  • Bryan Kohberger returns to court today for a hearing as his defense team asks Judge John Judge to order the prosecution to turn over more evidence they want to prepare for trial. The hearing was initially scheduled to be closed to the public but Judge Judge determined the witness could testify in open court. Kohberger has pleaded not guilty to murdering four University of Idaho students in November 2022.

      The case was brought on by law enforcement and prosecution. They are the origin of the dysfunction.
      If Bill Thompson had some semblance of prosecutorial professionalism, he would have vetted the evidence before bringing these charges. Now he just sits there, silent, head rested on his knuckles, skin hue oscillating between the spectrum of red and purple.

    Prosecution got spanked today, they have security guards leading a 4 person homicide, this is unacceptable a guilty person might walk, or a innocent person might be put to death, shame on the chief of police, shame on Idaho state police

    I can't believe ANY polilce department let files go unread and/or misplaced in a case involving the loss of four lives. It's not like Moscow police has tons and tons of serious crimes to take their attention off this case. I also hope this court gets its audio fixed soon. They need to talk to the Daybell trial people - theirs sounded just as bad at first, then suddenly on day 4 it was fixed. I am SO embarrassed for this police department!!! It sounds like they should have just given the entire investigation over to the FBI or at least the State Police, since it looks like they couldn't keep up with the job .... or even keep track of the evidence and files!!

      I totally believe Bryan Kohberger is innocent! This is the first case I’ve followed that I believe is innocent. Bryan was so close to getting his doctorate. I do not believe that he could stab 4 victims over 55+ times on different levels of the home and fight with Ethan in 8 minutes! No blood in his car or apartment. Even if a vehicle is cleaned, there would still be evidence of blood. I suspect that someone who knew the victims committed these murders. I’ve also read there’s a big problem with drug trafficking there.

    This is infruiating. Police created exhibits of evidence are not evidence, only the original evidence is evidence. In this instance its the AT&T records, not a screen shot of whatever bits of that data made it into a CAST program.

      I believe Bryan Kohberger is innocent for many reasons! He’s the scapegoat for this incompetent law enforcement! It has been proven he was not stalking them and did not know them! There’s also a huge problem with drug trafficking there.

      @mycrimetime he's one of many- who aren't trained to handle the information they're handling. One of many- and can't tell the defense attorney WHO she should be asking to speak with to get the info she needs.
      An incohesive team consisting of multiple untrained, unskilled, unlicensed, people who "don't know" and "can't answer" and "are unsure" or "aren't the right person."
      This detective should not have been tasked with extracting information from this piece of evidence- he had no idea what he was doing and didn't document his work.

      That's not what's happening. And most of these cops have worked in big cities before. Besides there's tons of murders in small towns. Every 48hrs and Dateline says " things like this don't happen here " and I haven't seen a NYC LA or Seattle or Chicago etc case for years. They are all in small towns. Seems like Ohio and Idaho and other rural areas have a lot of crimes. There's some of the biggest drug busts there too. My ex is DEA and my dad is a ( ret. ) Fed judge. So not sure what your comment means. It's actually bigger cities that corruption seems to be more common. Idaho is not Mayberry honey.

      @CramaLand the reports and recordings the detective testified to that he didn't know he had custody of. That is evidence. We don't know who gave him this evidence, who last accessed them, who created them, the information they used to create them. Nothing. Chain of custody doesn't involve just physical evidence. It follows *all* evidence. People have to be able to testify that the reports they are reading testifying on are the SAME reports they created in the first place. If they weren't the last person to have accessed those reports, they can't testify with certainty that any report is unaltered from the original they created.

The frat house needs to be investigated about the boys walking with hoodies on about 3 or 4 of them walking towards the house around the time of the murders. But even if there was a video of him committing the crime, the court doesn't have the power to strip his right to a fair trial and throw the rules of the legal system out the window. Prosecutors still have to do their jobs and follow procedure, but they aren't, which is why so much time is being wasted on these motion to compel hearings. It's a shame for the victims and their families that the prosecution's office is dragging this out so much instead of doing what they're supposed to do.

      I don't know the reason for this, because there are a lot of stuff that they are supposed to turn over but haven't. One of the many excuses that have been made is that the FBI is moving very slowly, so they simply don't have it yet. For whatever reason, this was never turned over. But they magically found the file the day before this hearing.

      BK waived his right to a speedy trial, most likely at the recommendation of AT, as she's an excellent atty and knows that there's a reason the State is playing games with not turning over evidence. She needs time to fight to obtain the evidence in order to argue their case. Hence, this hearing on one of their many motions asking for evidence to be turned over.

      Yes, the detective was woefully unprepared. It's a shame the prosecution won't comply and share the evidence they've been compelled to share since early 2023. This trial should have already happened but they're dragging their feet and still haven't produced the evidence related to the PCA that was issued in 2022. Like you said, wasting the court's time.
