    It took exactly 6 months for my 100% rating for agent Orange exposure in Nam . It was back dated and the first check was ginormous !

    due to the pact act claim that the VA granted me 30% for sinusitis (from burn-pit exposure in Afghanistan) and 10% for rhinitis, i finally got my 100% P&T status.

      Damn I put in for my sinusitis and Rhinitis for my time stationed in Bahrain....had sinus surgery and it didn't work....hopefully I get what you got and that would put me over the top

      @@expectnolove9978 I’m sorry to hear that. But you need to go to Va consistently and asked for allergy medicine and nasal spray, that’s what I did and got granted both , on my first time filing.

      @@NavCom209 I filed the pact act on my own. But I went with medical trajectory to help me with my migraine claim. I was stuck at 30% got up to 50%

    This is great! Thank you. One of the biggest things is/was, that although it's presumptive, you will still be denied if you haven't been diagnosed with whatever you're claiming. You can file an "Intent to claim", and then go through the process of being diagnosed, or, vice-versa. But no matter what, you need a diagnosis of "said" presumptive claim.

    That’s the thing .. for some of us that have filed for PACT Act presumptions prior to the law , it’s a shame to not be able to have the proper retroactive date (which may have been years ) rather than just one year of back pay. 👎🏾

      You serve Country, do everything except from you and much more, they cover it up and lie, they lie to you before you even begin training. Agent Orange was used everywhere, and stored in the U.S. military and U.S. Department of Agricultural/ Forest Service, B.L.M. they are living about what they have done to all Veterans.

    Why is a payment considered a "grant" and not a paid out adjustment on the case? Thank you for standing up for the veterans and giving us a voice. Documentation beats conversation every time. i've been contesting my case with the VA since 2014 when i officially retired, I had to get a lawyer as my VSO, my case made head way, i got tired of dealing with the VA. I submit paperwork or the PACT Act still awaiting a decision. They diagnose me with medical problems the issues are cyclical but when they come on its bad. News like this gives me hope you and the other channels like this keep me informed and in the fight thank you again

    I filed my claim at the end of April had my exams at the end of May and was 30% Service Connected for Asthma in early June. The crazy thing is. I didn’t file a claim for Asthma. I mentioned Asthma in my statement for Sarcoidosis and had a C&P Exam for it separately. The Biden Administration is DELIVERING the PACT Act for Vets in a major way.

    I am a Vietnam era veteran but have never been to any of the geographic locations in the PACT act. I did, however have to handle other toxins an an almost daily basis without being provided any ppe like rubber, chemical -proof gloves or breathing protection. Those include PCBs, Trichloroethylene and PFAS. What I keep hearing is that burn pits and Agent Orange are the marque toxic exposure and the VA is not granting service connection for any other toxic exposures. I have 6 of the conditions on the presumptives list whcih every doctor I meet finds extremely odd because I have the "weird" ones. Neurological issues, heart electrical problems, stage 4 metastatic prostate cancer, pancreatitus, insulin dependent diabetes, porophiria cutanea gravis, non-malignant growths of the neck and thyroid. I also have some conditions caused by or exacerbated by VA medical or administrative malpractice. All hear is "gee, well, too bad for you"

      How did you get P&T for prostate? I got 100% for prostate also but not P&T (I'm a Vietnam vet stationed Thailand) I'm also 75 years old and have no intention to have my prostate ripped out. Currently on Active Surrvalance.

    Denied all of my PACT Act claims, documented and proven medical issues, I live in Indiana and the Regional IN Office has been cited by the Inspector General of the VA for many illegal actions, just appealed the claim six months ago. At 69 I have to wait one more year and I at the head of the line.

    IN my research I found an EPA study that said that until 1988, the disposal of hazardous wastes was left to the discretion of the base commander but mis handling of HazMat continued well into the 1990s. I was in the USAF and they used to practice fighting aircrft fires by dumping a few hundred gallons of JP4 jet fuel on the ground and then putting it out with the foam which is laden with PFAS. You can't tell me that never found it's way into the ground water if you had been doing that since WWII.

    The cutoff for Guam is 1980. I was there from 1989-1991 and spent plenty of time playing war games and in the jungles around NAVCAMS and Andersen AFB and have conditions that would be covered but for the dates. Yet the EPA has reported dangerous levels of dioxin remaining in the soil as recently as 2018. What hope is there for a veteran like me?

    I have been service connected for three (3) PACT Act disabilities; however all were rated at 0%. They are hypertension, multiple skin cancers and scars resulting from the the cancer removals. At my C&P my blood pressure was below the threshold. I have been on medication for that since 1996. The skin cancers have been removed, so I understand there is no longer cancer. The scars did not cover enough cover enough square centimeters. I was just curious if the VBA is reported what ratings they are approving the disabilities; I have not seen it on the VA Dashboard.

    A few things to consider
    1. Continously pursuance is definitely something to consider for an earlier effective date IF the law supports it. The VA can't pay you for a disability in 2010, when the law wasn't in place at that time. Nor does it stipulate a time prior to August 2022
    2. AO exposure under the PACT ACT only adds two new contentions, but it does expand the area of exposure
    3. GW & 9/11 vets have more contentions added. It's important to note that the claimant needs to be reviewing information pertaining to their time in service
    4. The M-21 & CFR are public knowledge. They tell exactly what is required for a grant of a disability
    5. If you are already paid at the 100 percent rate. It may not be beneficial to file a claim. Meaning if you are permanent & total at the 100 rate since 2013 ( 10 years) then your spouse can typically get the highest death benefit payment no matter what the cause of death. Thus doing a claim while your right would be futile.
    6. Understand your VA Math & know while your combined rating will never say more than 100, there are ways to increase your monthly benefit
    7. If you don't fall under the PACT ACT look up Occupational Hazards & have a board certified specialist write you a nexus letter

    Do you have any insight into how the mass torts for veterans affected by AFFF/PFAS & PFOS will be impacted by The VET PFAS Act (presuming it is passed into law) and vice versa?

    I filed the day after Biden signed the legislation. During my C&P phone examination the guy interviewing me kept repeating over and over again in amazement as to the amount of high blood pressure medicine I was taking. When I got notified with a deposit in my checking account and then received an award letter, they gave me just 10%. That plus 30% for PTSD brought me to 90% thanks to the VA'S Fuzzy Math. I think they purposely low-balled both so that I couldn't reach 100% total disability. That's okay I've got more claims to file on them anyway. And by the way all my disabilities our Agent Orange or PTSD caused.

    Was just denied rinositus due to preexisting before entering service even though condition worsened due to working with Jet Fuel.

      Denied my Leukemia under PACT. But conceded toxic exposure, conceded Sw Asia service in Gulf War, and conceded I have a disability. Yet currently only “lymphomas” are covered under PACT not leukemias.

    On April of 2023 the VA sent me a letter with a list of the qualified cancer conditions for the Pact Act. The cancer I have was not on the list (CML leukemia: bone marrow cancer). Bone Marrow was mentioned but it was for lymphoma not leukemia. I filed an appeal for the Pact Act twice with the VA and they said there would have to be a link between my service connection and the in-service disease. I spoke with my oncologist about this and she said that I have to wait until the VA put leukemia on this list. Someone did make a comment on getting my oncologist and my primary care doctor to find a link to my service connection and the in service disease. I'm going to look into this next week. I just can't believe because I have leukemia cancer and was exposed to toxic while in the Navy and my cancer is not on the list I cannot get the Pact Act. The VA already knows I was exposed to the toxic and I was at desert Storm.

    Is it for Gulf War syndrome? I only got 10,% for asthma and 10% sinus nothing for allergies Strokes rash Strokes arthritis fibromyalgia fatigue and many other things and I had asthma and sinus on my separation physical February 93!

    Maybe CC&K can answer this: I called the VA hotline, they told me to write in "symptom - PACT Act" in the supplemental or original claim paperwork. Have you heard this to be true? As many have written below, I have a "0" on rhinitis and sinusitis, "denied" for chronic fatigue even though the decision letter stated I am TERA and service area "conceded".

    Does the PACT Act also cover exposures to radiation and other contaminants like PFAS such as aqueous film forming foam (AFFF)? There have been quite a bit going around about that lately and it is rather confusing.

      @M K. The PACT Act doesn't address PFAS/PFOS exposure. However there is a Bill in Congress currently being debated, that specifically addresses veteran's toxic exposure to AFFF. If the Bill passes and is signed into Law, several specific cancers and other diseases will be considered presumptive conditions. Currently everything on the specified list is handled on a case by case basis. If passed, veterans will be entitled to receive medical treatment, be reimbursed for prior medical expenses, and, if other legal remedies for compensation are exhausted, may be eligible for VA Disability Compensation.

    I was anNBC nco at ft.Bliss for a few years. I ran my troops through a gas chamber alot. Does this count in the pact act. I've got hypertension.

    Thanks for the video. I have a question. I have one of the presumptive conditions, but my exposure was not in the presumptive time frames outlined in the PACT Act. Three different people told me I should still file a claim; my PC Nurse (who screened me), a VA claims reviewer, and the VA Hotline. I filed the claim. What are my chances of getting it approved? I am currently at 70%

      Hi@michaelberry, I too have the same situation as you. I filed for the Pact Act for a cancer condition but my cancer was not on the list for Pact Act. I have CML bone cancer but it is leukemia and not lymphoma cancer. The VA already knows I been exposed to toxics while in the Navy and I even discussed this with my oncologist and she said to wait until the VA put leukemia on the cancer Pact Act list. I do plan on seeing my oncologist to type up a link between my service connection disability and the in-service disease. As I said earlier I have bone marrow cancer and was exposed to toxics while in the Navy, just because my cancer is leukemia and not lymphoma cancer doesn't means I cannot get the Pact Act. I was still exposed to hazardous material while in the Navy no matter what and I am entitled to the Pact Act.

    am a 100 percent p&t i been told if you don't want the va to change your rating be happy with what you got and don't ask for more, if i try to open a claim for this because i was exposed back in 04 and 06, it might come back and bite me and reopen my case and lower my disability?

    I can answer that the easy answer is NOPE! I applied for rhinitis and chronic sinusitis(currently being treated by the VA) one was denied right away they acknowledged that I was in the theater of Iraq/Afghanistan & exposed to burn pits but NOPE my conditions were not caused by my exposure during duty & the other claim has been in "looking at evidence" stage since Oct 2022, if you're not disfigured don't was your time!

      This is 100% not true. I just got connected for presumptive asthma under PACT Act. In fact they viewed my claim as “NEW” and got 30%. File as many claims/appeals as you want until you’re 100% connected. Location. Diagnosis. Documentation. Should get you results!

    I was located in classified location within Egypt and close to Red Sea during Gulf War (Jul - Dec 1990). The rater denied me said I wasn't in a Gulf war location while my DD214 says I was. Also, Egypt was left off his eligible locations. This is why I was denied!

    Kinda' sad that we are now entitled to benefits from situations from the '60's. In my case all the proof of conditions on hospital records are now destroyed by the hospital after 10 years. Two hospitals with massive amounts of treatment have destroyed their records and now I can't prove the conditions.

    I have had 3 cancers since I got out. The VA diagnosed me, treated me and I was even hospitalized for my liver cancer. Get this… liver cancer was service connected but skin cancer and breast cancer was denied at the SAME C&P dr. I was denied for congestive heart failure, liver disease, kidney disease, hypertension and others. I don’t get it.

    I am interested to know is a secondary condition (sleep apnea) of a Pact Act-approved, service connected condition (Acute sinusitis) also considered a Pact Act claim as well???

      Thanks for explanation. Our “Modernized VA” (still like wrestling an oversized dinosaur) accepted sleep apnea claimed secondary to VA PACT-approved Acute sinusitis. Claim had a DBQ, Nexus letter citing linkage between sinusitis and sleep apnea in 4 longitudinal studies, completed sleep study, prescription for CPAP (appears 50-percent). VA ordered 2 separate ACE Exams, 2 separate Independent Medical Opinions, presumably to refute expert nexus and DBQ findings? Then after 254 days of waiting, VA denies claim saying it was not direct service connected. Duh, really. The claim was connected on secondary basis to SC Sinusitis. VA denial had zero-0, analysis of medical evidence supplied in support of the claim. So, filed Higher level review (HLR). Two (2) months later, still waiting for VA to cherry pick case from rack of HLRs. So, the unsupported denial, where evidence at least reached equipoise, and HLR filing which goes to the supervisor that okayed the first incorrect adjudication of case….and we wonder why the big backlog, why vets are so discouraged with VA tripe??? This illustrates the problem.

    I did get my sinusitis claim approved in July last year a month before the PACT ACT was signed into law. I symptoms have worsen. Do I resubmit the same claim under PACT ACT, is there a certain form I need to fill out to get re-evaluated?

      YES! For some crazy reason my Asthma Claim was received/reviewed as NEW. File using the diagnostic code for Asthma. If you have documentation that the condition has worsened you might get an increase. You have to state you are a veteran of South West Asia and that you should be service connected under PACT Act!

    I had malignant melanoma, it was removed and left me with a painful scar. VA just rated me 0 percent for scar, no mention of the melanoma since it was removed. Took 8 months.

    The didn't do anything for me. I only got 0% for Rhinitis. I have a lot more wrong with me than that. I lost 20% of my left lung in a thorocotomy surgery. I daw three epidemiologist and all said they have no clue for my problem, but the VA put it down as pneumonia. B.S.

    If a person has a 100% rating. Will a person be able to get more money for the new claims? Or can you just ignore the pact act since you already have the 100% rating. Could this new claims knock you down from your 100% rating. I have heard that putting a new claim could reduce your rating.

    Dad served on board in Johnston Atoll and Vietnam. He filed for Agent Orange and was denied before the 1st set of presumptive conditions were approved in 2021 because Blue Water Navy was not included then. He was able to pursue it again afterwards but was denied because the VA could not locate his ship's locations in Vietnam. I found this odd because even on the link to ships from the VA Agent Orange site, his ship is clearly listed along with locations within 12 nautical miles from shore. Unfortunately, Dad has since passed as well as Mom. Are we as his surviving adult children eligible to pursue the Agent Orange claim in his stead now that Johnston and Guam are included?

      "Inscrutable" things like this happen. For example, some time back I recall reading about a vet who was sent to Afghanistan (?), then later on after getting out of the military he applied for VA Disability Benefits. He was shocked to learn the VA "had no records" that he ever was there. His wife had to send the VA personal pictures taken of him over there. Absolutely amazing...

    No, they suck! My spouse walked through toxic waste, a mile, twice a day for 5 months. He saw dr for chronic cough after deployment. When he tried to file - VA said come back if you get cancer!

    Just one question....why is the law firm is not talking about people being affected by the contamination at FT. McClellan, AL Given the fact that soldiers are affected by theses toxins while training or stationed at FT McClellan, AL. Why only Camp Lejueng.
    Simply NOBODY what to talk about FT McClellan, Is it because people get in trouble for that?

    I have 50% sleep apnea and I applied for new condition fact act claim for my diagnosed asthma,copd but they combined it to my 50% sleep apnea Is there anyway this condition to be separated ratings?

      No, the VA doesn’t allow multi symptom ratings on a single or related area of the body. It’s to prevent triangulating on the rating system. Because each symptom effects/worsens the other, so they are lumped as a single rating and the highest rating of the different issues is the one you get

    Filed for High Blood Pressure but was denied because blood pressure was not over 160? The reason it is not over is because I am on two different meds to control it for the last 20 years. I guess if I want this I have to go off my meds for 6 months so it will go up? Dumb...

    I am 100% PTSD. Law firms in the past, have refused to represent me, because of that. I have filed several PACT ACT claims and the VA have denied all of them up to 07/2023. Because I am 100% how do I expect lawyers to help me with my PACT ACT claims?

      Just know that once you are 100%, any other conditions you have, you will not be able to get compensation or a rating. That rule needs to be thrown out of the window.

    I fail to understand the logic/fairness in the eligibility requirements of the PACT Act in relation to the (1) geographical location of the toxic exposure, (2) era in which a toxic exposure occurred, and (3) the specific type of toxin. In my mind, a toxic exposure is a toxic exposure, regardless of when, where, and specific type of toxin. In 1981, while stationed in Germany, I was exposed to solvent-based Chemical Agent Resistant Coating (CARC). This early version of CARC paint contained lead, hexavalent chromium, and double the amount of VOCs (volatile organic compounds) that the water disbursed version of CARC contained that was used during the Gulf War era. When I called the VA to ask for chemical exposure testing, they told me that I did not qualify under the P-Act for testing because I did not meet the eligibility requirement of geographical location (Germany) and time (1981). What??? I have medical diagnoses from my private physicians showing I have lung nodules, bibasilar acteletasis (collapsed lower lungs), allergic conjunctivitis, nasal polyps and cysts, severe sleep apnea (with a prescription for a CPAP), hearing loss, and tinnitus. I’ll be filing an original claim next month, but I’m not looking forward to the battle ahead with the VA. As a resident of Texas (Cedar Park), I am glad to hear that CC&K is now in Texas.
