These aren't everyday police. They are border agents where you are required to verify that you're a US citizen.
This needs to be brought to The Supreme Court. The law says the stop doesn't violate The 4th Amendment, but forcing someone to answer a question does! They have the right to ask, and we have a right not to answer!
In 1974 the supreme court was 5-4 in favor of the republican party. Perhaps then partisanship wasn't a thing, I doubt it however, but with todays 6-3 republican supreme court I wish you good luck. No way these f!!ckers will give us back our rights.

Border protection has an inherent interest to the society, and it is reasonable for persons to suffer a minor inconvenience which does not infringe on their constitutional rights.

Illegals "crossing the border surreptitiously"? Really? Many years ago I worked with a number of illegal aliens, and every time they went home to Mexico for a vacation, I always worried they would not be able to come back. I asked, "How do you get back without legal papers?" The constant reply during those years was, "As long as I have $300 to give to the border guard, I'll be able to come back". I thought, "Wow! those guards are making a lot of money. Imagine the number of illegals crossing the border every day". They did not have to hire a coyote. They did not have to do anything "surreptitiously".

Under US v Martinez-Fuerte they can set up checkpoints, stop vehicles, and question the occupants. NOTHING in that ruling stated that people have to answer any questions.
Section 28783 does not override the United States Constitution. Plus if you are significantly and sufficiently far enough away from the border. Why in the hell is there even a checkpoint? This just goes to show that border patrol is more focused on harming American citizens than actually doing their job at this point

There are Federal Checkpoints 100 miles from all the borders, some include the whole state so the Feds could stop you at any time in those states and demand that you provide evidence that you are a US citizen, if you don't have it on you I would say you would be arrested and deported for not providing evidence of your citizenship. I am waiting for this to include the whole US from coast to coast and from Canada to Mexico.

They needed to pull forward to the secondary stop area them refuse to answer questions. The case in question simply indicates that the check point is not a violation of the 4th amendment. There is nothing in that case that asserts that you had to answer their questions.

Actually they didn't say anyone was obligated to answer. Just the stop wasn't a violation.
Detainment requires the higher standard, invoking the 5th doesn't meet that standard.
The Supremes said it had to be a permanent place. Is this one of the 2 the Supremes said was ok? They also said "just to slow down and look in the windows." This is more than the allowed "disruption." They didn't say anything about asking/answering questions and shit. So, they are still violating the Courts Order.

These federal agents keep quoting INA 287 and the Martinez-Fuerte SCOTUS opinion as if these 2 things are the “end all be all”. None of these say anywhere that the 5th Amendment disappears at an “immigration status” checkpoint. The SCOTUS decision and INA gives these Agents authorities for sure to briefly detained and question drivers but NO WHERE does it say that motorists HAVE TO legally answer these invasive and probing questions. Not a one. Most citizens feel intimidated and just comply and obey. If that’s their “bag” it’s ok. But Agents shouldn’t be surprised or get their law enforcement ego hurt when a citizen invokes their right to remain silent. Federal Agents when a citizen rightly declines to answer questions will just have to continue with their investigation some other way but a citizen is under no obligation to speak and give these Agents evidence of any violation that the citizen may or may not have committed. How are Agents going to continue their investigation without the cooperation of the citizen? That’s on the Agents to figure out, not the citizen. Any judge worth his or her salt would tell you that.

She can do her inspection. He is not required to do her job. And he does not have to answer questions.
If you don't answer their questions, then they'll be under the assumption that you're an illegal immigrant. Then, you'll get cuffed and identified to be released later. You're just wasting your time at that point.
