Earlier this year Twin Galaxies conducted a deposition of Billy Mitchell, and it's one of the funniest things ever. Today we will look at the highlight. Billy gets caught in a massive lie, and gets completely destroyed.

People defend him because, all these lies aside, he actually was a good player, and they refuse to believe a good player could ever cheat.

You need to pay more attention to how Billy words things. He didn't actually admit to anything, and how he qualified his statements leaves a lot of wiggle room. Nor has the lawyer caught him lying.
A decent lawyer will shred the idea that Billy played on that cabinet. There are only photos of him in front of a cabinet, which Billy does say looks like the one he played on. But he also tosses out that he would not play on a cabinet with a red joystick. Ergo, if the cabinet had a red joystick, he did not play on it
The pictures definitely hurt his lawsuit and credibility, but it isnt a slam dunk. Calling him a liar is a bad idea without solid proof he is lying.
Lying implies intent and the knowledge of what you are saying is not true. Misremembering or getting facts wrong does not automatically mean he lied. Unless there is a video of him saying that he definitely played a cabinet with a red joystick for his record, it would be near impossible to prove he is lying.
I will also point out people's memories are horrible. Eyewitness testimony is one of the worse forms of evidence out there. People change, alter, forget, and make up new memories. They also see, hear, and think something happened that never did.
Billy may actually believe the joystick was black. His memory of the cabinet could very well not be what the actual cabinet looked like.
I hope Billy loses the lawsuit and is forced to pay attorney fees for the defendants. But this deposition and the photos do not guarantee a win and do not prove he was lying.
@@taoofjester4113Except he sated UNDER OATH that it was the machiene, So either way even if the evidence was "Not Legit enough" would still be convicted for lying under oath which throws ALL of his case into question. Honestly this is a pretty open and shut case either way cause Billy has 0 proof to back up his claims. Where as Twin Galaxy has multiple submitted peices of evidencw and cort records of Billy lying. Any decent Judge will look at the case and dismiss Billy, and if its a bad one it will just be appealed anyway.

There’s a subtle moment that I love - the lawyer comes across like he doesn’t understand what an authentic cabinet is, and Billy buys into it, he’s very dismissive with his answers, little eye contact etc. When the main photo is revealed and the lawyer asks outright if Billy played an 8 way, Billy finally gives the lawyer his undivided attention, understanding that the lawyer perfectly understands all the jargon. He’s staring at the lawyer with real venom when he realises the lawyer understands what a plunger button is, what an 8 way is etc. very subtle but very damning.

Usually I just listen to the videos, only a few times looking up. I tried to imagine how Billy must've looked, but watching that moment was incredible. You can really see the seething anger, even though his tone does not change. Thank you for pointing this moment out!

The most puzzling part of this whole series has been finding out Billy has fans lmao.
Yeah, even when it was thought he'd earned the records, I still thought he was a bit douchey.
There are always going to be people in the world who have such an incredibly deeply ingrained victim complex that they're always going to be compelled to take the more unpopular side of any argument by default. They don't even think about it or try to educate themselves, they just think that because one side has more people, that that side must be wrong, and they start spewing crap uncontrollably in support of even a demonstrably false position.
Billy has always been absolutely hilarious, but he's dead serious. Internet made people alot more savvy about cringe, but some people like Billy and his orbiters got left behind.

He confirms it LOOKS like the cabinet and that he REMEMBERS joystick being black. All subjective feelings and nothing definitive that any good lawy can say are just confuicion due to time (and how unreliable human memory is - why witness testimonies are kinda worthless on their own). That is not admision of the cabinet being the one he played with UNLESS is it established this is the only one on that convention.

To be fair, VanBuren20 recently released a video denouncing Billy and said that he is sick of being lied to and will no longer support him. The straw that broke the camel's back is when Billy tried to get VanBuren20 to to copyright strike this very video because Karl included footage of him per fair use.

To have that much memorabilia celebrating beloved games from childhood, only to essentially remove one of his *own* children from the family for something that's neither her doing or even a bad thing, is... not a good look. Imagine being such a blatant Nintendo fanboy yet still having the gall to believe oneself morally superior to their kid, while being a homophobe. They're not necessarily related topics sure, but the sheer juxtaposition of such things feels like a domestic abuser being a big fan of classic Disney films.
Would almost make me feel ashamed to like many of the same games. Though as much as I like Nintendo games, can't say I'd ever have that much company merchandise displayed like that, considering how vicious the company itself is. Would feel too much like outright sponsorship, when they neither need or deserve it from the average consumer, at least as a corporation rather than a game developer.

I dated a pathological liar once for three years. It was an absolute emotional rollercoaster, exactly because you just don't want to believe that such a thing could exist. Surely a human being would not lie about this stuff; would not pile lie upon lie; sometimes lying to get out of other lies and sometimes lying for no reason at all, just because that's what they do. Stepping back from it, you want to feel sorry for these people - they really do have a pathological problem. On the other hand, fuck that shit I never want it anywhere near me again so long as I live.

@@mobiusraptor7 even though it happened decades ago now, it is still hard not to be effected and scarred by these types of people. I have never seen him again, nor do I have any desire to. I'd be willing to bet he is probably sitting in a jail cell somewhere. The fact that he had no remorse in stealing other peoples money, and wrecking others lives, I doubt he would have stopped at credit card fraud. He was the sort of person who would have felt justified in his actions.
I think the most damaging part of his acquaintance is that you forever doubt your ability to judge peoples intentions, because of their ability to make a lie sound like the truth.

IIRC, they still have to answer objections, but the objection will determine if those answers are admissable in court or something.
I looked far an wide and the only photos I've seen of Donkey Cabinets that had that joystick was the Billy Mitchell photos. I hope they somehow find that cabinet in the photo and are able to prove if it was an 8 way joystick unless Billy Mitchell and Walter Day attempted to destroy the evidence (they probably did.) which would make it far more difficult to prove.
@@nolife6013 Finding the cabinet in the present day doesn't prove anything because such a joystick could have been put on at any time, by anyone. The only evidence that could possibly matter is witness or photographic evidence from the event itself--which they have, in those photos.

The questions are not avoidable, he's just trying to keep Billy from perjuring himself more by keeping his answers short and direct.
I'm a lawyer, and must say that this was a well-conducted deposition. You're right in saying that you don't want to make a big deal about anything or spring "gotchas" here. You want to nail down the relevant testimony and be able to impeach when the time comes. It is really tough for most people (and even a lot of lawyers) to simply keep their cool and act methodically under these circumstances.
I'm not an expert in law and plz correct me if I'm wrong, but when Billy's attorney objects on speculation, I think he should have stopped talking. He went on saying it didn't make sense then asked the other attorney if he meant "this" instead. Billy's lawyer is messing up just as bad as he is xD.
I imagine there's a bit of a rush when it all goes as perfectly as it does here.

"Would you play on a red joystick" "No"...yet we have a image of you playing on a machine, in which you said was the machine you broke the record on, with a red joystick, so what do you make of this?

The lawyer really should have had him confirm there was only one machine at the convention. Otherwise he could claim, "There must have been another machine with original hardware, because that's what I remember it being."
Then the burden of proof is on him to demonstrate 1) That there were two nearly identical machines there, 2) That the second, unseen machine had legitimate hardware, 3) That the second, unseen machine was the one he used despite the recording equipment being set up on the machine in the photo, and 4) That he was lying when he said, under oath, that the machine in the photo was the one he played on.

Even when it was revealed the joystick was red, he didn't deny that it was the machine. Just that someone must have changed the joystick. So he's not denying it's the machine at all.

We have og DK cabinets with plunger buttons and 4-way joysticks. They are absolute shit compared to today - but there is literally no mistaking a Nintendo 4-way joystick for any other joystick. It's short, stubby, and has its own unique feel opposed to offer joysticks. You have to buy a wedding ring for the commitment the joystick requires to go one-way and your jump arc. You can't glide it back and forth.
Even if he did set the high score on this cabinet (he didn't), he used this cabinet because he thought he would never get called out for it
Nintendo 4-ways really do have a surprisingly unique feel. I own a DK cab myself and it's amazing how much stick movement it takes to go from left to right or up to down. It's a one-of-a-kind feel for sure.

The first arcade I worked at was modern. The one I work at now is all EXCLUSIVELY original cabinets with original components from 1999 and before.
The difference between pre-JAMMA, wild-west joystick and button configurations and post-JAMMA is night and day on some cabinets. Nintendo joysticks are one of them. Pac Man is another.

I've been to court a few times but I've only ever had to testify once and before that trial I had to meet with my friends lawyer(my friend was sueing someone) and the whole lesson was for me to learn that you only answer what was asked and make the answer as short as possible. He said "do not give them them ANY information they don't ask for. If it's a yes or no question that's the only answer you give. The other lawyer may ask you a yes or no question and then just stay quiet and look at you if you answer yes or no. He's only doing that so you will feel like you're supposed to keep talking, DO NOT keep talking. I cannot stress the importance of what I'm telling you" I cannot even begin to guess how many times he said that.
If you've watched the West Wing (TV series) this was in an episode. One of the characters is being prepared for a deposition and the lawyer says "Do you know the time?" and she looks at her watch and says "It's 3:30" and he says "Don't do that", explains this and then says "Do you know the time" and she says "Yes".
if they ask you to explain something explain it in as little words as possible and as close to the question as possible
for example if they ask you "how did you do this?" or "how would one do this?" best to answer "it is done like this" and zip it, no Id do it like this but ive seen people do it like that, just "its this" and zip

But it is far easier said than done. For example, the "just wait after the initial answer" strategy is done because it works. People do not like silences in a conversation and they naturally seek to fill them so they will often add context without thinking.
On top of that, note that the deposition was well over two hours long. And they raised this topic just before one hour and went back to it more than two hours into the questioning. By the time they ask Billy these questions he is likely tired and stressed, which weakens anyone's self control against their instinct to fill a silence.
And a talker like Billy is more susceptible to that. And there is likely also a good deal of overconfidence from him believing he could not possibly lose at anything so he doesn't take it seriously enough.
Until you get the yes/no question "Have you stopped abusing your partner?"... (the answer is no, but how it would be construed is another story...)

@MrBollocks10 Just in case this isn't a troll, the color of the joystick absolutely matters. The Donkey Kong arcade cabinet comes with either a blacktop or whitetop joystick, indicating 4 possible directions a player can be controlled in. A red joystick, as Billy says during his deposition if I'm not mistaken, indicates the ability to control the character in 8 directions. Since the Donkey Kong cabinet comes with a 4 directional joystick, this means that the red one is indicative of modified hardware instead of original hardware, which is what Twin Galaxies is attempting to prove.
