Hi there. Great video. I have a card game that I have already sold a few copies of. There is a business that is a jewelry boutique that has the same name. I do not see that name in the search USPTO site. Is it likey that a Trademark application for this name would be rejected ? We are trying to decide if we ned to just rename our product. I know this is a broad question, but any nudge in the right direction is appreciated.
It is hard to say -- I'd say that jewelry and card games are not overlappping businesses but an examienr may think differently
Hi, I have an LLC and a non registered trademark which I am using on Amazon and I have decided to register it on USPTO under class 21(kitchenware). Now, there is an already registered similar trademark but under class 42(web designing).
For understanding, let's say this trademark is 'grand style' and mine is 'style grand'.

How long do you have to wait, after you have filed your trademark before you can start to monetize. on your trademark. IE: sell tee shirts, mugs ETC. without the worry of it being used by others.
What types of evidence do you need of a first date of sale? If I sold a product to a friend who paid with cash or Venmo how would I record that so that I can use that date in the application?

Hi there! Question~ how much later on in the process are the rest of the filing fees due, when filing the TEAS standard application? Is the standard version technically less of a financial risk, since the fees for multiple categories aren't all due up front-- (even though it's more expensive per category than TEAS+)? I'm stressing about whether to file my TM in multiple categories, or just try getting my TM registered in my primary category first. Thank You!
The fees for multiple classes are always due at the time of filing, regardless of whether it is TEAS or TEAS Plus.
hello . can i register a trademark on my mailing address? or i will need physical address for my trademark?
You can use a mailing address but the domicile address must be a real physical location
Hey i have a question that's been bugging me with trademarking,
say i have a original fictional character (i actually have more than 5) that all appear & or exist in the series im writing. What would be the way to trademark them & for every character i make that is in the book, are they able to be protected under a single overarching trademark or do i need to register every one of them individually? i plan to create an animated series and want to be sure my work is legally protected from being stolen by others or potentially a corporation
Trademarks are for each thing, so if there are multiple things each is registered individually. But you may also want to protect via copyright law, which is different (check out copyright.gov)

I'm not a Lawyer, but in my case, I will start using my LOGO on clothing. I have no choice but to protect it. Let's say the LOGO is attracting customers and someone in another State notices this, they can go ahead and duplicate it and or, Trademark it if I haven't done so. If the name I am using in the LOGO is really important, I would want to protect that as well. In my case, if I could only pick one to trademark, I would go with protecting the LOGO.

looking for how to file an extension of time request on TM.
I'm not a Lawyer, however, I think you may be indicating you filed a 1b application, Intent to use. If this is what you are asking and you do not have a Specimen ready, you can file an extension. Further, when you receive a NOA (Notice of Allowance) , you will have 6 months after the NOA date to send a Specimen. If however, during that 6 month period you do not think you will have a Specimen ready, file an extension before the 6 month period. And, 6 months later if you are still not ready, I am quite sure you can file for another extension. Finally, you can call the USPTO, the help number. They will kindly help you. That is what they are there for. And if by chance you get someone that doesn't seem to want to help, pretend you have to get off the phone, and call back later and more than likely you will get someone else, ready to help you. I've always had good customer service when calling.
@@MM-cs3yz thank you! I received a NOA and needed more time. I was essentially looking for a how to vid to complete an extension. I managed to work it out. It was relatively simple. They did charge $125 for each class, which got me another 6 months. Thanks again for your response.
for the trademark application, the evidence I've show to show that our trademark is in use, do the evidence have to be based on USA?
What if I've only a office in usa and my services are for developing countries? We still haven't started providing services within te USA.

Yes, if you are filing for a USA application, the sales but be in the USA. Or you can base it on a foreign trademark.

If I trademark an image that represents my initials, can I use it on products I sell without an llc?
You are not required to have an LLC
So I want to trade mark my clothing brand and when I’m entering in who the owner of the mark is even tho I don’t have a LLC Should I still list the name of what I call my brand or should I use my own name
If your LLC does not exist yet, it cannot be the owner. You can be the owner and assign it later.
