One additional comment: I replaced the fencing for my patio (enclosed) and had 6 people bid on the job. I highly recommend that you obtain multiple bids and check the Yelp and BB reviews carefully. One ‘highly rated’ company attempted to charge over three times the amount of the other companies. I hired a young person just starting out who went the extra mile. Knew his stuff and was proud of his craftsmanship. Don’t be afraid to hire a young person.
It doesn't absolve you from liability by subcontracting the job. She didn't have a contract with the subcontractor he hired. He did not her. I don't think he grasped that concept.
I agree. I asked a tree guy to take down some trees and I included in the contract to do the clean up. The clean up wasn’t done and I complained. He said he asked another guy to come do the clean up as he wanted the wood. I told him I didn’t contract with the other guy but him and guess what? He got to work cleaning it up. My ex (husband then) laughed at me that I even wanted a contract.

Also sub contracting work and not taking responsibility for the crappy subcontractor is poor character. Man up, pay the lady and sue the subcontractor.

our 40 acre horse farm was sold to us 'fenced' for the horses. horses that CAME WITH THE PURCHASE. they kept getting out and going down to the neighbors places, several of them. we tried to walk the 'fence line' and discovered the electric wires were properly installed only where VISIBLE from the front of the pasture. the rest was NAILED to TREES haphazardly. had to sell the horses, and five years later, we are still fencing. AND so many other issues....sometimes you win, sometimes you lose. at least it's beautiful here lol. (and before you tell me, we paid plenty to have the place inspected, and found later they were in cahoots with the seller.)

I live in Louisiana, our new build home, was hit by 2 hurricanes 6 weeks apart. We lived in it for 45 days before it was destroyed. Roof, siding, water damage, flooring, 2 ft high of sheet rock, upstairs 3 rooms of carpet had to be ripped up. 1 contractor was a "family" friend and stole 50k and didn't do half the work. 2nd contractor subbed it out and still tried to get us to Pay him an additional 10k for subbing it out. 3rd contractor done the siding and roof and when they ordered materials they ordered to much but did not leave it they took it with them after we paid for it. I learned a lot it took over a year to repair everything and some stuff is not even finished or done correctly.

It was. Contract stated x amount of dollars gets you x amount of feet, but Judge told the defendant that don't exonerate you. If the contract states that then doesn't., then I don't know what will exonerate him.

Which is apparent at the end, when he's talking to Doug and he made the statement "this is why I subcontract to other people".

And if they contracted it out then they should have came at the end to ensure it was done correctly. 🤷♀️

In her mind, partial fence meant all the way from the left to the right along the back. In his mind, partial meant all the way from the left to the wood that was still standing on the right. It's obvious if you actually look at how he explained the picture to the judge.
She didn't get a "partial" fence. She replaced PART of a fence. The miscommunication was how big the PART should be. The entire back end OR from the left corner to wooden face that still stood.

Plaintiff got a recommendation from some sort maintenance website/service if you relook at the beginning of the piece, which put her in contact with what she thought she was a company which did fencing (its not at all uncommon for landscaping contractors to including fencing work as part of their services)., and the guy I don't doubt did little to dissuade her of that fact. I'll bet you a $100 he didn't tell her he was subcontracting out the work (and by quality work I'm guessing likely day labourers) The property owner obviously has little knowledge in this field. Expecting someone who know next to nothing about this type of work to be able to know someone recommended to her as knowing about fencing, as not, I think is unreasonable. You making the mistake that as you have more knowledge in this area, all people do or should. They don't and won't.

I watched a German Shepherd walk up a 7 foot high chain link fence without thinking about it (he was too far up for me to grab by the time we went to see what the noise was) He then shoved the roof off the kennel run with his nose and jumped down the other side. This woman's dogs will be gone as soon as they get bored.

I don't know who was right. If they only agreed to what $1000 would get them the defendant should have won. But if the fence was truly uneven the plaintiff should have that corrected.
Sounds like the contract was not very well written, all that should be very clearly spelled out, the cost, exactly where it starts, and exactly where it finishes, what is included and a time frame.

sloppy unqualified defendants don’t understand how to run a business. You have a responsibility when you subcontract because YOU created a contract with a client. She should have hired a real fence company. Instead of a landscaper. I know a fence company will cost more. But you get what you pay for.
Plaintiff got a recommendation from some sort maintenance website/service if you relook at the beginning of the piece, which put her in contact with what she thought she was a company which did fencing (its not at all uncommon for landscaping contractors to including fencing work as part of their services)., and the guy I don't doubt did little to dissuade her of that fact. I'll bet you a $100 he didn't tell her he was subcontracting out the work (and by quality work I'm guessing likely day labourers)
The property owner obviously has little knowledge in this field. Expecting someone who know next to nothing about this type of work to be able to know someone recommended to her as knowing about fencing, as not, I think is unreasonable.
You making the mistake that as you have more knowledge in this area, all people do or should. They don't and won't.

I watched a German Shepherd walk up a 7 foot high chain link fence without thinking about it (he was too far up for me to grab by the time we went to see what the noise was) He then shoved the roof off the kennel run with his nose and jumped down the other side. This woman's dogs will be gone as soon as they get bored.
Not all dogs care a wit to leave their boundaries. Also id bet the shepherd is not fixed and/or is young energetic and not given proper attention and focused exercise
@@bovinityleak2066 he was neutered, older and boardubg at the vet's. The tech jumped into her car and met him back at his home and brought him back. We kind of forgot to tell the owner. Male dogs ....btw....will climb ANYTHING to get to a female in heat. All the best to you for the holidays!

I don't know who was right. If they only agreed to what $1000 would get them the defendant should have won. But if the fence was truly uneven the plaintiff should have that corrected.
Sounds like the contract was not very well written, all that should be very clearly spelled out, the cost, exactly where it starts, and exactly where it finishes, what is included and a time frame.
I'm just going to say if she only wanted $1000 worth, then it totally is her fault. I completely believe that the plaintiff said she wanted one thing and changed her mind after she got it. I will say the defendants could have done better but they still did what they said.

sloppy unqualified defendants don’t understand how to run a business. You have a responsibility when you subcontract because YOU created a contract with a client. YOU must oversee the work and ensure that the work is done correctly. Defendants lost a lot more than they seem to realize. They came on public tv and demonstrated that not only do they not know how to run a business but that they don’t put the client first.

Why would anyone pay even $1 for a fence that has a 7' gap? Especially when you have dogs. Why not just leave it open the? Sounds like the contractors told him it would be 55' but then it turned out 55' wasn't enough. But it is totally unbelievable anyone would pay any money for a fence that doesn't connect.
