    This was the best explanation of the PACT ACT and some of the most obvious symptoms lists explained that I have seen on TH-cam so far. I filed an Intent to File in March last year got service connected in January this year with 0% compensation but the connection is allowing me to file secondary claims for a lot more problems I’m facing since OIF II. I thought I had lost opportunity to file because my service medical records were lost since 2004 deployment but my battle buddy found it in 2013 and gave it to me. Having retired from the service in 2010. I thank the veterans that paved the way for the PACT ACT, their sacrifice helped many many more veterans to get care and compensation for their service in time of conflict.

    My dad died 8 years after returning from a 2 year stint in Vietnam. Died in a VA hospital and my mother nor him received anything. Pact Act came out and a great VSO is working to making it right.

    Asthma diagnosed after service is on the list of presumptives also. I was diagnosed with asthma over a year ago was in Afghanistan in 2012-2013 with toxic exposure. Filed a claim after seeing private care being a pulmonologist. Was diagnosed and prescribe three different inhalers. Brought all of my medications and doctors visit notes to my C&P exam and was still denied

      That is so wrong that you were denied! I just don't get how so many veterans who have so many probelms cannot get compensated and yet, I have known someone who was perfectly healthy (ex friend who i have seen everyday and she also told me she was cured... she was Air Force) and she gets 100% and social security and it happens with a lot of people. This is wrong! I confronted her about it, hence the ex friend, because it makes me so mad that she is taking advantage of the VA. My husband and I both served in the Navy and had very difficult, dangerous, physical jobs (which i loved and miss... wish i had the health to keep doing it) and have been in the middle east. My husband actually got a brain injury in the military and two years ago was diagnosed with traumatic brain injury and still does not get compensated for it. He has problems everyday because of his TBI and won't get compensated no matter how much we have been fighting for it and sent them proof that he has it and got a head injury while on the job. We also have other problems and were just told about the burn pits which is why I'm here watching this. Knowing your story and other's stories, I'm sure registering for burn pits and our problems, it probably won't get us anywhere either. How are some people able to get compensated so easily and quickly but those with horrible conditions cannot get what they need?

    I am in a uniques position. I worked for CIA while in combat zones for nearly 4 years. I am a Reservist too that devoted 26 years. I did Reserve obligation weekend obligations in the combat zones for like the first 18 months. I was around burn pits and exposed to rafio active material. Any chance to file under Pact Act and get approved? I did file. But did not know if I wasted my time. I have 37 medical issues.

    Excuse me madame but those cancer conditions you mentioned for the Pact Act has alot to do with lung cancer or respiratory. I am a 💯% T &P service connection disabled navy veteran for CML bone marrow cancer but it is leukemia cancer. I applied for the Pact Act for two years and on my last claim in May of 2023 I applied for Non-Hodgkins lymphoma (NHL). I was denied because my evidence was not new or relevant. The reason I chose NHL was it dealt with CML bone marrow cancer which I have. I already mentioned to the VA that I was exposed to toxics as a Radioman (RM3), and with burning classified material in a burn room for seven years as well as being in Saudi Arabia during the Gulf War. I'm scheduled for my next hematology appointment on April 16 2024 and will have my oncologist to write a nexus for a link between my service connection and the in-service disease. This is my only option for the Pact Act especially since I was exposed to toxics. Hopefully it will be granted. I doubt that the VA will ever decide to add leukemia to their list of cancer conditions anytime soon.

    • @kway5046
      @kway5046 8 วันที่ผ่านมา

      @watchman2279 it would probably still be important for the VA to recognize these health issues and have them service connected (even if you are already 100%) because if you die from those reasons and they are service connected, your living spouse may still be able to get some if not all of the compensation. I'm not 100% sure on that but I know with me, I still want the VA to recognize service connected issues that I have. I'm still not technically 100% (it's crazy how difficult it is to get 100% when you have real legit issues that can never be cured... i have to live with a lot of my pain for the rest of my life) but even if I was 100%, I still want to be treated for the issues I got from being in the military.

      I'm so sorry to hear this. It just boils my blood when I hear about other veterans that are really suffering and still cannot get 100%! I have an ex friend from PA (she was in the Air Force) who told me to my face that she is completely cured (she had depression from a divorce and supposedly got some kidney problems from the depression pills) but will at times tell me that she is getting 100% and social security and even showed me her typed out budget and how much free money she makes. Later I confronted her about it and that she is taking advantage of the VA and how wrong that is because there are people who are legitimately going through things that can never be cured/ major diseases that still do not get 100% because of people like her! I am also disabled and still not 100% and I have been told by doctors that there is nothing they can do for me but just manage my pain. I hate that you are going through this and you are not getting what you deserve. I have seen too many of these situations with veterans that they do not get what they need but those who take advantage of the system get everything that people like you deserve. It p*$$es me off! I wish there was something I can do. I am surprised that this happens to veterans and that others get compensated easily and have no problems. I get that if you just see someone, it can look like they don't have problems but my ex friend, I was with her almost everyday in her house or mine and I know the things she is able to do and the things she told me. I may look normal but if you live with me or see me everyday, you know I have many problems. I have some good days but more bad days then good. When I have my good days, it's such a blessing that I just want to actually get outside or do something with my kid or try to catch up on dishes or something. Again, I am so sorry this is happening to you and I really hope you got 100%. It's hard living with many problems... one problem leads to another and another and it's depressing and hard to live with.. thats why our veterans who have these problems deserve 100% for their sacrifice to serve our country. The military really beats some of our bodies down so much and it gives us limited options for jobs and just a limited way to live. Sorry, I'm sitting here sick, so sick, and that's why I'm on this channel because I have been hearing about the PACT ACT and wanted to know more about it. I have been in the middle east too and can't figure out why I am always so sick. I haven't looked into burn pits for me yet so I'm sitting here bored, sick, and ticked haha I'm sorry for going off and sorry for the long comment. I'm passionate about veterans getting what they deserve.

    Under what circumstances do multiple Zero % Service-Connected Conditions add up to 10%?..I have 4 Zero Percent Service Connections. Shouldn't that equate to two 10% Ratings ?

    • @woodslawyers
      @woodslawyers  2 หลายเดือนก่อน

      VA math is confusing. We provide this free VA disability rating calculator to help you estimate your combined VA rating. In VA math, 80% disability plus another 20% disability doesn’t add up to a 100% rating. We use all of the current ratings and update the calculator regularly. You don’t need a VA disability math chart with our handy calculator. These rates are effective from December 1, 2023 to November 30, 2024, so while the law was passed in 2023, these are considered the 2024 VA disability rates. www.woodslawyers.com/va-disability-benefits-rating-calculator-for-veterans/?.com&BurnPitPresumptivesLori&CommentShare

    I applied for the VA health benefits based on service in Bahrain and Kuwait from during my enlistment from 1997 to 1999. I received the benefit. Let's say I have or develop one of the presumptive conditions you mentioned. If I file a claim for it, do I have to establish that I knew there was a burn pit near me or is that already presumed? I never worked on a pit directly. I am aware of metal drums that they burned items in, but I assumed that the items burned were paper. Would these qualify as burn pits? With that said, I cannot say there were not other burning sites or pits near me, since I was not aware of everything occurring near me.

    • @woodslawyers
      @woodslawyers  5 หลายเดือนก่อน

      The VA assumes that there are certain conditions linked to the unique circumstances of a veteran’s military service. If you’re diagnosed with a presumptive condition, you do not need to prove the medical nexus (connection) between your condition and your service to be eligible for VA compensation. Veterans who served after Aug. 2, 1990 in any of these locations: Bahrain, Iraq, Kuwait, Oman, Qatar, Saudi Arabia, Somalia, UAE, or the airspace above any of these locations are eligible for presumptive VA benefits.

    So, if we haven't yet filed a claim or an intent we cannot get benefits?

    • @woodslawyers
      @woodslawyers  วันที่ผ่านมา

      Correct. To receive VA disability benefits you must file a claim. An intent to file creates an effective date for your claim for compensation. Your effective date is the date you can start receiving VA disability benefits for a specific condition. You might want to submit an intent to file because if your claim is approved, you could receive retroactive payments back to the day your intent to file was received by the VA. In other words, you could be paid for the time it takes you to research and file your claim.
      However, it’s important to note that you have up to a year (365 days) to file your claim for benefits after you submit an intent to file. If you do not submit your claim during the one year following your intent to file, your effective date will relate back to the date you submit your application for benefits rather than the earlier date of your intent to file.

    So it doesn't cover the "20th century?"
    Does this cover Kazakhstan and would it be possible to reimburse a veteran, who didn't know about or how to use the VA after service, for their own costs and lost civilian work dollars?
    This is all before digitization and internet really took off.
    I learned the paperwork was lost in fire at a facility at one point, so a person does not exist in that paperwork area.

    Hi could you tell me if being on Mt St Helens a day or two after it erupted breathing in toxic ash and walking through knee high ash all without PPE such as a mask, googles or a body suit to protect the skin. Mt St Helen is not one of the listed environments included in the presumptive areas.

      Even if you don’t have these conditions now but have served at places with these burn pits and conditions, you would still want to fill out the questionnaire and get on the registry because if you develop the conditions later, it’s covered and will be service connected.

      This video only covers what the PACT Act added for burn pit exposed veterans. However, the Act included updates for other toxic-exposed veterans too.
      Agent Orange exposed veterans with hypertension (high blood pressure) or monoclonal gammopathies can now be service connected on a presumptive basis.
      The PACT Act has also expanded eligibility for VA disability benefits related to Agent Orange to military members who served in additional locations.
      Here’s some additional information about that:

    I was in the Navy as Damage Controlman. Got hurt on my Vertebra by my superior as Hate Crime. After fighting over 14 Years , now finally I am %100 p&t since feb 2023. I do not have cancer, i did not bother filing for pact act even though i was in Kuwait, iraqi waters in 2007(feb-jun) i am concern this pact act might create havic in my life, open up my ratings and danger my 100% status.. What you think Ma'am? And is there any one has any professional suggestions or ideas?

      If a veteran is happy with their current rating, then it is not necessary to file new claims. The choice is ultimately up to the veteran!
