Get the EIN first, and then you'll use that number on the business license application and such. But you can use your SSN instead if you want, assuming you are the only owner.

That's a good question -- it really depends on what cities are involved. Some cities will pull the state database and be upset if you didn't get the biz license from them. I have not seen Sacramento doing that, but it could change. Usually the biz license is from the place where you are actually physically located. Note - the biz license database is public (but it doesn't seem to come up in a google search, so someone has to really be trying to find you).

I'm planning to start a mobile cleaning services that will span across cities and will include both residential and commercial. I live in an unincorporated city also considered a desert region in the San Bernardino County. I spoke with them and they mentioned a home occupation permit but none of the Class types appear to apply to me. Hi Frankie - technically your mobile cleaning service is a home business since it has no other office -- it is like your home is the headquarters of the business. For a business license, you'd have to look at the rules for each city to see if they require it when services are provided at the client site. Also, occasionally some commercial businesses you clean may require you to show them the business license (and proof of insurance).

You're welcome! Hm it depends upon the exact rules in those counties/cities and what you are doing. For example, if you were selling luxury picnic baskets at an event in a different county, you may only need a temporary business license (in some places). If you are providing picnic event in-person hosting on a regular basis, you may need to set up licensing in both counties, especially to get permits for the event locations and for insurance to cover your events. For the DBA, for a small business usually we just file it in the county where you are located (business address), but you might want to get a DBA in the other county so no one else gets a DBA for the same name there.

Hm after you submit you'll get an email with a link to docusign to sign the license - it usually is soon after but can be up to 15 days. Might go to spam? If you don't sign in 15 days then it deletes the application and you start over.

Welcome! I haven't created any industry-specific videos yet. Generally you would follow any business legal tips for a one-person business. The biggest difference is you need to watch out for protecting the copyrights over your work, where you would usually want to just license work instead of doing it work-for-hire/assignment of the copyrights. You may decide to assign copyrights over work for some clients/customers if appropriate, but you don't want to do that accidentally.

Usually places only care about where you are actually doing business (not a mailing address). Occasionally the other city will send a notice but you can tell them it is only a mailing address -- you don't do business there, which should work.

Generally cities want a business license / business tax certificate per the actual location of where the business work is being done. When someone works from home and has a virtual business address, the business license is using for their home business address. But check their rules -- some places don't have business licenses, and some has special home occupation permits that you need first.

That's a great question! It really depends upon the city/country where you are getting the business license. Some of them don't pay attention to the address as long as you pay the money. Others have put all the virtual business address locations into their database and will reject your application if you use one (typically those are the online application ones). A few will let you put both the virtual address and your physical address, and will keep the physical one non-public. Many times the only way to know for sure is to try (but a few discuss it in the application/instructions).

Yes you can switch -- it is a bit tedious because you have to go back to every place you filed or set up something, and switch it -- dba, business license, sales tax permits, bank accounts, etc.

Usually the city wants the business license for the actual physical location. Look at the city/town where you are located first, and then the county if your town is unincorporated.

Thanks! If you are a small business getting a business license in your area, I don't recommend using a service -- you end up spending as much time dealing with them as if you'd just do it yourself. I'd just google your city/town/county and "business license" or "starting a business in" and find the government website page about starting a business in your location. If you can't apply for a business license online via their website, just call the number for whomever is listed there as in charge of business licenses and permits, and they will help you (if we were not in covid, I'd recommend going in person). If you can't find the website or number, call 2-1-1 (information) and see if they can help you. If you are a large business that needs licenses in hundreds of areas, I'd go with an enterprise service like www.cscglobal.com/service/cls/business-licenses/

Hi Eli - you'd need to check with your local county and/or town. In some places, they don't have business licenses or permits, but in others you'd need a business license and a permit (either home occupation or mobile business). Also depends upon the type of business -- for example, if you sell food you will need permits for a food truck business.

this is prolly one of the best videos to explain the process.. but i do have a question, i've started the llc process and then will get the ein number. when applying for my business license in my city does it have to be the same as the llc name??? guess i'm still a bit confused if i can have one llc but have a couple different business' under it, so the names would be different that the llc.
Hm typically the business license is more about your business location, and they will let you state as it belonging to the LLC with a DBA (or maybe multiple DBAs). You may want to talk to someone with the city unit that does the biz licenses to make sure you fill out the forms right.

Hi, thanks for your question! My understanding is that the City of Pleasanton requires all businesses located there to have a business license. If the business has a sign, it is "prima facie" evidence of a business -- in other words, if you have a sign you are for sure a business, but you can be a business without a sign. Their code says: "“Business” means and includes professions, trades and occupations, and all and every kind of calling whether or not carried on for profit." Welcome! Hm there are categories for dolls and for toys, so probably under those (doll clothing is probably under that as an accessory). The main aspect is to make sure to state how you sell them -- for example, if you sell them exclusively online that can make it easier to get a permit (because customers are not in person).

Hi Cindy - they are probably referring to the Federal EIN (employment identification number). You need that even if you don't have employees yet - it's a tax ID for a business. I do have a brand name and do not go by my birth name, I am a bit lost with the requirement of publishing a ficticious business name for 4 weeks in a legal newspaper. Is this something required or optional? I find it so time and money consuming to set up a business if you have to do this before you can go to the clerk in your city to register.
In California the publication is required for a FBN, but you don't do it before you register -- you register it first. I recommend using DBAstore.com to make it easier

Hi - so if the business has just one owner (you) then it is a sole proprietorship and it automatically exists as as a business as soon as you start offering products/services to people. (If multiple owners, then same thing but as a partnership.) Look at getting an EIN (unless you are okay with using your SSN for the biz), then DBA (if needed), and then business licenses.

It depends on the laws / ordinances of each place where you physically work - each has their own rules. I imagine many people don’t get biz license for just one gig, but some cities can get hardcore about enforcement occasionally, to generate revenue.

It really depends on the city/county. Many of them don't require a biz license if you are just there temporarily or they have a special temp license for gigs. And some don't even have a biz license. I'd start with where you are operating at first (you won't play gigs in every county etc.).

Hm it looks like Elk Grove would consider a mobile business (where you visits clients at their location but you do paperwork and computer work at home) to be a home-based business, but they don't allow tattoo services to be done from home, so that may not work for your purposes. You might just call them (916) 478-2211 and say that you are having a mobile business.

If you are operating in the unincorporated area of Alameda county then you need a business license www.acgov.org/business/buslic.htm (if you are in a city, look at the website of that city)

Usually if you get a city general business license, you don't need a county general business license (the county one applies if you are located in an unincorporated area). If you are located in multiple cities, you might need multiple licenses -- depends upon what you are doing in each city. Yes sometimes all owners need to be on the business license.

I want to use a virtual business for multiple reasons...I’m a renter, privacy, and I plan on moving sometime in the future. My question is: If I am required to set up a business license do I apply one in the city my rental home (physical presence) is in or the city where my virtual business address (LLC) is in?
Usually the city where your physical location is wants the business license there. But if you have a virtual address where there is someone physically there (they provide receptionist services, sometimes you use their conference room), it can make more sense to have that be your "physical location" instead of your home office. I'd look at the requirements of each city (especially if you are a renter, you might need your landlord's permission) and make the decision based upon the requirements.
That's a good question - some cities/towns have specific rules about that, and some are silent. I imagine that many mobile businesses don't bother, but if someone is doing most of their business in a town (or if that town has specific rules on that) then it may be best to get it, to avoid drama later.

Depends upon your location (the city and also if it is a building or a food truck) and what you are selling (just food, also alcohol, etc). You'll need a business license for the business overall, a permit for what you are selling (food, alcohol), and a permit for the location. Sometimes much of this is combined. I recommend going to the website for your local city/town -- they usually have info about opening a business. Call them and they will usually tell you what you need.

In CA you get the business license usually from your town (sometimes from the county, if not incorporated) -- go to their website and look for "business" stuff. You'd only need a seller's permit if you sell products to your customers (maybe cleaning products? not sure if you'd have anything).
If your only contact is shipping to a customer there, I don't think there's enough for a business license in those various states/cities. If you go in person to a trade show, for example, in some places you need a (special) business license. Typically business licenses are needed for in-person operations (storefront, warehouse, employees, etc.).

For many new coaches, it makes sense to start out as a sole proprietorship to save costs / complexity, until the business gets running and you are making more money. It makes sense since coaches usually pick their clients and do the work themselves, and the business is fairly low-cost to start up (so no big loans/debt). Obviously the down side is the personal liability, but much of that can be handled via insurance, being picky about clients (to avoid drama), avoiding debt, and having written contracts.

Eh technically LA County wants you to use a street address where you are located so someone can find you. I'm sure that many people use UPS Store or other virtual addresses, and it sometimes goes through and sometimes their algorithm catches it.

Complicated scenario: A person who lives in Tijuana, Mexico, works as a W-2 employee in San Diego, has a CA DL, is registered to vote in San Diego County, decides to form an LLC in Wyoming in order to do virtual assisting from his/her Tijuana home. He/she then registers the LLC in California as a foreign LLC using a UPS store or professional virtual office address in Chula Vista. Is this person required to obtain a Chula Vista business license? Will the City of Chula Vista even accept a UPS Store or professional virtual business address on the business license application (will the CA SOS accept such an address on the foreign LLC registration form for that matter)? As much as he/she may like to, he/she hesitates to cut California out of this freelance equation entirely because he/she files an FTB state tax return each year for his/her W-2 income, and thus the FTB may wonder why he/she doesn't do the same for his/her freelance income especially if he/she includes that freelance income on his/her 1040.
Generally, Chula Vista (as well as most other cities) would only require a business license if the business is located in CV or works there sometimes (like visits clients in person). However, I have seen some cities who will check public database listings (like with the CA Sec of State for LLC listings) and will send a bill because the address listed with CA is located in their city. I don't know if CV does that. Also, occasionally someone will ask for a copy of a business license, and you'd need a business license to give them.

If you want to make sure you're on the up and up, you'd get a business license (if a general business license is required in your city/county). The main issue you may run into is some cities only allow certain types of businesses to operate out of a home -- and a few don't allow businesses that have inventory (I have no idea why they care, but there you go). So check out the rules for your city by going to their website and looking for the "business" section of their site.

Thanks for asking about this -- it is a very good point that if you use your home address as your business address, it will be in publicly available databases. I recommend getting a business address to use for such listings. It depends on what is available in your area, but some virtual offices have options where you can pay a fee (usually under $50/month) to use their address and get mail there. People also use a PO Box or another mailbox company (UPS Store, Anytime Mailbox, etc) ... that works sometimes but isn't technically the "physical location" that you need for certain forms. Also get a business phone number (can just use google voice or a similar voip service).
I recently applied for a PO BOX and I feel much more comfortable now that my packaged do not show my address especially with a growing business, definitely recommended.
Hi Elizabeth, I am having a hard time finding out what necessary licenses and permits needed for me to start my own mobile notary business in the county of Santa Clara. I'm interested in a sole proprietor but I'm having trouble finding out all the licenses and permits I need to do a mobile notary service. My office will be out of the home but not having anybody come to my house I will be going directly to the clients at their place. Your business license/permits will likely be from the city where you live, not the county. Check out the website for the city where you live and look under a "business" section -- also could look for a phone number for their business department.

Well you need to be a notary public with the state www.sos.ca.gov/notary/qualifications and post the bond etc. Besides that, the requirements would be the local stuff and paying taxes.

Yep that's about right. The sellers permit really is just a number/account you get so you can file your sales taxes to the state (it's not exactly about "permitting" you to have a business). So many items have odd names.

Good question -- in a state where business license are from the city/county, it does not transfer. Yep you have to start over with business licenses/permits when you move (aka have a new location).

I want to run a recording studio from home. Have you ever seen a business license get disapproved because of the nature of the business. I checked the local guidelines (Sacramento) and the business wouldn’t violate any of the regulations. Everything would be sound proofed.
Typically that only happens if it is not following one of the rules, like the rule says no customers and they have customers.

That's a good question -- it really depends on what cities are involved. Some cities will pull the state database and be upset if you didn't get the biz license from them. I have not seen Sacramento doing that, but it could change. Usually the biz license is from the place where you are actually physically located. Note - the biz license database is public (but it doesn't seem to come up in a google search, so someone has to really be trying to find you).

I'm planning to start a mobile cleaning services that will span across cities and will include both residential and commercial. I live in an unincorporated city also considered a desert region in the San Bernardino County. I spoke with them and they mentioned a home occupation permit but none of the Class types appear to apply to me. Hi Frankie - technically your mobile cleaning service is a home business since it has no other office -- it is like your home is the headquarters of the business. For a business license, you'd have to look at the rules for each city to see if they require it when services are provided at the client site. Also, occasionally some commercial businesses you clean may require you to show them the business license (and proof of insurance).

And if so would the same go for filing a DBA?
You're welcome! Hm it depends upon the exact rules in those counties/cities and what you are doing. For example, if you were selling luxury picnic baskets at an event in a different county, you may only need a temporary business license (in some places). If you are providing picnic event in-person hosting on a regular basis, you may need to set up licensing in both counties, especially to get permits for the event locations and for insurance to cover your events. For the DBA, for a small business usually we just file it in the county where you are located (business address), but you might want to get a DBA in the other county so no one else gets a DBA for the same name there.

Thank you Elizabeth! I applied for business licence in San Francisco but I didn't get any letter or any notice. Instead I received two letter about labor law compliance notice.
Hm after you submit you'll get an email with a link to docusign to sign the license - it usually is soon after but can be up to 15 days. Might go to spam? If you don't sign in 15 days then it deletes the application and you start over.

Welcome! I haven't created any industry-specific videos yet. Generally you would follow any business legal tips for a one-person business. The biggest difference is you need to watch out for protecting the copyrights over your work, where you would usually want to just license work instead of doing it work-for-hire/assignment of the copyrights. You may decide to assign copyrights over work for some clients/customers if appropriate, but you don't want to do that accidentally.

Usually places only care about where you are actually doing business (not a mailing address). Occasionally the other city will send a notice but you can tell them it is only a mailing address -- you don't do business there, which should work.

Generally cities want a business license / business tax certificate per the actual location of where the business work is being done. When someone works from home and has a virtual business address, the business license is using for their home business address. But check their rules -- some places don't have business licenses, and some has special home occupation permits that you need first.

That's a great question! It really depends upon the city/country where you are getting the business license. Some of them don't pay attention to the address as long as you pay the money. Others have put all the virtual business address locations into their database and will reject your application if you use one (typically those are the online application ones). A few will let you put both the virtual address and your physical address, and will keep the physical one non-public. Many times the only way to know for sure is to try (but a few discuss it in the application/instructions).

Licenses are city by city, but not every city requires a license if you don't have a location. You have to check each place's rules though

Usually the city wants the business license for the actual physical location. Look at the city/town where you are located first, and then the county if your town is unincorporated.

Thanks! If you are a small business getting a business license in your area, I don't recommend using a service -- you end up spending as much time dealing with them as if you'd just do it yourself. I'd just google your city/town/county and "business license" or "starting a business in" and find the government website page about starting a business in your location. If you can't apply for a business license online via their website, just call the number for whomever is listed there as in charge of business licenses and permits, and they will help you (if we were not in covid, I'd recommend going in person). If you can't find the website or number, call 2-1-1 (information) and see if they can help you. If you are a large business that needs licenses in hundreds of areas, I'd go with an enterprise service like www.cscglobal.com/service/cls/business-licenses/

Hm see if there is anything else you can give Google that could prove your business is legit. Like a photo of the shop with the sign, insurance statement, utility statement, tax bill, etc -- something that has the address and business name on it, that shows the location is legit

Hi Eli - you'd need to check with your local county and/or town. In some places, they don't have business licenses or permits, but in others you'd need a business license and a permit (either home occupation or mobile business). Also depends upon the type of business -- for example, if you sell food you will need permits for a food truck business.

this is prolly one of the best videos to explain the process.. but i do have a question, i've started the llc process and then will get the ein number. when applying for my business license in my city does it have to be the same as the llc name??? guess i'm still a bit confused if i can have one llc but have a couple different business' under it, so the names would be different that the llc.
Hm typically the business license is more about your business location, and they will let you state as it belonging to the LLC with a DBA (or maybe multiple DBAs). You may want to talk to someone with the city unit that does the biz licenses to make sure you fill out the forms right.

Hi, thanks for your question! My understanding is that the City of Pleasanton requires all businesses located there to have a business license. If the business has a sign, it is "prima facie" evidence of a business -- in other words, if you have a sign you are for sure a business, but you can be a business without a sign. Their code says: "“Business” means and includes professions, trades and occupations, and all and every kind of calling whether or not carried on for profit." Welcome! Hm there are categories for dolls and for toys, so probably under those (doll clothing is probably under that as an accessory). The main aspect is to make sure to state how you sell them -- for example, if you sell them exclusively online that can make it easier to get a permit (because customers are not in person).

Hi Cindy - they are probably referring to the Federal EIN (employment identification number). You need that even if you don't have employees yet - it's a tax ID for a business. I do have a brand name and do not go by my birth name, I am a bit lost with the requirement of publishing a ficticious business name for 4 weeks in a legal newspaper. Is this something required or optional? I find it so time and money consuming to set up a business if you have to do this before you can go to the clerk in your city to register.
In California the publication is required for a FBN, but you don't do it before you register -- you register it first. I recommend using DBAstore.com to make it easier

Hi - so if the business has just one owner (you) then it is a sole proprietorship and it automatically exists as as a business as soon as you start offering products/services to people. (If multiple owners, then same thing but as a partnership.) Look at getting an EIN (unless you are okay with using your SSN for the biz), then DBA (if needed), and then business licenses.

It depends on the laws / ordinances of each place where you physically work - each has their own rules. I imagine many people don’t get biz license for just one gig, but some cities can get hardcore about enforcement occasionally, to generate revenue.

It really depends on the city/county. Many of them don't require a biz license if you are just there temporarily or they have a special temp license for gigs. And some don't even have a biz license. I'd start with where you are operating at first (you won't play gigs in every county etc.).

Hm it looks like Elk Grove would consider a mobile business (where you visits clients at their location but you do paperwork and computer work at home) to be a home-based business, but they don't allow tattoo services to be done from home, so that may not work for your purposes. You might just call them (916) 478-2211 and say that you are having a mobile business.

If you are located in the city of Los Angeles (search your address here: finance.lacity.org/) , you need a business license from the city. I’m located in California and plan on setting my LLC in January for my online business. I want to use a virtual business for multiple reasons...I’m a renter, privacy, and I plan on moving sometime in the future. My question is: If I am required to set up a business license do I apply one in the city my rental home (physical presence) is in or the city where my virtual business address (LLC) is in?
Usually the city where your physical location is wants the business license there. But if you have a virtual address where there is someone physically there (they provide receptionist services, sometimes you use their conference room), it can make more sense to have that be your "physical location" instead of your home office. I'd look at the requirements of each city (especially if you are a renter, you might need your landlord's permission) and make the decision based upon the requirements.
What about if I’m in one city and county then a customer is located diffrent city and county? I’m a handyman…
That's a good question - some cities/towns have specific rules about that, and some are silent. I imagine that many mobile businesses don't bother, but if someone is doing most of their business in a town (or if that town has specific rules on that) then it may be best to get it, to avoid drama later.

Depends upon your location (the city and also if it is a building or a food truck) and what you are selling (just food, also alcohol, etc). You'll need a business license for the business overall, a permit for what you are selling (food, alcohol), and a permit for the location. Sometimes much of this is combined. I recommend going to the website for your local city/town -- they usually have info about opening a business. Call them and they will usually tell you what you need.

In CA you get the business license usually from your town (sometimes from the county, if not incorporated) -- go to their website and look for "business" stuff. You'd only need a seller's permit if you sell products to your customers (maybe cleaning products? not sure if you'd have anything).

If your only contact is shipping to a customer there, I don't think there's enough for a business license in those various states/cities. If you go in person to a trade show, for example, in some places you need a (special) business license. Typically business licenses are needed for in-person operations (storefront, warehouse, employees, etc.).

For many new coaches, it makes sense to start out as a sole proprietorship to save costs / complexity, until the business gets running and you are making more money. It makes sense since coaches usually pick their clients and do the work themselves, and the business is fairly low-cost to start up (so no big loans/debt). Obviously the down side is the personal liability, but much of that can be handled via insurance, being picky about clients (to avoid drama), avoiding debt, and having written contracts.

Eh technically LA County wants you to use a street address where you are located so someone can find you. I'm sure that many people use UPS Store or other virtual addresses, and it sometimes goes through and sometimes their algorithm catches it.

Complicated scenario: A person who lives in Tijuana, Mexico, works as a W-2 employee in San Diego, has a CA DL, is registered to vote in San Diego County, decides to form an LLC in Wyoming in order to do virtual assisting from his/her Tijuana home. He/she then registers the LLC in California as a foreign LLC using a UPS store or professional virtual office address in Chula Vista. Is this person required to obtain a Chula Vista business license? Will the City of Chula Vista even accept a UPS Store or professional virtual business address on the business license application (will the CA SOS accept such an address on the foreign LLC registration form for that matter)? As much as he/she may like to, he/she hesitates to cut California out of this freelance equation entirely because he/she files an FTB state tax return each year for his/her W-2 income, and thus the FTB may wonder why he/she doesn't do the same for his/her freelance income especially if he/she includes that freelance income on his/her 1040.
Generally, Chula Vista (as well as most other cities) would only require a business license if the business is located in CV or works there sometimes (like visits clients in person). However, I have seen some cities who will check public database listings (like with the CA Sec of State for LLC listings) and will send a bill because the address listed with CA is located in their city. I don't know if CV does that. Also, occasionally someone will ask for a copy of a business license, and you'd need a business license to give them.

If you want to make sure you're on the up and up, you'd get a business license (if a general business license is required in your city/county). The main issue you may run into is some cities only allow certain types of businesses to operate out of a home -- and a few don't allow businesses that have inventory (I have no idea why they care, but there you go). Thanks for asking about this -- it is a very good point that if you use your home address as your business address, it will be in publicly available databases. I recommend getting a business address to use for such listings. It depends on what is available in your area, but some virtual offices have options where you can pay a fee (usually under $50/month) to use their address and get mail there. People also use a PO Box or another mailbox company (UPS Store, Anytime Mailbox, etc) ... that works sometimes but isn't technically the "physical location" that you need for certain forms. Also get a business phone number (can just use google voice or a similar voip service).
I recently applied for a PO BOX and I feel much more comfortable now that my packaged do not show my address especially with a growing business, definitely recommended.

Your business license/permits will likely be from the city where you live, not the county. Check out the website for the city where you live and look under a "business" section -- also could look for a phone number for their business department.

Well you need to be a notary public with the state www.sos.ca.gov/notary/qualifications and post the bond etc. Besides that, the requirements would be the local stuff and paying taxes.

Yep that's about right. The sellers permit really is just a number/account you get so you can file your sales taxes to the state (it's not exactly about "permitting" you to have a business). So many items have odd names.

what if you get a business license selling on eBay, Etsy, Poshmark, etc. in your local area and get a full-time job immediately after the face and have to relocate...can you do a business license transfer to that city or town? or do you just loose that money and have to start from square one? Good question -- in a state where business license are from the city/county, it does not transfer. Yep you have to start over with business licenses/permits when you move (aka have a new location).
