The "wire with the curly bit" gets pulled around so that it is as close to the handle you use for winding. Then it clicks into place. Also the farther away the ball of yarn is, the better.
Yes unfortunately with this one I pulled it as far as it would go and it wouldn't stay whatever I did. I think it was a dud one, so I've returned it. Good to know they aren't all like that though! Do you have one?

If you pull out the yarn guide firmly it will stay up it just needs to slot into its spot
