From what I understood he said about the changes is that he ripped the Total War files and modified them in order to make them printable (close gaps, fill the volume rather than have them be a digital skin) not make aesthetic changes.
Etsy people are still selling physical models, and whats worse is that he can be punished by GW further more because of this.
But even though the models are from CA total war, the over all IP is from GW through contract.
Its interesting how fast this has hit the internet. Almost all listings for prints of his STLs have been removed from etsy within the past few hours. Kind of a shame, as the ratling gunners were better than any GW has ever made, but that's my loss for not buying them sooner.

you can use the ripped displacement and normal maps to regenerate the detailed geometry with a little clean up.

Gw is shitty, and have been for a long time. But it is equally shitty to go around twisting the story / omitting important details and exploiting that pre-existing fact to play for sympathy from the masses. That's going to do him a lot of damage whether he's mis-speaking, getting his facts wrong or straight up lying. Not to mention I REALLLLY hope his time on side scrollers wasn't solely a ploy to milk ppl for gofundme money for his case... but it's kind of obvious that's what it was.

It's something I would be interested to see an equally large company argue in court. I suspect legally, the line between plagiarism and adaptation is wherever you can afford to make it.
@bbtdltd8081 you rip the low poly base mesh, and then use the normal and displacement map to rebuild the high poly version.
It requires a bit of clean up, but it's not too much work.

2:26 - Copyright claims board, per their own FAQ have a significantly lower standard of proof that goes along with the lack expert witnesses (under the excuse that the 80 year old "copyright experts" they have that cant even open excel are enough), limited/virtual only discovery and most of all if money is not the case, and even tho there is a lack of the vast majority of actual judicial processes required to be fulfilled in any normal court case their "judgements" are still binding (how the US allows a clown car of money laundering not subject to the legislative branch, instead solely to the lobbying parties and copyright office per their own funding info on dot gov, to actually give legally binding decisions is beyond me, but hey US... and at least the CCB cant be used as precedent for real legal proceedings for the burgerlanders/others cant be fucked over because a copyright troll case).
7:23 - Not internationally and especially not in the EU which still follows the BC for IP where all private and personal use of copyrighted material as well as altered/different expression to the copyrighted material are explicitly not infringement of IP/has no requirement even to request the original author, rep, publisher or distributor for approval or other forms of licensing (does still breach the cults account rules tho).
14:51 - Like a sneaky snake, he did technically explain exactly what he did which was correct, but without knowing (e.g. the difference between a displacement effect being sculpted, calced or booleand as new topology vs texture (where the model is flat, but looks as if it isn't OR the difference between manifold vs non-manifold geometry, essentially that there are no holes or multiple edges/vert connection points which cross creating a new "hole" in the model) the details of it, it sounds a lot more as if it was very significant work (it still is quite time consuming, but so is e.g. image extrusion resculpts or cleaning up scans, both of which can result in nearly identical models in about the same time, only the first you start with a image and a (z-)sphere or box (... or if a sicko a cylinder) in your sculpting tool of preference while the second is mashing around 1300 images taken of a slowly rotating model.
Overall, while EG is still as the basket weavers, Ps and and the blue paper plane folk say "a rotten tau forehead" (i think their list other than lying was the money begging, delaying model fixes, copying banners and weapons from another persons patreon, etc), GW is just as much of a petty whore for going through a non-court over in half outright lies (that models cant be printed if the stl doesnt come pre-supported and that the free cults models were ip infringement when no commercial right was being breached, especially not GWs as CA is the ones who own the work for hire goods done for the expression of the copyright licensed to them by GW), especially when most models if you compare/open the game file vs the archive forms of the stls in blender. dont match 1:1 in as mentioned most cases... because ofc you have to fix, retopo and apply displacement to have the texture actually be part of the mesh and if doing 3d models for printing well, care to actually alter detail size, as many overlapping points where small contact+sharp edges could be girth of thin parts like blades which in games are often not even 3d but just a single face/2d with good normals, displace based on high res unwrap and shader based albedo layers; tho as said even in the other video some obviously still are just texture as UW booled default models with no real alterations (iirc screamers and old version of bloodletters were examples someone posted even way back).
TLDR: the rrats have always been real, always trust the N-chans for they follow the great horned rat

@@RobotCrafter1 I wouldn't go that far directly, simply because in the end he was (indirectly) using the content for commercial use, which you just plain shouldn't in heavy gray zones such as to what degree is "fixing, texturing, detail tweaking and posing a model of a character" no longer the same expression of a IP.
Irony is as Cults is a french company, if he didnt have the patron nor etsy and just did what a certain food-based-innunedo-battlemace-adjacent-model-maker does of linking a secondary repository of the models in the files with a smaller model such as a weapon or banner, GW wouldnt have even the loosest of ground in the first place (as private and personal use doesn't require permission from IP holder even in 1:1 copy cases in EU/such use is explicitly excluded from IP protections and since 09 even repeated that point specifically for private copies of digital goods).
Much like with video game mods, keeping it fully non-commercial is the best move both from regular hobby passion and from a business standpoint as outside of a few countries copyright and co/legal protection of commercial intellectual property rights is then no longer a issue and it would take 6+ years in a trade court just to ATTEMPT prove any damages (at which point the lawyers and sheer time cost the business suing more than any potential losses and its still risky as hell because in nearly all cases courts sided with "authors moral rights may have been bent but no IP breach happened", also much like video game piracy lost sales arguments that never went anywhere once under scrutiny).

@@corvus_armatura7595 Yes the models were free however, you could subscribe to his Patron to get supported models. So instead of having to place supports before printing, you can just drag and drop into your desired 3D printer slicer.

several things didn't add up for me about the initial when i saw it:
1: it seemed strange to me that they'd actually take a 3d printer guy to court right off the bat when they just went the c&d route with companies like artel w who were actually selling models of gw characters from both some of the games (the three warlords from dawn of war 3) and other characters based way too closely to gw art like inquisitor gregor eisenhorn) artel were selling those for months (or a year or more in some cases) and the only action gw took was a c&d and they later let artel distribute the models as free stl files
2: the first models i could see of his when i googled him looked like just straight up 3d rips of belakor, a great unclean one, skaven ratling gunner and a few other things
3: the first places i saw covering this didn't seem like reputable warhammer news channels, instead it was outrage farming channels who's main coverage of warhammer is just outrage bait content and from what i could tell didn't have a single bit of warhammer content that wasn't outrage farming (not even a lore video or miniatures video)
So i am glad i held off talking about it in video form
My experience was very different when looking into it (again, fully my fault for not doing better and entirely my responsibility for what I reported initially)
On the first point, GW have an extensive record of being overly litigious and going after the little guy. So I didn't find it suspect nor odd that they'd be harassing a smalltime stl producer making proxies. That sounded exactly like something they would do.
In regards to the minis though, I looked em up and found the Green Knight and Grimgor. I did clock they looked close but I thought they looked different in some regards (hindsight being what it is, I was probably just blinded by my assumptions) I also figured the rest were more deviated.
As for the third, I only saw the Side Scrollers interview and a twitter post. Not a lot, I know. Again my big f-up. Aldo just clarifying you're not talking my channel in regards to the 3rd point. Cause I have several of both lore and miniature vids. Not much lately admittedly but still several in the 'ol channel catalogue lol

I'm not the biggest fan of GW, especially after they fucked over my towns local hobby shop for the last month to the point that they might not carry their stuff anymore, but this guys story sounded fishy when i first heard it, specially with the way he answered the question about how he got the files.

He's an unfortunate casualty. Because at a minimum- this should be a message to GW about how easy it is for someone with the ability to make an STL and access to a 3D printer to basically undermine them. They should keep that in mind the next time they announce an 'unfortunately necessary price hike'. At this point, the game is simply not affordable- but they're fully aware of that, because the objective is to make it so you can't afford anything else from a competitor if you're playing 40k/AoS (and I got that straight from a Nottingham GW employee that worked with the executive office).
Quite honestly, when a game costs this much to play- I can't blame people for seeking out alternatives. On top of that, the actual game mechanics don't justify the price point and work it takes to get an army on the table. Yes, GW makes some fantastic models- much better than anyone else, especially when you factor in the conversion capability and customization. But... it's just not worth it.

GW stole almost all their ideas. Screwing a little guy harshly versus slightly less harshly isn't really much different.
Inspiration is different from theft. Just because you don't like GW, doesn't mean they deserve this. Stealing from big or small creators is not right.

@@szymonrozanski6938 Technically the chaos star isnt a pixel perfect copy, its a copy of modified version of the D&D redesign (they did 3 versions, the smaller flat/sidways square one, the smaller inner arrows that is reminiscent of 40k belt chaos signs and the base EC equal size arrows but with a ring, iirc all 3 were present in deities and demigods) of the EC chaos compass.
As the actual original Eternal Champion chaos star is just the cardinal and intercardinal arrows compass rose as can be found on myriad a map. Crooked details (and discarded ring) were additions by secondary sources back when Moorcock wasnt sniffing his own butt as much/didnt learn that behavior yet from his then publishers.
GW created distinctions. There is a difference between inspiration and theft.
@@szymonrozanski6938 I don't know where you got the Tolkien estate lawsuit from, the closest I could find was a suit against DnD. GW's litigiousness aside, they do majorly change what they take inspiration from.
Space Marines - no one before GW made them genetically enhanced warrior monks worshiping a god emperor.
Tyrranids - Obvious xenomorph rip off, but has the added feature of gaining new material from what they eat, travelling the stars on flesh ships, and being part of a hive-mind.
Eldar - Elves with Celtic, Japanese, and Egyptian influence.
Necrons - The terminator but with Egyptian themes and the best 40k character.
I don't want to defend GW but their work is transformative, it might not meet the standard which GW usually places on other creators but it does meet the legal standard.

Eman made a number of huge mistakes, but we would have probably never found out if he hadn't gone on Side Scrollers and lied like he did. Hell, I would dare say he shouldn't have gone on the show to begin with. If you're in the middle of litigation or settlement talks, it's generally not a good idea to talk about it until it's all over.
This should go without saying, but I am not pro-GW. I dislike the company a fair bit. That said, legally speaking they are not only in the right but also playing with kiddie gloves. Asmo hates GW way more than me, so if he can look at the facts of the matter and reach this conclusion... we all can.

I had said this on other videos but GW is still a bad company. However, copyright infringement exists to protect literally anyone and everyone who has a claim to something, so this is completely fair from the very beginning.
Naw if you send out Cease and Desist letter or Order, you send it certified mail it get there in about 2 day max. I send legal documents to former tenants.. so I kind of know. if you don't send it certified mail with tracking data. if not you use a process server to hand deliver the documents which defendant and the processor server sign and date a log sheet.
Thank you for the truth. I do not like GW at all, I have a tendency to believe what EmanG has said because he has accused GW of things that they have done in the past. It is important to know the truth when dealing with GW, After all you would not normally need to make any thing up because GW are vexatious litigants. That is why most people took EmanG on his word. According to the U.S. Copyright Claims board FAQ:
The Copyright Claims Board (CCB) is an alternative forum to federal court to resolve copyright disputes up to $30,000 total (called “small claims”).

They can, but through individual claims.
GW filed 14 and from what in the consolidation can be seen at least 8 more claims.
However they also say without hard evidence (which... its the CCB, thus any random shit qualifies as evidence due to lack of even basic court minimum standards) its rare for any claim to go beyond 1/3rd of the maximum according to statements of folks that dealt with it.
The fact it can be said that you "stole" the files from a game you paid for is wild.
Because you paid for the game. Not the copyright to everything within that game. That has never been the way that has worked. Ever.
If you buy a book and copy the text within it verbatim and then publish it under your name, that is just as much theft as ripping a 3D model from a video game, make no changes to it to make it your own and selling under your name.
@Asmogan I understand the idea, I was referring more to the idea that it's illegal to access the files and modify them at all, which is what it sounded like was the issue. It's like how car manufacturers want to make it illegal to repair or modify your own car. Obviously it's illegal to rip the model and sell it as your own IP.
@@alexanderm8880 tbf GW does have one up on this guy, this patreon had printable stuff while the free was not so. But in that regard the models are all not copyright. I looked at them, some are literally basic ideas as they state from sci-fi(should've stated fantasy in the case). Those models are well above what GW ones look like, and again it can be argued both ways how similar this ideas are to just doom enemies(average demon enemies). But I'm not giving GW any victories.

I disagree, more due to the fact that alot of alternative sculpts are created from scratch and can be distincted enough, what he did was rip model files from gw licensed games and using them as his own that Is just blatant theft
I disagree heavily. It's not hypocrisy at all as my problem isn't that the models were ripped, it's that they weren't altered in ANY significant way to adhere to copyright/fair use. I said as much in the video. Feel free to re-watch and listen carefully. The core issue is that you cannot use 1:1 models of existing copyrighted designs regardless of how the models you are distributing were obtained, they NEED to be altered and made noticeably unique to the copyrighted designs. Otherwise you are just committing theft.
@@MichaelBrown-gc6li The difference between tweaking a rip (or a scan) to add details and make it printable vs making a model from scratch are around 3-4 hours of one afternoon assuming one already got the game and modtools (or for scan already took the hundreds of pictures for the photogrammetry software, assuming its one that can spew out anything better than a vague shape), so not exactly.
You still shouldnt be making a patreon to profit off paywall, timegate and effectively just adding auto-supports and going through Uvtools over it twice to add any to missed islands, but you cant take most games (especially not anything from CA) meshes and slap them for print.
