  • Could the Philippines' 2024 EEZ Submission could kill the South China Sea Code of Conduct?

    Discover how the Philippines, in responding to its conflicts with China in the Second Thomas Shoal (Ayungin Shoal) has made a tactical error seeking an extended EEZ.
    By using the Sabah baseline, it revives a dispute over Sabah claim, a move that will strain bilateral relations with Malaysia. The submission has also introduced new problems in the overlapping claims in the South China Sea dispute.     By welcoming discussions with Malaysia and Vietnam over its EEZ submission but not China, the Philippines appears to be betting that this move would push Malaysia and Vietnam into negotiating separate codes of conduct with it. However, this move is very risky as it could erode trust and confidence among the claimant states and could cause the ASEAN claimants to go their own ways and deal with China. If that were to happen it would mean the end of the Code of Conduct and leave South China Sea /West Philliine Sea vulnerable to conflict. Ultimately this would spell disaster for regional peace, security and stability and ASEAN unity.

    Malaysia may never side with the Philippines in asserting its rights over the West Philippine Sea. Even when the Philipines won the 2016 arbitration which actually benefits other claimant states, was there any word of support from Malaysia? It is heavily dependent on china .. Asean is divided and will implode as a political group because its member states stand idle while its other members are bullied by china whose claim has been rendered illegal under Unclos.

      Everyone accepts the ruling of the court of arbitration. Only China objected. Malaysia, Brunei and Vietnam did not object.

    PH's strategy is the SCS with respect to its claim on the disputed reefs with China is to goad the other SCS claimants entwined with its dispute with China. By invoking the Sabah issue, PH has effectively recanted an earlier political settlement with Malaysia, an obvious tactic to complicate matters on the SCS with China. Perhaps, the PH is doing so on behalf of the USA in order to justify the US naval presence in the PH, and by extension the US involvement in the SCS.

    Sabah should be a non-issue. Philippines should not be overextending its diplomatic prowess in reclaiming territories when the country has more pressing concerns elsewhere. I totally agree with you in alienating other ASEAN countries considering the last 8 years or more the country has been riding a pendulum swing with regards to its stance towards the China and the South China Sea

      why Sabah is not a non-issue? Sabah is part of Sultanate of Jolo, Sulu before the Spanish colonized Philippine archipelago. Sultanate of Jolo, Sulu is the original Philippine territories compose of Palawan islands, Tawi-Tawi islands, Sulu islands and Northern Borneo called Sabah, most of the people in Sabah, Borneo speaks Tagalog the national dialect of the Philippines

      1. Sabah WAS part of Sultanate of Jolo but it was dissolved when its Borneo territories became British territories while the sultan of Sulu agreed to be a protectorate of the Spain.
      2. Most people of Sabah do not and CANNOT speak Tagalog. They speak Bahasa Melayu and their respective ethnic languages. Sabahan Chinese speak Hakka, Kadazan-Dusun speaks Kadazan-Dusun languages, Murut speak Murut, Bajau speak Bajau, Iranun speak Iranun, Suluk speak Tausug.
      3. The only time native Sabahans came under a government that represents their people is when they joined Malaysia as its own Federated territory. Not when it was conquered by the sultan of Brunei nor when the sultan of Brunei "gifted" the entire territory to the sultan of Sulu nor when the British successfully incorporated it to their North Borneo Territory.
      Get your facts first.

    Sir you have missed important on you history. The conflict start when China cease control from the Philippine of mischief reef , which china made artificial island and military base, thats why sheira madre was send in 2nd thomas shoal.
    About sabah, its long time dispute cease by malaysia to sulu sultanate ( sultan on Philippines) by renting the land now they dont want to return back to Philippines.

There is an agreement signed by sulu and British North Borneo Company stating that they give up their rights. Later the British North Borneo was replaced by the British government then Malaysia was formed from independence gained from the British government.
      The rights of the sulu to the land were given up a long time ago. They also signed agreements to give up their rights to Manila

    Very good unbiased narration of events, w a likely possible surprising yet risky reason for the Phils' asked extended shoreline w Sabah in it.Ever since Filipinos are nonchalant about Sabah issue & the heirs of Sultanate of Sulu are probably only ones keen about it nowt..Phils,Malaysia & Vietnam have partly of their EEZ sea encroached by China's dash line,same w Indonesia & Brunei. Phils & Malaysia's conflict over Sabah was not as highly adversarial as the Phils/China row now.Phils & Vietnam have common at times serious respective clashes w China's intrusions in their EEZ seas, & Indonesia too w China in Natunas area.Posture of the Phils seems it does feel as threatened when Vietnam partly occupied Spratly compared to strongly when China also partly occupied Spratly ...The 2nd Thomas Shoal is within EEZ waters of the Phils under UNCLOS to which China signed as signatory. Also 2nd Thomas shoal as well Spratly,Sabina Shoal , Mischief reef & others claimed by China are parts of Phil Territory embodied in Treaties of Paris & Washington (mentioned by P Marcos in Singapore speech) ceding Phils to US by Spain which treaties China said it accepts recognizes formally conveyed to the UN Permanent Court of Arbitration, yet will not participate in proceedings... Sizable damaged marine & coral life in Phils' EEZ waters due to China's heavy dredging, massive fishing w detrimental methods,harrassments to Filipino fishing & naval boats tolerated by admin of frmr P Duterte, prompted now P Marcos to take a strong stand ( agreed to by 80% of Filipinos in credible polls) to protect & defend Phils' territorial & EEZ sea.

      You have a valid point.Hopefully yours & others seemingly valid points raised in media which do not align or contravene to the Treaty of Paris amplified by the Treaty of Washington submitted by the Phils' in its contention to the UN Permanent Court before, will also be taken up now too in a likely UN meeting to discuss Phils' request for extension of its shoreline.

    As for me the issue of Sabah does not matter and should not be an issue because we are one people who have the same ancestral parents. The sea of Philippines is the sea of Malaysia, Indonesia, Brunei and Singapore and their seas are also the seas of these countries. I think these should create a law that allow our people access one another and inform our people that we are one people. Tell the people that we are the Indo-malay people and we are not different from one another.

      Am a Filipino,good to hear of Malaysia's airplane deal w KAI,you may need that as China's dash line includes parts of EEZ sea of Malaysia.To most Filipinos,Sabah is a dead issue & likely heirs of Sultanate of Sulu would be only ones interested.I think Phil govt may have other reason including Sabah in its requested extended shoreline as opined by podcast speaker.

    ASEAN member states must stand against China in one unison voice, Asean fragmented diplomatic approach is not strong in the face of Chinese incursion. Resist the Chinese bullying, aggression and intimadation against Asean states, with one united voice, china will think twice. With out unity, China will still persuade to continue to assert their illegal activity and bullying tactics against ASEAN states.

    Sabah Claim
    Historical Context:

      Actually the issue is not black or white. Claimant states are not trying to appease China. All of them have protested against the 9-dash map. All of them do not recognise it. But China is prepared to talk. Why not take that route. The UN adjudication path is not going to produce tangible benefits.

    I think Malaysia should not worry about this because Philippines, Indonesia, Brunei, Singapore and Malaysia have the same ancestors or ancestral parents. In fact, it is possible that 100 or 200 years from now these countries will become one as these countries attempted before to form one country known as MAPHILINDO which stands for Malaysia, Philippines and Indonesia. Indonesia really wants to unite us as one. If these countries will become one then the leaders or the Prime.Minister or President could be from Malaysia, Indonesia, Philippines, Brunei or Singapore.. Everyone knows that the name Philippines has nothing to do with their bloods and ancestors because Philippines are Indo-malays just like Brunei and Singapore. We rather help one another to ward off China from the Indo-malay territories. Remember we have the same ancestral parents. Look at Indonesia, Brunei and Philippines they look up each other as brothers with strong close relationships. Philippines and Malaysian politicians should set aside their personal interest and rather think for the good of all Indo-malay people because we are great people...
