry, while having me "take over your case" generally is a good idea, if it is only for the purpose of chasing USCIS, sorry that is out of what I am allowed to do as an immigration consultant, and not an attorney. Besides offering legal advice, what an attorney can do, that I can not, is "represent" you. Ask yours to earn his keep by reaching out to USCIS in his capacity as an attorney, and as your representative, to demand action. Having said that, while an attorney CAN do this (while I can not), they rarely are willing to do so as they don't find personal profit in it. Find an attorney who will do what you actually are paying an attorney so much extra $ to actually do.

    Hello Fred, I have a question if you able to answer it. Will I have to refile a new petition after the 2 year meeting requirement is up? I visited my fiancee in the Philippines back in July of 2019 and because of the epidemic I haven't been able to go back. My 2 year requirement is up in July of 2021. Will I have to do a new petition or will the us embassy in the philippines waive this issue? I hope you can answer this.

      The two year rule applies for the day your application was received. If you met the requirement when submitting, then you do not need to worry about it 'ageing' out.

    Hello , Mister Fred my faince and I are concerned about from where to get my court records for the visa interview because i have been living in a city in Morocco for 5 years because of my studies but my ID is still have the address where i was born , and i went to get my court records from this city i live in now they told me that I need to get it from where I was born so iam trying to do that , and my fiance is concerned if that will be an issue or would cause my visa to be denialed. Because in the email it says you need to have court records from where I live and it doesnot work like it in Morocco.
    Please reply me as soon as possible because i have been aproved by the USCIS last month and i have no time left till the interview

      Get the court records and police clearances from everywhere they are available and relevant.

    Hi sir im from philippines, when embassy manila resumed for fiance visa..? Because our case pending since march 2020, but our case is ready since june 15,2020. They accepted for interview only expedited.

      The consulate is partially open, it reaches out to individual cases, invites them to interview etc. Your case will be processed after the cases that were ready March to May, and will be before those ready from July till now.

      I have helped couples with larger age differences get their visas. However your situation requires EXTRA effort to overcome your red flags and to convince the reviewing officers that your relationship is bona fide, not a sham for immigration benefits.

    we only shared 12 days together 8 with the family and 4 alone, We had such an amazing time traveling to different beaches, the family wedding the traditions eating down as a family nonstop food, what an amazing beautiful family.       Sounds like you had a fun trip. If your question is "is my being 14 years older to a person I want to sponsor for fiance or spouse visa immigration to the USA a red flag?" then the answer is yes. US immigration will consider this an element that causes suspicion. To over such suspicion you need to convince US immigration by your actions, and proofs of your actions that there is no fraud, that your relationship overcomes such red flags. That is a major component of the work I do with couples, I help them present their individual story of having a bona fide relationship.

    Hello Fred wahl, I'm from Saudi Arabia my visa has been refused last year 13jan was my interview and after 11 months USIC usa nbc they mailed my husband to send more evidence within 30 days, we did and they update on their website that they received they start work in it, but 14 jan the Saudi usa nbc they sent email that my visa canceled and we didn't sent any evidence i just want to know is this email from system automatically because it's been one year or it's true?
    Should we call the NVC or just wait? Please help me

    I may be interested in hiring you if you can tell me the cost and a question that I have I have been married to a Filipina for 15 years when I married her she had a daughter one year old and now the doctor is my step daughter and she is 16 years old my question is if I file for my wife a spouse visa will my stepdaughter which is still a minor be included in the spouse visa or do I need to fill out a separate application for my stepdaughter that is 16 years old I would like to know that question that way I know what the financial would be if I hire you to do the paperwork for me and what the total cost is because I've heard separate things one says that I only need to fill out the spouse visa and my stepdaughter would already be included in that because she's a minor and all my stepdaughter would have to do let's go to the medical along with my wife and go to the embassy with my wife and she would be approved along with my wife so I want to know the financial cost if it's just one application or if they are going to be separate applications for my wife and a separate application for my stepdaughter if you can answer that I would be interested in hiring you

      Both spouse and child need their own visas, so there are two separate applications. Normally we prepare and submit both at the same time requesting US immigration to "keep them together" during the process, so that both attend the same interview, both are granted visas at the same time.       @@Visacoach thank you for your reply I need to ask a question before I go any further on the affidavit of support I would need to claim fourr dependents my wife is Filipino and I have a stepdaughter Filipino and then it's me American and our daughter is American and Filipino so I need the Visa for two people my wife and stepdaughter but I still would have to claim four dependence on the affidavit of support my question is I have social security income of 14, 180 plus I have a self-employment of $22, 320 my question is can I add my social security income along with my work income which would be 36, 500 can I combine those two and cups together or do I have to use what's on the adjusted gross income of my 1040 form only and also our daughter is 13 Filipino and American duel she gets social security of $7, 090 can I add her income with mine since it's a family member living at home because I'm confused if I can only report was on my 1040 form as far as self-employment income or can I combine the self-employment income with my social security income and even maybe my daughters social security income or do I need to find a co sponsors I need to know this before I can proceed thank you for any help you can give

    Hello Sir. I really need an advice please. I am confused if the address is really important when filling my papers in the CR1 visa. I have two addresses, the first one is my birthplace and the second one is my new address right now. The problem is, the district that stated in my marriage certificate is no longer covered by our district.
    For example: In my marriage certificate it's indicated it "Barangay Poblacion" but we are not longer covered by "Barangay Poblacion" they changed it in "Barangay Golden". I don't know sir if I should fix my marriage certificate or not. We don't want trouble when we will start filling for CR1 Visa. Please I need your help. Thank you!
