      I hear what you're saying, but it's irrelevant. Whether there was a hurricane or not, whether the plaintiff told him not to worry about the money (because of the storm) or not, he still lived there and so must pay rent. She was also correct the plaintiff shouldn't be liable for the defendant using community property, and subsequently being fined for it. The "interrupting, impatience, & exasperation" was just the icing on the cake.

By staying in a property and not paying for it, the defendant is making the plaintiff into the victim of the hurricane. That's not fair.
      Lots of people had to do some serious work and overtime after a hurricane, including law enforcement, paramedics, rescue workers etc. - all of whom were paid for their work.

    I can kind of understand not paying rent when a hurricane is on the way. It takes money to leave. It takes money to stay. If your job closes you don’t know for sure when you will get paid again. You are supposed to withdraw some cash because if the electricity goes out you won’t be able to. For about a week after Katrina cash was useless because everything was closed. Then I remember having to shop in a Walgreens that didn’t have electricity and the manager was ringing people up with his solar calculator. He would let us customers into the store two at a time. We were so grateful.

    Does anyone know what statute the defendant is referencing? After searching a bit, the only thing I could find is that in the event that the residence is sufficiently damaged, then the contract/lease is terminated. But since the defendant keeps claiming to have “protected the property”, that means it wouldn’t have been damaged enough to warrant their lease being terminated. And thus, they’re still liable for October’s rent (on top of September’s, which doesn’t sound like they were being absolved of and just that they were given an extension on).
    But yeah, if anyone knows the laws there better or has a better idea of what to search, I’d be interested in learning more about what law this defendant thinks is going to justify not paying two months worth of rent on top of any other damages that he incurred.

    • @TheFlowerQueen
      @TheFlowerQueen ปีที่แล้ว +1

    It was the responsibility of the condo's *owner* to prepare and protect his own real property~not his renter's. This defendant not only was acting on the instruction of owner, exhausting what ltd funds and using the few resources made available to him, in an effort to secure and prevent damage to owner's property. He had also paid every month for four years before disaster struck and simply lacked a safety net~since, like so many today he lived paycheck to paycheck merely to house and feed his children (more than I can say for some fathers). However the attitude of JJ (who owns $50M real estate portfolio incl luxury homes in FL, NY, CT, RI and CA) toward this defendant's hardship was, 'Well my $10M winter home is in Naples too~and if I can fly my private jet to one of my other mansions until renovations are complete then you should be able to too!" (Nevermind that in the aftermath of hurricane it disabled nearly all housing and lodging, utilities, roadways, emergency supplies, grocers, hardware stores, support services, gas stations, vehicles, buslines, banks and even airports) I love JJ but she can be painfully out of touch with responsible everyday people who may simply be without the same financial cushion, good health, success or privileged life she's enjoyed. It's disappointing when she fails to discern even between welfare scammers, freeloaders, squatters and those who abuse the system.. vs decent people who~even after years of working hard, paying their bills on time, supporting their families, paying into SS, repaying student loans~may at some point thru no fault of their own be disabled, laid off, suffer a personal tragedy or even face a natural disaster (I've lost count how many times she's shamed someone in her courtroom for being on SSD calling it 'welfare' despite being unable to collect a dime one hasn't paid into SS system) Many of whom worked as hard or harder than her until struck by an illness or accident. It's wonderful she's enjoyed the health and strength which allowed she and her Hb to cont working, raising a family to provide them with financial security. I'm sure encountering her share of deadbeats in courtroom makes it even harder to remember not everyone struggling is lazy, irresponsible, dishonest or shifting blame. Sometimes LIFE happens. God is love +

      yes it is the owners responsibility but the owner actually asked the defendant to move out so if he wanted to do any repairs or not, that was his problem. the defendant had been late many times in the past, that's why he was asked to leave. he was supposed to pay rent on the 1st and was already late, then he used the hurricane that happened over a week later to not pay his rent. he then chose to stay there another month in what he called an uninhabitable place with the excuse that he was protecting the property. he would've come up with another excuse and reason to stay another month and not pay rent again. you have gone on and on even attacking JJ but the case is simple and like she said, he is a perennial victim
