      I APPLIED IN 2002 WHEN I WAS RATED UNEMPLOYABLE BY SSI. I WAS STOPPED BY HOSPITAL. THEY SAID IF I CONTINUED THEY WOULD CUT OFF MEDICAL.
      I WAS AWARDED 100 PERCENT IN 2009 AND TOLD I COULD GET BACK PAY TO 2002. I'VE BEEN TOLD ITS BEING PROCESSED FOR AROUND FOUR YEARS NOW.
      I ALSO HAVE ISSUE WITH OVERTON BROOKS WITHHOLDING MEDICAL HELP.

      I've been rated 70% for almost 6 years now and I was awarded permanent and total status along with my tdiu back in July 2019. Do I ever have to worry about having my rating reexamined or reduced??

    I was rated 100% (not P&T) for my ankle/foot with gout and arthritis. 2 years into my rating I received a notice for a C&P for possible P&T upgrade. Went to my C&P a month ago and they couldn't give me an answer so they contracted LHI for another examination. Went last week and now waiting on an answer. I'll report back. Wish me luck fellow veterans!

    I received 100% T&P and I didn't ask for it and didn't find out about it until 10 months later when I decided to download my disability letter.
    However I was 100% for 5 years since I was 33. By 37 I was T&P. The VA has been good to me.
    Although there is a dark side. My life has been horrible. It's not easy living with the these disabilities. I would rather live a normal life and not disabled.

      Agreed, what combat area did you serve in? Afghanistan vet here. Was to patriotic to file any claim because I felt I didnt do Jack. Although I was exposed to being blown up or shot at on a weekly if not daily basis...

      @@nateb-runs5053 I was in Afghanistan and Iraq for a total of 3 years 10 months deployment time. When I got out I never knew about the disability claims or the disability world really. I think I got a letter In the mail saying that that I was eligible or something so I made an appointment and went. No prep no knowledge. They first awarded me 70% from the get go, then a couple years later went to 80% then a couple years later 100% then 5 years later P&T. You should definitely go, symptoms don't always show up immediately they can worsen as the years go on like my case.

      @@nateb-runs5053 , there is no dead line really. I got out in 1992 and didn’t make a claim until 2020. I started at 70% and now I’m 100% P&T.

    I'm am a combat veteran with PTSD. For thirty years I sent claims and they would only increase by 10% in Texas. We moved to Washington DC and I was given the 100% permanent disability. I am convinced that people down in Texas, are not very kind to veterans putting claims, or they think they are lying or even that "Hey, going into the military is what a Texan is supposed to do anyway, so deal with it". I had many people thank me for my service in Washington in one year.....and none in Texas in my Thirty years.

      Idk evaluating claims is based off specific symptoms that you state to have even if they didn’t like you a 10% is what you pretty much get when you have a service connection and you told them you don’t have any problems going on

    One of the best ways is to look for the words on you awards letter if your disability if states your rating is listed as dynamic or static. Dynamic means changing and Static means the same or non changing.

    I went from 70% PTSD, after my parents passed away and I had an appointment for it, and dropped to 50%, then I had an appointment 5 years and it went back up to 70%

    If you are a veteran and have an appeal with the VA CCK is the best! They secured me 100% p&t. It took a while, but they never gave up. I appreciate them more than they will ever know.

    If you are 100% p and t, there is no need to file new claims or an increase! No need to poke the bear!!!!

      I am today 80/20=100% before that I was 70/30% 16/17 years, that changed in 2016 from prostate cancer agent orange; and agent orange keeps causing health problems for me, so, I have filed a claim for nerve damage, hearing loss (hearing surgery both ears implants hearing aids stopped helping), and now vertigo plus tremors nerve damage. VA has all the data on my conditions declines; doctor authorized visits by VA. 22+ years rated.

      That might be in some other cases but not for me! Agent Orange a continued damage to me. For 22.5 years 70/30 for 16/17 years, in 2015/16 prostate cancer surgery, I was told through two tests a lot of nerve damage agent orange, now I’m having internal tremors plus hearing loss, what else is next on the menu? Hearing implants in 2020 left ear, in 2021 surgery in the right ear. So because prostate cancer went to 80/20 in 2015/16, I was told by a VA employee file again you should be 100% as a Vietnam veteran. Here is a word medical - Demyelination. Please look it up. My nervous system is damaged by AO getting worse by the month by the year, and I will poke the bear. Plus, I refiled for PTSD and was denied 22.5 years ago ten years of therapy - poke the bear. Agent Orange tremors may be a sign of Parkinson's Disease. I am scheduled for an examination on July 28th; a C&P examination Internet on July 12th, for PTSD. I was denied a PTSD claim in 1999, it was the same year I was awarded 70/30, in August 1999.

    It's Never permanent. The VA will change the rules to suit their needs.

    I received 70% disability after appeal for MDD from service connected tinnitus and hearing loss. My attorney asked my OSA claim to be dropped despite VA diagnosis and prescribed BPAP. She Indicated it could be seen as a frivolous claim. I am 78

    You didn't mention the additional problem of veterans rated for conditions secondary to tinnitus (like insomnia, migraines, depression ....). Without the primary rating, there can be no secondary. A reevaluation could result in a catastrophic trickle-down effect if tinnitus is removed.

    My husband received permanent disability for juvenile diabetes when he was 27 yrs old. This was in 1989 before the disability act went in effect. Believe me he wanted to be a lifer and was denied because the disability act was not in effect until 1990.

    Thank you for the information. I've been getting pulled around by the St Pete VA for years and only just gotten them to finally admit service connected rating of 90% after nearly 20 years of having my conditions treated on my own and being denied by them. it wasn't until I gathered every note and exam and treatment from all of my caregivers, over the years, and resubmitted 18-19 years later, that they gave me a combined 90%. Prior to that, they were only giving me a 10% for skin conditions which was questionable if I actually had but it was the only way they could categorize it.

      @@dennisyoung4381 Oh, I know. I've been suffering from them for the past 20 years and fighting for all that time to get things rated. They like to rename issues and deny them and it's taken me 18 years of being treated by my own physicians and gathering years of treatment records to prove my case. I just got a 3% rating for my feet, after 20 years. It took me 18 years to go from 10% for a condition I truly have never had, to a 90% for a combined rating of what I've been trying to get rated for, and now, finally, I got rated for my feet at 30%, which only added 3% to the 90 combined. St Pete VA has, probably the worst record of veteran treatment within the system. It's no wonder they also are treated that way with their Raters.

    I'm at 80% from tinnitus, AO exposure type 2 diabetes, along with peripheral neuropathy in both feet & legs. Now, I have diabetic retinopathy is both eyes and am now also insulin dependent. Are diabetic AO related issues added to a claim something I should be concerned about?

    Such as relocation of a bicep, and removal 10mm of a clavicle? Or 6in of titanium that was used to repair a spiral fracture of a fibula? Or say a submuscular transposition of the unlar nerve...and the numbness and nerve damage associated with the procedure?

    I had a reduction in my asthma rating because it "didn't get worse, but it didn't get better." That was after the initial rating in 2012 and the review in 2017. I lost my appeal.
    I was moved from 50% to 30% and moved me from 70% to 50% overall. It did end up getting worse a couple years later, forcing them to changing it back, but, yea, they did reduce mine because it stayed the same.
    I am hoping the recent PACT bill passing will prevent them from lowering it again (hopefully raising it, actually) because I am on the burn pit registry.

      all meds needed especially

    10 years ago was rated at 80% service connected and I’ve had no other rate changes I do doctors visits twice a year changed it to once a year this last time. I’ve had major difficulties in the last three years with PTSD and anger management. When received my benefits at first I was told the reason I wasn’t 100% was because I was still working over the road truck driver. And at which time I felt I could not work anymore I can refile for the other 20% and be reconsidered. What should I do now that things are getting worse can I reapply for the other 20% even though it’s been it’s Ben 10 years!

      Thomas, if you've been seeing a counselor for the condition and have not worked in a while and the VA can verify that, I say go for it. But if you're still working and have not gone to counseling, your claim will most likely be rejected and you risk your existing 80% rating if it's not static.

    I just turned 52 and have 93% and 100% non workability. I was retired in 2010 with 21yrs. The pain management physician wants to reduce me after a 10 minute visit and 1 exercise which then caused me injury the next day. This is all my family has and I'm freaking.

      @@rushtk2112 1) You are protected by the 10 year rule 2) The VA has to give you a hearing AND it can be appealed before the rating reduction is approved. Just show the VA through private medical records that your condition hasn't improved and you will be fine. You only have to worry if you know your rating is shaky and did show real improvement. But if your rating is solid and the VA examiner just lied, you will easily beat the reduction proposal.

      By the way, how did this happen? Are you saying you just went to a VA Hospital or Clinic for normal treatment and out of the blue, the doctor just made up the fact that your condition improved? Or did you file another claim and poked the bear and then a C&P wrote disfavorable info that got the reduction proposal started?

    I’m soon will be 65 years old, this last year they determined I needed hearing aids under the gulf war burn pit examines should I put in for increase rating? I have been in for a CMP board, I’m currently at 70%

    So im 100% due to stoke in 2018 and 70% PTSD from 2017. Since 2019 theyve said they are going to lower to 80% but Im now 57 yo old since then. Actually I have hearing in a few days. Not worried but just trynna see if the over 55yo rule applies to me even tho they are late with granting my hearing. Plz advise. Thks

    Ok what if they made you 100% P&T from some of your claims but deferred the rest then set you up for exams to finish ur claims...?? Can they reduce your P&T status.???

    I am 100% due to prostate cancer. When I got my disability letter from the VA it said that my next exam would be in 2025. If I have something like radiation or another form to get rid of the cancer when do I tell them that I have had a procedure? 2025 or when it is done? I have had some people say waif but I don’t want to get to q025 and then have them tell me that I owe them 1000’s of dollars from the time I went through a procedure. Thanks

    i was rated at 10% for Tinnitus 12 years ago. recently, i was rated 50% for Obstructive sleep apnea for a total of 60%. Is OSA considered a static condition?

    I went in back over 5 years ago to try to get a higher rating. The Quack the g sent me to had me lay on a table lift my legs and that was it No Xrays No MRI. Still only 40% with Arthritis and nerve damage in my back. Service Connected. So now I got a new xray and MRI its way worse than my innical rating over 22 years ago. I'm almost afraid of trying g to get a higher rating level again. Any ideas tk help me

    I am curious why I have a combined rating of 70% when I have a rating for 70% Major Depressive Disorder/PTSD and 10% Residual, left bunionectormy, both service connected? Why don't I get a combined rating of 80%?

    It would be more beneficial to explain the difference in process between mental and physical disabilities. You focus more on physical disabilities when the majority of us have psychiatric issues.

    All my other ratings state "STATIC DISABILITY" except my PTSD that was rated in 2006. It says, "FUTURE EXAM DECEMBER 2008". No exam or notification ever took place and we are now going into 2024? Any answers to this?

    If you're 100% disabled from the service any loss all your paperwork medical record personnel folder and they don't have your right discharge things or your rank can you do something to buy that

    I was 75 when I received a 50% rating. I have heard that once a veteran gets to 75, they will no longer be asked to be reevaluated.

      If it's rated as static and you don't poke the bear, then yes. But if it's a dynamic mental health rating and you don't keep going to counseling/taking meds then yes, you could still be reduced or lose your rating.

    Oh yea, I forgot to mention that the non service connected disability was for migraines I suffered daily that really prevented me from working at that time. They started when I was in my mid 20s back around 1976 or 77.

      There are no "non-service connected" ratings at the VA. You can be rated 100% disabled by Social Security (SSI/SSDI) and get a VA Wartime Pension for it, but you can't get percentage ratings for disabilities that happened outside of the military.

    I had a morphine pain pump implant with the blessing from the VA. It has been removed as it was not doing the job, now I am on medical marijuana and in pain. It is service connected and I am at 70%. I cannot work and find the simple tasks at home is a no deal situation. I cannot work etc but need the 100% to get dental as my teeth are gone, plus in Louisiana I can get a substantial reduction in property taxes etc...please help

    I've got 3 different ratings on my left knee. 30% for limited range of motion, and 2 more for 10% each with each one saying basically the same thing. I don't understand it.

      Because they believe there is a potentiality that your disability can improve over time and they will likely schedule you for future examinations to determine if this is true. If you can show new evidence as to why your disability will not improve or you can claim new disabilities that can be proven they won't improve over time then you can be upgraded to P&T.

    Hi. You mention the 55 year old rule. I just got recently SC at 62YO. Does that apply to me as well, and does that mean any further ratings will be protected? Also, does P&T imply 100% or can it apply to ratings under 100%? Thank you.

      The permanent part yes, but the total part I think implies 100% combined.

    Your benefit presentation is excellent. My rating is 40% + 40% unemployability, service connected, Paid 100% rate, total and permanent. I have questions on possible rate reduction. This has been for 13 years now. I am 75 years old. Am I secure with their rate without a negative change? A lot of veterans feel the VA has the right to do any type of change they deem necessary. Can you help me understand my rating as loss of rating would change my life. Thanks for the help you provide to veterans.

    How about conditions improving due to prescribed medications. With the new VA laws (tinnitus, Mental Health, etc.) I seems a provision was put in that allows VA to reduce a rating if medications are making the veteran better. Is that true?

    I got a decision, an awards letter; however, because it went back to 1979, but, because of the amount and my race, the VA has fought me to prevent me from getting the retroactive pay due. I've been before the Appeals court three times, twice the court sent me back to the BVA for them to decide how much I'm to be paid. All they did was deny my claim even though my pay records did not reflect a full payment of the amount of the award. The third time I went before the appeals court, and even though I proved the VA was providing false information, and the court couldn't rule against the truth so I thought. Instead, I got a memorandum decision, which was based on no facts, just the judge picking a side, and rule against the facts. Furthermore, I had no appeal rights. The court protected the VA despite the fact I had a decision and awards letter that was squashed unofficially.

      Don't take pain meds before examination.... Remember you want them to see the real results of your disabilities... Not that you are ok for 2 hrs due to 500 mgs of Painkillers. Let them see the real impact of your injuries and daily pain and suffering you go through... Be Honst and smart about your symptoms

    I looked over my claim decision again and I don't see anything indicating permanency or not. It just states what has been claimed/rated and nothing more. Is it safe to assume it's permanent?

      Login into Ebenefits->Your VA letters->Letter Generator->Get your VA benefit letter(green box)->View Letters (blue box)->Benefit Summary and Service Verification Letter. Scroll down to 'VA benefit and disability information.' Look for a check box for 'You are considered to be totally and permanently disabled soley due to your service -connected disabilities.'

    what if the VHA is refusing treatment for service connected disabilities, I cant see an ortho doctor for my ortho injuries unless I give them a reason I need to a new reason, same thing for neurological disorders and Blood disorders that have been now declared terminal, I keep getting told I am to complicated to care for, records have been hidden they wont let me put my copies into the file were they were removed. I also have evidence of labs drawn in germany when I was medivac'd out showing high white cell levels and no I got a call a comp and pen exam has been scheduled for a c and p exam for a terminal cancer, the records have been hidden of the developing since 04 and became critical in 2011 when my doctor was under investigation for 9.5 years of neglect he his the evidence my oncology appointment for Multiple myeloma starts 2 days after comp and pen exam. i brought the records to the va to get them readded to the record and they refused to let me and 3 days later my home was broken into and just those records were stolen what do I do? when I got CC referral for oncology I called my old VSO and asked for a motion of intent to file a claim be submitted now I have a comp and pen exam as the proof was discovered of record tampering and retaliation on me for calling my rep for help because they were making me suffer T and P since 2010 they even removed ratings and didnt forward them to the new state I moved to everything from 2004 to 2009 is missing VBA has the ratings but not med files and my doctor was in the military so he was allowed to take my first Germany hospital workup 23 sept 04 and move it to 2005 under a va I didnt goto until 2008 please what do I do my exam is in 3 days

    Ive been a 100% for more than 5 years im 36 I was told I was a static status whatever that means ...but I was told I could work with out worry of reductions as well as Im currently using VocRehab/Edu Benefits....I dont know if im permanent but I think so....VA can be confusing

      Brother, if you're not TDIU then yeah, there are no restrictions on working unless it shows fraud (i.e. you are rated 60% for your back yet go out and work as a UPS truck loader, etc).

    I have stage 4 prostate cancer, has matasized to the bone and left lung. I'm a Vietnam veteran and I'm 73. At 100% now after an appeal when they tried to cut my benefits, but I won the appeal, but still don't have a 100% permanent rating. My oncologist tells me I have this for life and it's not getting any better but I'm afraid to apply for permanent status because I've heard stories they cut benefits if you try to get 100% permanent status. Is that true? Who should I talk to about this?

      I was 100% Scheduler and asked for P&T and they scheduled C&P exams and without evidence my conditions had gotten better, they reduced my ratings. I wouldn't ask, let them do it unless you have some iron clad disabilities that can't be considered to be better.

    I’m 100% combination not p and t, I had a back surgery before getting out of the military, my wife decided to join the Air Force because of the benefits and now we are station in England, I can’t do much with the VA from here but should I get a lawyer or something to get the p and t, or just waited out till they give it to me? I’m sorry I’m just really lost right now.

    I think it’s crap they review our files and if they see something is getting better the send us for a decrease but if they notice we have something that we havnt claimed they don’t send us to get the conditioned services connected or increased.

      70 percent disabled and 30 percent able body for the hearing. Then 70 percent of your 30 percent able body is 21 percent more putting you are 91 percent. Pay is 90 percent rate. Hope that helps.

    This was a very interesting video. My case is a little different form than most. It involves a non service connected ratings of 60% which puts me at about 1260 a month. This puts me just below the poverty level. Anyway, I have a problem with tinnitus that I developed while I was enlisted. About ten years ago I was rated at 10% service connected. Here is the problem. If I was to receive the 10% for the tinnitus they would reduce the non service connection to 60%. How is that fair? Is there any thing that can be done for me at age 70. My thinking that they should be trying to help me get 100%. Can I be help at this stage of the game?

      I'm confused. The VA does not issue percentage ratings for non-service connected conditions. You can get a VA Wartime pension for being 100% disabled by the Social Security Administration or if you are over a certain age, and if you are homeless or close to homeless, you can get financial help through the VA SSVF program. The VA Wartime Pension is pretty close to 60% pay-wise but is not a rating. So I guess I am confused by your comment?

      Exactly, non service connected pension has no percentage attached to it,it may be the equivalent to a 60% rating 🤔 and it is assigned to wartime served veterans, it's similar to ssi, and it's income based

    Still active duty, but disappointed that they continue to reduce ratings to save money. Lobbyist (VFW, MOAA, etc.) should be actively working to retain benefits for veterans who sacrifice so much.

      if you are under 20 years you've not sealed the deal, VA can reduce the amount; there is a law that prevents them from doing so once you are 20 years or more. You're a veteran and receiving compensation from VA, we are lucky ones. I've many vets have gotten nothing.

    Can a widow get a 100 % rating after the veteran has passed due to a service connected disability. The rating at time of death was 70% but the VA accepted the death as service connected. No rating/request was active to increase at time of death.

    I got out in 2013 at 100%. I have been 100% since and still not permanent. I'd like to be so I can get Dental. Right now I am waiting on a rating that was completed on the 28th of June and here we are 8th of July and still nothing. It's good to know people like this exsist

      If your 100 percent scheduler, your entitled to dental. You don’t need P and T for dental.

      @@derrickstinnett2054 trust me you don’t need p and t. If you have 100 percent for pTSD you have non temporary rating. I am 100 percent for PTSD but not permanent and total. I have been getting dental treatment at the VA for seven years. I been treated at three different VA regions. When they say temporary they mean after a surgery or 21 days in the hospital you get paid 100 percent. If you been 100 percent since 2013, you should request p ant t anyway. You already have the five year and 100 percent rule protecting your rating.

      PTSD can be permanent and total. There is nothing in the VA regulations that’s states that mental health conditions are not eligible for dental.

    I’m at 80 for hearing loss. I was a Huey mech. As well as ptsd tinnitus n a few others to make up the 80. Been two yrs so far do I need to be concerned? I can’t work due to another issue no idea where it came from but had a pancreatic biliary bypass where they replumb u and cut u along ribs from side to side. But I have a consult with va this fall to see what’s going on with that. Is it possible they will add this to my rating?

      No, that's a static injury and will never improve. You should definitely qualify for a lot of secondary ratings with that high of an ear-rating and possibly TDIU. And thank you for your service!
