Did you know that some Saudi men travel to India, Thailand (the southern part), and Indonesia for what they call "short marriages" but it is prostitution? A lot of young women without proper knowledge of what they are getting into did not realize they left high and dry after a few days or months. These men usually travel in groups and they have agents in these countries. Even young children are engaged in these activities. Most wives do not know or they turn a blind eye as long as they are in marriage and as long the husband is not going to them as wives. They are shut up by their male mahrams and female relatives.

I remember learning of this practice in Hydrabad Dhakan back in the 80’s and 90’s. These dirty old men from the gulf states would travel to India to take advantage of the poverty there and contract Nikah’s with underage Muslim girls as young as 12 years old and pay the parents a ‘mehar’ in exchange for staying with the daughter for a week or fortnight, after which they would talak her and go back to their country. So many young girls lives were ruined to help her struggling parents put food on the table. These men did this with impunity, with the aid of the local mullahs who officiated and brokered these so called marriages of convenience.
Reminds me the concept of having a girl friend on the side while being married.. something out of a mafia film or something.. The good wife at home that don't ask questions..
In "normal" Islamic marriage, there is no mention about the length of the marriage, BUT ...the husband can divorce the wife by saying "talaq" three times (the wife can not do that). So, in a way, normal marriage is worse because the wife can be divorced at any time by the husband while in misyar or mut'ah marriage, the woman understands that the marriage is temporary. At all of marriage types, the women only get paid by the dowry and some living allowance for food, accomodation, and receive nothing when divorced. So, the cost per sex can be much much cheaper than being with a prostitute.
Misyar marriage, unlike Mut'ah, doesn't have predetermined length.

There are people who say that they don't mind marrying a second wife, but they can't afford it. These men typically consider the age and looks of the women they might marry and often believe they're doing them a favor by having sex with them - even when it's unprotected. They might not take responsibility for any children that result from these encounters, but the women involved are left to deal with the consequences of their decisions. This can be particularly difficult for women who are already struggling with being unmarried and may carry the burden of these experiences for the rest of their lives.

The first question that comes to mind is - is the 2nd, 3rd or 4th wife to be aware that she is entering a Misyar Marriage? If so, then that is a risk both parties have assumed before entering into this contract. If not, then that is exploitative indeed. The burden of disclosure should fall upon the man entering this arrangement.
The second question I'd ask is, if the woman knowingly enters into a misyar marriage, is she taking the necessary precautions to prevent unwanted pregnancy? Is the man taking precautions to prevent himself impregnating her?
It is exploitative even if she knows. Because she's only accepting this kind of marriage because of the limitations that this religion and culture impose on her. She might feel that nobody wants her for being too old, divorced, unattractive, etc. Or maybe she's got feelings for him, she wants to show she's understanding of the man's lack of financial capabilities and he uses her kindness against her.
From what I understood of the video as well as I what I already knew... a true 2, 3 or 4th wife follow the rules of a nika marriage.... ie: they are not temporary, the husband must provide for all his wives etc..... whereas the misyaar 'marriage' is an excuse to get some on the side, from what I can tell.. even more disgusting than the nika version, if you ask me.

Thank you very much for talking about this and I would like to add something more. Secret marriages are used to clean up statistics and give the impression that polygamy is way less common among Muslims than it actually is. It's definitely not only 1% of couples that experience that, like some argue. Just read an article on this topic and apparently in Germany it could be as high as 20-25% of Arab men that get a second wife. Usually the first wife knows nothing about it. It's very frustrating when I try to talk about it with Muslim women who don't want to admit how common this is, when every Muslim man has told me his father has two wives, or a relative, or a friend. In Egypt, this kind of marriage has been made formal and facilitated and it's called orfi, I guess because Hanafis don't always need the wali's permission. It's a sad situation 😞

One minor point: Yes men and woman all want sex, love, companionship etc. It isn't as binary as he wants to make it out to be. However, there might still be some play of biological differences between men and women, when we are discussing something where (literally) hormones are invovled. Oxytocin, estrogen and testosterone do have a role to play in thnigs like libido. It isn't just a matter of gender socialization - not purely, anyways.
obviously, that doesn't mean we need to cling to medeival ideas about gender when thinking about how we want a legal and social insitutition to work.

There are many Arabs who come to Indonesia and 'marry' local Muslim women. For several hours, days, weeks or months (depending on the man).
Then, because divorce in Islam is so easy (just say 'I divorce you' 3 times) the man divorces the woman... With suitable monetary recompense.

This is interesting, how do Muslims view marriage? I am a catholic and this just does not compute. In Catholicism, marriage is one man and one woman come together and become one flesh, it is one of the seven sacraments, i guess similar to the five pillars of Islam. There is no divorce and the only way to get out of it is to get annulment, basically the marriage was never valid because you were to closely related or some other impediment.

Well you should know that the only reason Misyaar marriage is Halal is because it fits within the general rules of marriage in law, on condition merely that it fulfil all the requirements of the sharia marriage contract:
The agreement of both parties
Two legal witnesses (shahidayn)
The payment by the husband to his wife of mahr (dowry) in the amount that is agreed
The absence of a fixed time period for the contract
Any particular stipulations (shurut) which the two parties agree to include in the contract and which are in conformity with Muslim marriage law
And Muslim scholars or any else do not have the right to stop two people from getting married as long as they fulfil these conditions so it’s only “halal” because it fits in the laws of sharia but it’s highly discouraged and no body that knows what is best for them would be doing this.
It’s like a country saying they don’t like Muslims but they can’t really do anything about it because there is religious freedom in their constitution.
Easy: its halal because its a marriage that SUITS the woman, ie its a marriage that is convenient to her. But the only way it’s convenient is because she is unable to commit full time for various reasons meaning EQUALLY that she is unable to get her husband and her rights full time which could come at a detriment to her which is why its not advised. She is choosing to be devoid of a full time husband for an EASIER life In other words yasir qadhi is saying its better to be like the western woman and live like a dog in afull time marriage trying to juggle everything. It’s like a tax loop hole. Or other loop holes in laws. Yes it is wrong but it is very difficult to legislate against because of the principles around it. This isn’t unique to Islam. With increasing age, women are worried about their limited fertility. And then increase their compromises.
And will be more willing to enter Misyar esp if they are financially strong. But to be honest it feels like Islam favours the man, from birth inheritance and marriage. They can have 4 wives and men are using it to their advantage, often in secrecy. If the first wife comes to know, she is reluctantly having to accept it either bcos she is financially dependent on him, she has children or better still bcos Islam says it is halal
