Than hamne us par counter claim file kia hai bcoz usne khud ne illegal construction kar rakha hai public road par extension kar rakha hai or service road par bhi that's why hamne counter claim lagaya h sahi kiya Sir hamne

Correct me if I have misinterpreted it, but by my understanding, when CC can be filed even after filing of WS then hum ye kaise keh sakte hain ki amount/relief in CC must be recoverable at the time of filing of WS. If there is no bar in the order to suggest that CC must be raised or pressed at the time of WS, then Aisa bhi to scenario ho sakta hai ki prativadi ka CC, uske WS file karne ke bahot baad mein jaakar recoverable banaa (but during pendency, giving enuf opportunity to plaintiff to defend against such delayed Cc) and then he might wish to file a CC. Wouldn't it be a weird situation. Anomaly.
To sum up, Statute kehti hai aap CC WS ke baad bhi der se file kar sakte hain. Provided it's so much in time that Plaintiff has opportunity to defend it. Lekin fir statute ye bhi stipulation lagati hai ki CC must be recoverable at time of WS

Supreme कोर्ट का एक judgement है उसमे कोर्ट ने एक judgement दिया है की अगर कोई बच्चे अपनी माँ बाप की ( बुधापेमें) सेवा नही करता है तो उन्हे ( यांनी माँ बाप को) अपनी बच्चों दिये हुये पैसे या प्रॉपर्टी वापस लेने का अधिकार है क्या आप इसके बारे मे CPC क्या है या फिर वो case हिस्टरी no क्या है उसके बारे मे एक विडिओ करके बता सकते हैं

Complainant ne kuch bhi nahi kiya uskee property ko dono side se divar k taraf se dhoda under aye he aur bhim columns bhi thik se nhi kiya he uska dekh k dusre ki himamt badhi vo bhi thoda side se purani divar badi thi usko khadedke aaya tha ..ispe hamara rights violet hua he ab kya kre ispe counter claim nhi ho skata. jab aapne legal set off or equitable set off ka difference bataya tha tb ek difference ye b tha ki legal set off me it is not necessary that claim must arise out of same transaction
Pr Abhi set off and counter claim k difference me ek point ye bataya hai ki set off must arise out of same transaction and counter claim need not arise out of same transaction
