Sir if a partition suit is pending and one of the defendant file a subsequent suit for the partition between same parties.and the plaintiff withdraw first suit at the stage of evidence from which stage now the subsequent suit will proceed.i mean from the very begning or from the evidence stage.

I got my my land ... in partioned suit
Kabza was given by court..
And seprate khatuni was made too in my name..
later my opponent went to..commisoner court...
Also their woman They are trying to do kabza in my land...
neither commisoner court has given any stay..
and the case is pending ..
so here my question is
can I go to civil court for..temporary injunction???
as the name of land is in my name..
kabza is given to me..by sdm court and local police..
