    This is so helpful - thank you! There’s just one thing I’m still not sure of - if I am selling an art service (spraying windows for businesses, etc) which means my business would be conducted wherever the clients are, perhaps even beyond the city or county I am in, do I just consider it as though I’m conducting business where I’m based (for business license purposes and other required paperwork), since there’s no way of really knowing where the clients will be? Hope that question makes sense.

    What if you get your sellers permit and collected taxes before the dba and ein?

      To operate a business you must have a sellers permit, business license, register your DBA, and likely get zoning clearance or a home use permit. If you are conducting sales without properly registering your business you are in violation of your city/county business laws.

      A business license is a step in the process of this video. You will need to check calgold.ca.gov for your industry specific licenses

    Do I need to wait for the FBN to be approved and published for the month before applying for an EIN?

      It would be wise to wait until you have registered the FB in case your name happens to be denied. However, once registered you don't need to wait for it to be published

    question:you refer to bookkeeper/CPA.....why both ??

      Thanks :) Depends on the needs of the business owner - a bookkeeper's role is just to keep a business financial records organized, while a CPA's role is to give tax/financial advice

      @@ginnysilver new kind of bookkeeper out there: certified by IRS as tax specialist..,older ones are quite good. The CPA is getting hard to find(seasoned older ones are retiring), and so much costlier.

    Hi Ginny I have a question! As a sole proprietor hire independent contractors for like when business gets busy and they need that extra support? If so how does one go about doing that for tax purposes?

      Hi! You'll need to determine if you need an independent contractor or an employee. With independent contractors you do not tell them how to perform the job, you are hiring them to decide all of the specifics of how they carry out the work. If you are providing them with instructions, they would be classified as an employee. If a contractor, you would provide them with a work for hire contract and then collect a W9 from them and issue them a 1099NEC after the year ends.

      Gusto for payroll - use the link in my video description they will send you a bonus. For employees gusto has everything you need to legally hire and stay compliant, contractors you need to find a contract template within your industry and/or have an attorney modify or create one. 1099s I have tutorials on my channel.

    I LOVE your videos, so thorough and extremely helpful. I applied for my seller's permit with the CDTFA and never received paperwork in the mail. I did get a Sales and Use Tax number on my profile on the CDTFA site, is that okay?
    Can I also sell wholesale as well as a sole proprietorship (selling totes, candles, other accessories? or do I need any additional permits/licenses for that in CA? Thank you!

      Thanks so much, and glad they have been helpful! I would request a copy of your seller's permit to have on file since technically it should be displayed so you should have it on hand. California is one of the few states that does not permit out of state retailers to buy from California wholesalers without a CDTFA seller's permit so being a wholesaler in California is a bit more challenging, as an aside. You can do both and you will need to ensure you accept and validate resale certificates and check the retailers registration with the CDTFA online.

    Hi Ginny, do you know if I need a business license if I have an Etsy shop in California and it's my only source of income? I don't need one in my city but I'm unsure if I'm required to have one from the state. I don't sell in person and only online.

    Hi Ginny. Not done watching the video but i paused to ask a question because the seller's permit is my next step. At what point is a virtual address recommended? Will people easily find my home address of they google any of my documents? I know the DBA gets published. But i put everything on pause because i wasnt sure if i made a mistake with using my home address. 15:28

      Many people use their home address, but if you aren't ok with your home address and satellite photos of your home linked to your business then you need a virtual office (not just a virtual mailing address)

      You will need a virtual office - not just a virtual address - to be able to register a business to it. It's a more expensive service so make sure you know which service you are buying. Yes you will need to update your business address on all forms/registrations.

      Same process applies - but you would only need a sellers permit included if you have any tangible items included at any point in the process of a sale.

    I am currently 17 years old and want to start a business. But since I am underage, I am going to use my mother’s information to start this business. Would it still be considered a sole proprietorship if I am the one controlling all the business but just under my mom’s name? Thanks!

      No - not a sole proprietorship but a parent can form an LLC (a limited liability company) for their child's business. The parent would be the organizer, noted in the paperwork.

      Because a minor can not sign binding business contracts, it is generally not a good idea to start a sole prop for a minor. The Sole prop would be your parents and you would be an employee or independent contractor of your parents business, obligated to all required employee/labor laws. LLC with the parent as the organizer is generally how this would be done instead.
