I believe he did a subpar job, but yeah, the plaintiff didn't do everything correctly for his proof. He should have paid at least 2 companies to actually come over to give a real estimate. Many roofers will give free estimates, but if he had to pay, just add those fees to the suit.

I’ve seen a video of a insurance inspector telling roofers they are doing the job wrong and they kept asking him how am I supposed to do it then and his reply every time is I don’t know I’m not a roofer…. Lol he was just looking to deny the insurance claim.
this is why i never became a licensed contractor . its better to be hired by a homeowner to do work as a non licensed person hired to do a specific job for the homeowner . this way your work is not warrantied automatically by law just because u are licensed .
For a person who is as seasoned as the plaintiff is, taking the word of a contractor is childish! I have all my dealings with contractors in writing and I don't pay the full amount for all the work that is completed.
While this is true, it doesn’t absolve the defendant of having done a shoddy job. But yes, just because someone is a good friend/neighbor doesn’t make them a good business person, so the familiarity shouldn’t come into play when doing business.

My sister bought a house and had to battle with the insurance company to get it insured over a type of roof shingle. Since it was a family sale she got a good price on the house, otherwise if it was sold to a private buyer they would ask for all the shingles to be replaced since they were not up to insurable standard despite being physically sound.

HOPEFULLY. The contractor himself stated that there's nothing wrong "YET." As a contractor that seems quite certain that something will leak eventually, why not just take care of it now? If he waits and the leak(s) causes more damage not only to the outside but also the interior of the home, it's certainly going to end up costing him more than if he had just corrected the faulty workmanship now. Also, if the planttiff is trying to sell the property and can't because the roof doesn't pass inspection, then there is obviously something wrong with it. The planttiff should make sure that the 10 year warranty is transferable to the new owners and have it in writing. A new roof is a huge selling point, especially if it's done properly and comes with a warranty. The seller needs to be certain to leave the original receipt with the warranty details either in the house or bring it to the closing so that the new owner has proof of warranty. The seller also needs to keep a copy of the contract for his records. I had a pitched, large duplex roof and a flat hot tar roof replaced on my home in Wisconsin during a terrible winter storm and extremely cold weather. They removed 2 layers of asphalt shingles, a layer cedar shakes, and nearly every piece of plywood sheeting, drip edge, and trim. Removed all the garage trim, drip edge, loose rubber, and a few pieces of plywood sheeting on the garage. I worried about whether the rubber would adhere and if the shingles would ashere to each other properly, and it turns out that everything not only adhered properly, but it also looked beautiful. I sold the home 6 months later, and when the purchaser had their inspection done, I was there, and the inspector asked me when I had the roof done, and by whom. He told the buyers that he had never seen such a quality roof job in his 26 years of doing inspections. I had rain gutters done the week after the roof, and he said the same thing about them. It's been 17 years since I had the work done, and it still looks just as beautiful, and the garage roof doesn't have one leak in it. The property is for sale again so I was able to see the home again and talk to the owners. Personally I thought the guys were crazy to be on my ice, and snow covered roof in January when I came home and seen them, but hey it's Wisconsin, we keep working through it all, lol. I left all the warranty paperwork on the kitchen counter for numerous items, and the buyers were very thankful. Just an FYI, if anyone is considering selling their home, it helps the value more than you might think.
I agree 100%. I would also say that you can't go by the inspector. I had inspector and he didn't catch so much stuff when I got my home it wasn't even funny. After that I have talk to a few inspectors and found a lot don't know what they are doing. It's sad but true. Also I don't care if it's ten dollars but if he don't pay in full don't call and think you will get warranty.
I always get work done by word of mouth from someone I trust. I've had so much horrible service over the years by people that I didn't get a recommendation first.

I don't agree with this one! The warranty was for leaks. There is no proof of leaks. Cosmetic issues should have been addressed at the end of the work not a year later. Inspectors normally don't know more than what the book says. Also the $60 may seem small but it's part of the contract. What if the contractor did all but the last one percent of the work. That would be a big deal. Seems like the guy got a $560 discount for annoying everyone.

I'm sorry but if you don't completely pay someone for their work, yes whatever warranty you were going to get should be voided. You get a warranty with payment in full. If you don't completely pay, you don't get any kind of guarantee for anything.

I had a home inspector come to my house when I switched home owner's insurance companies. The guy was a joke. He didn't really inspect anything, he just walked around taking pictures (inside & outside). My house is spread out, so I have three A/C units that are up in two separate attics, but the guy didn't want to bother climbing up the ladder to look at them. He just took my word for it that everything was good up there. When I got the report back a few days later, and the only issue they had was (in one of the photos taken at a bad angle) it looked like a branch from an oak tree was extended over the top of my roof, and they wanted me to have it trimmed back. Well, it wasn't. I just climbed up a ladder and took a better picture to clearly show that it wasn't... and they were good with it. The inspector was a moron.

What about the inspection? That did indicate what was done incorrectly and what was needed to be fixed. He did not pass if the repair says that it’s correct. She would have taken it with a car estimate. It’s not broke or leaking but can’t pass the inspection 🤷🏾♀️. He should have gotten at least $1,000.
Youre confusing the inspection done by the city with the inspection done by the home buyer. There is no "pass" by the home inspector, they just document what they see so the potiental buyer knows everything. The only "pass" comes from the city to ensure that the repairs are up to code, something that the defendant says passed meaning everything is up to code and done properly.
The attitude from both parties here was infuriating. The plaintiff quipped: "can I talk now?". The mansplaining defendant didnt shine either as he was disrepectfully leaning on the judges bench, interrupting and incorrectly finishing the judges' sentences. I immediately tune out ignorant twits that start with: "Now here's the thing...". Interesting case of rough justice here. The paintiff would've prevailed with a receipt and doesn't deserve emotional damages. Every house or building in his city must be passed by him to meet council guidelines. Hes only been a builder all his life and wouldn’t have got the job had he not.

What about the inspection? That did indicate what was done incorrectly and what was needed to be fixed. He did not pass if the repair says that it’s correct. She would have taken it with a car estimate. It’s not broke or leaking but can’t pass the inspection 🤷🏾♀️. He should have gotten at least $1,000.
Youre confusing the inspection done by the city with the inspection done by the home buyer. There is no "pass" by the home inspector, they just document what they see so the potiental buyer knows everything. The only "pass" comes from the city to ensure that the repairs are up to code, something that the defendant says passed meaning everything is up to code and done properly.

The attitude from both parties here was infuriating. The plaintiff quipped: "can I talk now?". The mansplaining defendant didnt shine either as he was disrepectfully leaning on the judges bench, interrupting and incorrectly finishing the judges' sentences. I immediately tune out ignorant twits that start with: "Now here's the thing...".
Interesting case of rough justice here. The paintiff would've prevailed with a receipt and doesn't deserve emotional damages.
I bet the defendant is going to regret working on that roof as it looks like a roof with old parts and lots of problems. He'll be back up there doing repairs soon enough I'm sure.

I hate how cheap the judge always is! She always gives the least amount possible or tries to over talk people so they can’t finish what they’re saying bc then she might have to give more money! It comes out of her pocket and her shows budget otherwise I guarantee if she wasn’t paying the judgement she would award people a lot more money!

$500 judgment was a Slap in the face! This was a bad ruling in my opinion. The plentiful should have got a bigger portion of his money back. The judge seems like she favored the defendant for whatever reasons 🤔🤔🤔 & she was kinda being rude to the plaintiff! Hated ittt
He didn’t do a tradesman quality job proven by inspection. The plaintiff lost a sale for his property because of it. I would be angry to after paying 6k.
the plaintiff's answer to doug's question says it all , his answer was that he was gonna leave the roof as is with no further repairs . that means he is admitting the work was done well enough to not need any further repairs . he should have never got that 500 .

@@marleonetti7 why would I read other comments to determine what to say? I know two building inspectors who are employed by the govt. one in fact was my best man at my wedding many years ago. Every house or building in his city must be passed by him to meet council guidelines. Hes only been a builder all his life and wouldn’t have got the job had he not.
