Specifically illegal to use in warfare because gas weapons cannot be used discriminately. Enlisted combatants of a legally recognized military force don't [generally/ideally] have authority to attack civilians and there is no specific, or predictable, target with gas based weapons systems. Also note that in conditions which limit access to medical care such as a warzone, the use of pretty much any gas weapon can result in unnecessary permanent injury even among combatants, enemy or otherwise. Not to mention that weapons like this when utilized on a military scale, can devastate the environment and kill-off wildlife en-masse [yes, even tear gas.] When law enforcement deploy these weapons, they do on a small-scale with the responsibility of processing and admitting to care; the suspects they manage to neutralize and detain along with any non-belligerents who are incidentally exposed despite not being the intended target such as bystanders and the press. [which is laughable at face value, but that's what is *supposed* to happen.] In short: if you authorized these kinds of devices in the theatre of war, you would end up with entire cities being smoked-out by the stuff when it's loaded into shells and bombs, instead of being loaded-up in small grenade canisters and thrown into crowds of dissidents. IMO: using spicy air as a weapon is cheating and a small pp move no matter how you use it, but the two provided theatres are too dissimilar to compare.
