@@juliettelynne5861 no, because accidents happen all the time. Las time I bumped into, or was bumped by someone letting it pass was mutual and forgettable. If I was famous I can bet you one of those incidents would’ve caused irreparable damage.

This is crazy if you have ever skied on a very crowded ski slope especially on home runs at closing. Skiing is dangerous on its own. If this stands then the Ski industry should be worried.

In 2008 they passed a new federal law.... There will not be any automobile accidents... Accident implies no one was at fault... Someone is always at fault and will be charged and prosecuted for a crash....

And the ski patrol records. If they didn't carry him off the slopes on a sled, then his story is a fabrication.
@Johnny Natural If they both went down that hard, she would be as injured as him. We see that she was not phased by the collision at all. That raises questions about his credibility.
Whichever person was uphill of / behind the other is ultimately responsible. It's common skiing etiquette. One can not expect a downhill person to look backward while on skis. That said, there have been many times when a beginner skier further down the hill suddenly turns, changing direction unexpectedly without looking to the right or left at the area around them to see if anyone is nearby, and listen for the sound of a nearby skier. It's a matter of fast thinking on the uphill skiers part to do their best to avoid the downhill skier with very little time to maneuver around the downhill person. End of the ski day is the worst for these accidents because everyone is tired, and some have a bit of alcohol in them, making their ability to judge distance and speed much worse. It's unfortunate that the man was hurt, but being badly hurt is not evidence of guilt of the other person. Many skiers hurt themselves very badly without the help of anyone else (Sony Bono, Natasha Richardson). They are accidents. This is why they are called "Accidents". Skiing is a sport done at one's own risk as it usually says on the ticket one buys to ride the ski lift.

Yes, how can a doctor say what caused the injury with such certainty? It's impossible to know that! Unless there is video and proof of intent to harm this case needs thrown out of court.
I had a guy crash into me when I was 8 sing and my shoulder has dislocated hundreds of times since then because of it. Like the doctor said about this guy suing, it forever changed my life. But I accept that skiing is dangerous, and things happen. The idea of suing someone over an accident, not a malicious attempt to trip someone, is insane. This guy should be ashamed of himself.

Skiers have hit trees and sustained injuries or even died. He could have easily hit her and sustained those injuries.
Either way, she should've stopped but she kept going. The medical records should be the deciding factor.
@@arcturionblade1077 the rules of safety go, for example: at a red light, the person with green has the right of way, he essentially had the duty to yield if he ran into her and was uphill... better example would be merging g on highway or just walking down the street you don't walk into someone and plow them over and expect them to pay you bill when you have to go to hospital . And same with an owner with an aggressive dog who attacks your dog at the park.. the person whose dog does the attacking is not going to ask the other guy to pay his vet bill if his dog gets injured as a result...

I don't believe that schmuck Dr. for a minute. I ski, and snowboard, and have had this happen to me. I believe Paltrow is an experienced, and responsible skier. I think the Dr. is a "gold-digger". Much information is missing from his claim.
When a professional testifies that ‘ there’s only one scenario’ , you know this guy hasn’t testified before. There is never one scenario mate, not unless you are creating a narrative ……..

Ever read the back if the lift ticket ? I think he should not have been skiing if he was hurt from that. It sounds like he was hit with a car. Four broken ribs and a head injury from little Gwyneth ? Hard to see that.

There's no such thing as an accident. On the ski slopes you have a legal responsibility to avoid the person downhill from you. It is a written code.

Gwyneth makes a lot of money. She could have easily paid Sandersen out of court insteading wasting 8 days in Utah on this.
The reason she's doing it because Sandersen is trying to extort money from her. It's noble she's only suing him for $1 and attorney fees she wouldn't have had to pay if he didn't drag them all into court. She could have sued him for all the money she lost on the full day of ski instructions and for emotional harm of going through a lawsuit and ruining a great family vacation the first time her and her husband to be kids met, but she didn't. Gwyneth is a classact for that. She deserves to win this.

They both accidentally hit into each. One got hurt and the other didn't. Can't really see who's at fault 🤔? Do they have any video evidence of this?

Gwyneth's accounts have some noticeable inconsistencies. When pressed about the accounts in her own deposition, with respect to "looking behind briefly to her right(?) when she was called on by her son," who was uphill vis-a-vis her, "to take a look at him skiing," Gwyneth responded that she had "no recollection" of whether her son was calling her to get her attention. This was notwithstanding her own deposition stating otherwise. Later on, however, when her own lawyer was questioning her and accusing the plaintiff of having "sketchy memory," Gwyneth made a point about having a "very vivid" memory of what had happened to her on the day of the skiing accident.
When pressed, she acknowledged that she could not have "known for sure" whether the plaintiff bumped into her from behind accidentally or intentionally [allegedly to "sexually" assault her]. Again, however, she had earlier claimed that she had the impression that it was the latter, thereby inciting her to yell profanity at the plaintiff shortly after the two had bumped into one another rather than first asking the plaintiff if he was "okay." Nonetheless, when her lawyer was questioning her, Gwyneth seemed resolute about the prospect of the plaintiff bumping into her on purpose.
I’m pretty sure when you get your lift ticket it states the consequences of your actions on said day. You take that lift pass knowing you may be subjected to injury. Just like taking a drivers course you take a test realize dangers at hand and proceed with caution. We will see what the judge has to say and jury.

I’m not a GP fan but this is stupid. This is so dumb. Trials like this shouldn’t be allowed. If there is any liability why isn’t it the ski resort? Anyone who lived in Utah before 1985 knows that the ski resorts in Park City were hardly the best runs in the area. My guess is that that their trails have been under maintained and under patrolled for years.
This is literally all a money grab. People are over-analyzing it.

Everyone is hurt when a scammer gets money just to avoid court. It encourages more of a theme to create accidents and lies. Next time it could be you or me. I'm not saying that's what happens but I applaud people who don't settle when they are scammed.

Money does have a large effect on our happiness until essentials in life are secured. After that, like in a rich celebrities case, it doesn’t make a difference as far as I’ve seen in research.
