No, it’s not because the show would have to pay for it. Legally, he’s not responsible. A crime was committed and even though he knows and is related to the person and it took place in his house, that actually doesn’t make him legally responsible. I would have loved to see this guy have to pay too and I think so would JJ, but she has to follow the rule of law, even when she doesn’t like it. I hate that about this profession.
Unfortunately without a witness or evidence, her saying that he said his brother stole it (which is often considered hearsay and something JJ usually says), there's not much JJ can do. If he told her that his brother took it, she should have reported it, not sue the defendant.

The problem is the plaintiff should have sued the brother, not the defendant. The plaintiff was operating under the misconception that the defendant would be liable because it happened when the watch was at his house. That’s not true because a crime was committed. If the brother was a minor under the defendant’s control, it would be a different story, that’s why she asked his age. A full-grown adult thief committed the crime so he is the one who has to be sued in order to recover damages under the law.

All they have to do to find out where the watch is, is to log into the apple account and use the "find my" feature.
