  • The plaintiff says she bought a teeth whitening coupon from the company the defendant represents, but it doesn’t include the necessary additional dental work. She claims it was a fraud, so she’s suing to be removed from the collections company the defendant works for, plus 1 cent. The defendant says he was hired to collect a debt for a non-refundable coupon, and he won’t remove her name until the plaintiff pays her debt. He’s countersuing for the amount of the coupon, plus his commission.

    The people asking why she sued for a penny are dense and cannot hear what was said. SHE WAS NOT SUING FOR MONEY BUT TO HAVE THIS REMOVED FROM HER CREDIT!!! She had to assign a monetary value!!! Listen people listen!!!

    The plaintiff was not damaged. She had buyer's remorse for a non-refundable purchase. She had very, very poor legal advice. Case closed.

    She bought two $60 vouchers. Got paid $500 to be on the show. The show paid the counter suit against her, which was the entire cost of the vouchers. She still has the vouchers and is free to use them. THIS WOMAN IS A GENIUS!

      Whay she's saying, and even I can figure it out, is that she is NOT out the money. She didn't pay. If you don't pay, is it a refund? That's her argument.

    If a business offers a sale as nonrefundable then pass. It's a scam! Legit businesses don't do this! Plus, what type of business goes into other businesses soliciting?

    She didn't want the product anymore because her boss's daughter tried to use but the dentist refused whiten teeth that had cavities. Yeah, a dentist shouldn't overlook cavities in favor of whitening.

    Dental assistant here… you don’t put whitening over cavities. You get the cavities taken care of then whitening. That why’s there’s x rays and exam included

    Ive been scammed almost the exact same way. Whitening promotion for new client etc couldn't get trays done until precavaties were treated. Took over a year of them coming up with excuses and rescheduling and then when there was no other reason they didnt want to give them to me because i wasnt a new patient anymore! They literally drilled out a precavity, didnt fill it, caused an abscess and i had to then have a root canal that i had to pay for. All for some whitening trays.

    The Plantiff mentioned her boss's daughter was denied because of cavities and "claims" she has had a previous dental services for cavity...why would that matter, she could have had only a few of them removed and still have other ones then tried to get a whitening system instead of getting the remaining cavities taken care of. " The cheap always comes out expensive" J.M🙂

    She only thinks it’s not a refund because she paid by check and at that point, they had not taken her money so it’s worthless unless given to a bank. She canceled the check before they cashed it and found that they couldn’t so now they want their money. I stand with her because she gave them a piece of paper and they gave her coupons. The paper only has value at a bank while the coupons have immediate value. They could’ve taken back the coupons instead of giving it to a creditor as she was full willing to give them back. But hey what do I know?

    I honestly didn't know you could sue a collection agency to have your name removed. I always thought the way to remove your name from a collection agency list was to just pay your bills in the first place. 😂😂😂

    Professional whitening sometimes is not recommended bc there may be visible bright spots where certain work has been done. Learned that from my dentist.

    What good is a teeth whiting product if doesn’t work. It doesn’t work on a crown so I’m not sure why the Judge agreed with the Defendant….this is the first time I have questions on the verdict with Judge Milan as I think she is great!

    Outside of small claims court, a one cent judgement gets the other party to pay all their legal fees. That alone can run into the millions.

    A lot of states have a 3 day period where you can change your mind if you buy something from a door to door salesperson. Its that way in my state, idk about other places though.

      I’m not sure what state you’re in, but that’s unusual. In every state I’ve lived, and under basic legal principle, a contract is a contract is a contract the second it is signed/“signed” (mailbox rule, etc.)

      @@michellethompson5755 Unless stated otherwise, sometimes there are clauses put into contracts giving people an amount of time to back out of the deal. I took a title loan once from a shady company who was charging an illegal amount of interest for the state I reside in, they weren’t supposed to give me a loan to begin with but the loan agent thought I was in Washington DC & not WA state when the loan was issued. They lied as well about the interest rate when we spoke on the phone but I was desperate & took the loan out without reading the contract too well. Thankfully there was a clause saying I could return the money within 3 business days & void the contract out.
