    My Filipina gf and I have known each other since 2018. We have met and been together 6 times since. Last was March 2022. We are getting married there in Oct. 2022. We are currently applying for our capacity certificate and cenuar. We plan to apply for a spouse visa immediately after. But the big hurdle is money. I own my home here in the US. But I am retired and on a limited income. What should we expect ?

    Hello sir , I only have a couple of questions.
    First , is there an annual income you have to make before they will approve a visa ?
    Second , how much are the total fees , including yours.
    Third , if a person had once got a felony on their record , would that affect the visa. The story is a long one but I’ll try to shorten it for understanding. I was hauling a load of tires in my truck , not knowing there was a limit on the number that could be hauled at one time. And also not knowing that it carried a criminal charge (felony charge). This happened in Ohio.
    These three things are the only things that worry me about trying to bring my wife to America. Been together almost ten years. Been married four years of that ten. I don’t want to spend out the money if one or more of these things would stop me from getting her here. Any information would be most appreciated. And if they aren’t an issue , I’m definitely calling for your services.

    Hello Fred, I known my filipina girlfriend since 2018. She left the US in 2020 when covid began. Its been harder to visit her cause of the pandemic and inflation these last 2-3 years. We been communicating everyday. We decided to patiently wait since its been harder to visit with all problems especially with the immigration we have in the US now. Right now she is doing au pair until may 2024. I plan on visiting her next year on doing a spouse visa to get married and start the process since fiancé visa gotten taken more time like spouse visa now. She has a social security card with restrictions. I was wondering if I can do a head start on spouse visa application before heading to the Philippines before marrying her? Just so it can be a faster process than waiting 9-12 months after marrying. The waiting has been frustrating cause of these unfortunate circumstances.

      The "head start" is by hiring me a few months BEFORE you plan to travel. That way we can get the logistics out of the way and arm you with detailed instructions and checklists to take on your trip to insure that you do what is needed, document it properly and bring back all that is useful to your case so we could submit your application without additional delay right after your return. You can not "submit" until you are actually married. You CAN start working early so that you can submit IMMEDIATELY once the wedding takes place.

    Hi Fred I got married in US and came back here in the Philippines because my visa got expired that time and planning to process my papers here in the Philippines. My case just got approved last week. My question is do I need to register our marriage here in the Philippines? And if not, is that a one reason for suspicion by the interviewer?

      A spouse being interviewed at Manila needs present a Cenomar that indicates she or he is married to the visa sponsor. Cenomar is only updated if the foreign marriage is registered. As far as what looks "suspicious" best is you speak with the consultant or attorney working with you.

      You should decide what name to use after marriage then use it consistently, including getting new passport as needed.

      If you don't know why your visa was denied, well you can apply for another one, tourist or k1. During that process if there is an onerous reason for the esta denial that applies to other visas, the information would come out during the course of processing.

    They are services now that will allow me to marry my Filipina gf of 4 years online without meeting in person. In that 4 years we have video chatted too many times to count and it's not an issue to marry her this way vs going to meet her in person for a week just to return and apply for a K1 & be forced to marry anyway within 30 days. We have had 4 years to make that choice already. My question is, once we do the online wedding, which is recognized as legal both here in the US and the Philippines, shouldn't I then be able to start the CR1 visa process to get her to the US without requiring me to waste time and money to visit there 7 days ? I'd much rather spend that money toward her CR1 and the wedding & I never wanted to get on a plane if I could avoid it lol. I also should add that I make 42K a year which should be plenty to support her till her green card process is done. Thanks

      Sorry to hear that traveling to meet your partner in person is "a waste of time and money". US immigration, views romance cases (K1 or CR1) with suspicion. You only overcome that suspicion with evidence of a bona fide relationship. They don't even consider your bona fides if you can't prove an in-person meeting. For a K1 your in-person meeting must take place within 2 years prior to applying. For a spouse visa, your in-person meeting must take place at the wedding or after, and only then can you apply.       The US Citizen or US Lawful resident is the one who submits the application. He/she can choose to submit online or via hardcopy. My philosophy is that it is critical to prove the foreign applicant is eligible by showing well chosen proof that the couple's relationship and plans are "bona fide". The best way to achieve this is by sending in a hardcopy package.

      If the child is the biological offspring of the American Citizen and was born while the American was a US citizen, then the child IS also a US citizen and can travel to USA anytime, with or without you.

      Depends. If you won lottery and had DV lottery interview and were denied, then that reason for denial might haunt you. If you just did not "win" the lotter then should have no effect.

    I’m looking for assistance specifically for case transfer request from a US Consulate in Naples, Italy to the US embassy in Manila. I recently filed the I-130 on behalf of my spouse through direct consular filing overseas since I’m in the military. It got approved and was told to contact the embassy in PH.       As you stated you will marry in December. There is no choice of visa, there is only the spouse visa. If being imminently deployed for overseas duty, you might be granted expedite. For stations in USA, you get in line with every one else.

Would that be ok to give a proof of our long distance relationship along with our current relationship to prove our bonafide relationship? Or would that not be a good idea to mention long distance relationship? Would it used against?

      Choosing which evidence to use to demonstrate a bona fide relationship is a bit complicated`and to do consistenly well needs skill and experience. When I work on a case I go through all the evidence and the full story, and then decide the best and most effective way to present the couple's bona fides. Sorry, no simple answer, without full understanding first.

      To be eligible for a Fiance visa the last meeting needs to have occured no longer than 2 years ago. Where you meet is not critical as long as you meet in-person. Having said that, a meeting that offers the opportunity to meet friends and family as couple offers more ways to demonstrate your relationship is bona fide.

      Anywhere vaccinations are administered. This sounds like a question based on lack of awareness of American life. You should ask your new spouse to answer such questions and help to orient you to living in a new country.

      You Filipino partner contacts the civil authorities in the town where she wants the marriage to be conducted, and ask them for detailed instructions. If that town's procedures are two complicated she goes a town over and rinse and repeat. Sorry it is the town that sets the rules.

    I just spoke with you and you said marrying my Filipina was a poor choice. I'm sure your wife would disagree when I tried to explain our situation and that I loved her you cut me off with an arrogant attitude. You said since I married her online that there is nothing I can do to bring her here. She is not a scam and we are legally married.

      The reason I could not continue speaking with you, after I had already taken 15 minutes from my clients cases, was that you simply were not paying attention. I never said there was anything wrong with marryijng a Filipina. I married one myself quite happily. What I said was, since you knew you were unable to travel to meet in person, instead of marrying online, you should have instead, applied for a fiance visa. To be able to apply for a spouse, you need to "consumate" the marriage in-person for US immigration to accept you as eligible to apply. If you had remained unmarried, you could have applied for a fiance visa, and when applying explain why you can't travel, and asked them to waiver the in-person requirement. I believe that would have gotten her here. Now you are stuck, not eligible to apply for a fiance visa as you are married, and no eligible to apply for a spouse visa as you are married but still have not met in person.

      Was listening however you interrupted before I could finish speaking and yes I know what you said. You should state upfront that you are not an attorney and are you licenced in any way to represent your" clients" what is the pass fail rate of your clients. You get paid for every case but when your clients loose your not out anything. You should gaurentee if they don't pass that you give them a full refund. Oh and I'm not getting paid for the free advice either.

      Once Covid backlogs are gone, should be around 18 to 20 months. While the backlogs are still being reduced, expect it to take longer.

      Sorry let me be a bit specific. Is it possible to bring a spouse from Yemen since there a ban was placed on them. Also there is no operating embassy there so how would that work? Would it take longer than normal cases?

      It is my understanding that the ban has been lifted. Yemini's are interviewed at Cairo. Probably will take as long as normal. About year and a half

    Hi visa coach . I am in uk overstayed my visa and my girlfriend is usa citizen and we been talking and chatting from last 2 years and we loves eachother truly and 2 weeks back she visited to London to meet me and she went back to usa and we decided to get married and live together forever . Well that short visit we have few photos together and hitel room booking on her nd my name too . Well being an overstayer in uk she can't file my application for Cr1 even though we get married for this i need to move my home land (Pakistan to get married there and then she can petition i130 as i am ready to leave uk soon and she is going to come down Pakistan for marriage so my Question is we meet already once and 2nd time in my home land we decided to get married for sake of love so us it enough to get married on 2nd meeting coz it's so expensive for her to travel 2nd time to uk and on 3rd meet we get married is it ok on 2nd meeting on my home land we legally do our ceremony?       There is never a simplistic answer to "which path is better". It all depends on your personal preferences. The fiance visa process is currently taking over 18 months, So if you want to "marry next year".       My opinion is USA is a great country to live and to raise kids. I have "my cake and eat it too". I brought my spouse from Hongkong with our oldest two kids (4 and 7 at that time) and have lived happily together in San Diego every since 1999. Best country, best place, best wife, best kids (now adults). I am super happy to be here with them. I would not have it any other way.
